ORDINANCE NO. NS-2435
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA AMENDING THE HOURS OF
OPERATION APPLICABLE TO THE RETAIL USES
IN SPECIFIC DEVELOPMENT NO. 39 (ZOA 00-04)
WHEREAS, this Council, by its Ordinance No. NS-1856, adopted July 7, 1986,
rezoned property located at the Northwest corner of First Street and Broadway, more
specifically described in said ordinance, to Specific Development Plan No. 39 for such
property; and
WHEREAS, it is now desired to allow a change in the hours of operation for the
retail uses in SD No. 39.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES
ORDAIN that Specific Development Plan No. 39, Section 6, "Operational Standards,"
subsection A.1 .(d), is hereby amended to read as follows:
d) Retail and service uses, as defined by Chapter 41 of the Santa Ana
Municipal Code, hours of operation may only occur between the hours of 6
a.m. and 7 p.m. Restaurant and arts-related uses may operate between
the hours of 6 a.m. and 11 p.m. As used herein, arts-related uses shall
mean occupancy of the Premises with one or more uses which are
predominately related to the sale, display, teaching, studio or production
of the performing or visual arts, including, but not limited to, painting,
sculpture, ceramics, glass works, music, graphics, videography and/or
photography.
