NS-2424 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING VARIOUS SECTIONS OF CHAPTER 36 OF THE SANTA ANA MUNICIPAL CODE TO PROHIBIT SKATEBOARDING AND ROLLER SKATING IN THE CIVIC CENTER PLAZA WHEREAS, the City of Santa Ana desires to ensure the safety of pedestrians and vehicular travel within City limits; and WHEREAS, public property is being defaced by the usa of skateboards and roller skates in areas such as the Civic Center; and WHEREAS, the usa of skateboards and roller skates pose significant hazards to pedestrians in the Civic Center because of the high concentration of pedestrians as well as the regular usa of pedestrian walkways such as stairwells, retaining walls near sidewalks and handrails as skating areas; and WHEREAS, it has become necessary to ban the usa of such recreational equipment to avoid further damage and potential injuries to residents and visitors of Santa Ana; and WHEREAS, the use of skateboards on sidewalks in business districts is currently prohibited, however, roller skating on sidewalks in business districts, which is not regulated, presents the same hazards as skateboarding; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOVVS: SECTION 1: That Santa Ana Municipal Code saction 36-17-36-24 is hereby adopted to read as follows: Sec. 36-17. Roller skate. Roller skate shall mean any footwear or device with any number of wheels which may be attached to the foot or footwear and which is designed to be or can be propelled by human power, and which is not classified as a bicycle or skateboard in this Code. This definition includes, but is not limited to, in-line skates. Sec. 36-18. Civic Center. For purposes of this Chapter the Civic Center is that area in the City of Santa Ana, County of Orange, State of California, bounded by Sycamore Street on the east, Civic Center Drive West on the north, Shelton Street on the west, and Santa Ana Boulevard on the south. Ordinance No. NS-2424 Page I of 4 5O Secs. 36-19-36-24. Reserved. SECTION 2: That Santa Ana Municipal Code section 36-41 is hereby adopted to read as follows: Sec. 36-41. Miscellaneous driving movements and acts prohibited. No person shall: (1) Drive between the vehicles comprising a funeral procession while it is in motion and when such vehicles are identified as part of such procession by the display upon the outside of each vehicle of a pennant or other identifying insignia or by such other method as may be determined and designated by the chief of police. This provision shall not apply at intersections where traffic is controlled by traffic-control signals or police officers. (2) While riding any bicycle, motorcycle, coaster, skateboard, motorized skateboard, roller skates, or any toy vehicle, attach the same or himself to any moving vehicle upon any roadway, and no person driving any vehicle shall permit the same to be done. (3) Drive any motor vehicle within or over any sidewalk area or any parkway except at a driveway. (4) Drive over or across any new pavement or freshly painted marking, when any street barrier, sign or marking is in place, warning persons not to ddve over or across the same, or when a sign is in place stating that the street, or any portion thereof, is closed. (5) Drive or operate a vehicle contrary to the directions or provisions of any barrier or sign erected pursuant to the provisions of any ordinance of the city, or by any public utilities, or by any department of the city, or by any other person pursuant to law or contract with the city, and no unauthorized person shall move or alter the position of any such barrier or sign. (6) Drive a vehicle onto or from any freeway except at such entrances and exits as are established by public authority. (7) Park any vehicle within three hundred (300) feet of any fire apparatus which is stopped in answer to a fire alarm. (8) Ride a bicycle or skateboard upon a sidewalk within a business district, as that term is defined in California Vehicle Code, Section 235. Whenever Ordinance No. NS-2424 Page 2 of 4 51 any person is dding a bicycle or skateboard upon a sidewalk other than in a business district, or in any other public place, such person shall yield the right-of-way to any pedestrian. (9) Drive a vehicle into an intersection or a marked crosswalk unless thers is sufficient space on the other side of the intersection or crosswalk to accommodate the vehicle he is operating without obstructing the passage of other vehicles or pedestrians in such intersection or crosswalk, notwithstanding any official traffic-control device or signal indication to proceed. (10) Drive any motor vehicle upon or over a median. (11) Ride a skateboard or use roller skates within the Civic Center. Any person convicted of violating this subsection shall be punished by a fine which shall not exceed twenty five dollars ($25.00) and for any subsequent convictions within one year shall be punished with a fine which does not exceed seventy five dollars ($75.00).
