NS- 2394 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING VARIOUS SECTIONS OF CHAPTER 36 OF THE SANTA ANA MUNICIPAL CODE TO REVISE THE MUNICIPAL CODE DUE TO CHANGES IN THE CALIFORNIA VEHICLE CODE AND CONSTRUCTION OF MEDIANS ON CITY STREETS. WHEREAS, the City of Santa Ana desires to ensure the safety of pedestrians and vehicular travel within City limits; and WHEREAS, the construction of medians on City streets has created an undefined area of travel within Santa Ana roadways; WHEREAS, the definition of pedestrian has been amended in the California Vehicle Code; and WHEREAS, the changes in the streets of Santa Ana and the California Vehicle Code has created ambiguity within the Santa Ana Municipal Code. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Santa Ana Municipal Code section 36-8 is hereby adopted to read as follows: Sec. 36-8. Parkway. The parkway is that portion of the street other than the roadway, median or the sidewalk. SECTION 2: That Santa Ana Municipal Code section 36-10 is hereby adopted to read as follows: Sec. 36o10. Pedestrian. (a) A pedestrian is any person who is afoot or who is using a means of conveyance propelled by human power other than a bicycle. (b) A pedestrian includes any person who is operating a self-propelled wheelchair, invalid tricycle, or motorized quadricycle and, by reason of physical disability, is otherwise unable to move about as pedestrian as specified in subdivision (a). 188 SECTION 3: That Santa Ana Municipal Code section 36-16--36-24 is hereby adopted to read as follows: Sec. 36-16 Median. The median is that portion of the street which separates lanes of vehicular traffic and is not the roadway, sidewalk or parkway. Secs. 36-17--36-24. Reserved. SECTION 4: That Santa Ana Municipal Code section 36-41 is hereby adopted to read as follows: Sec. 36-41. Miscellaneous driving movements and acts prohibited. No person shall: (1) Drive between the vehicles comprising a funeral procession while it is in motion and when such vehicles are identified as part of such procession by the display upon the outside of each vehicle of a pennant or other identifying insignia or by such other method as may be determined and designated by the chief of police. This provision shall not apply at intersections where traffic is controlled by traffic-control signals or police officers. (2) While ~-iding any bicycle, motorcycle, coaster, skateboard, motorized skateboard, roller skates, or any toy vehicle, attach the same or himself to any moving vehicle upon any roadway, and no person driving any vehicle shall permit the same to be done. (3) Drive any motor vehicle within or over any sidewalk area or any parkway except at a driveway. (4) Drive over or across any new pavement or freshly painted marking, when any street barrier, sign or marking is in place, warning persons not to drive over or across the same, or when a sign is in place stating that the street, or any portion thereof, is closed. (5) Drive or operate a vehicle contrary to the directions or provisions of any barrier or sign erected pursuant to the provisions of any ordinance of the city, or by any public utilities, or by any department of the city, or by any other person pursuant to law or contract with the city, and no unauthorized person shall move or alter the position of any such barrier or sign. (6) Drive a vehicle onto or from any freeway except at such entrances and exits as are established by public authority. 189 (7) (8) Park any vehicle within three hundred (300) feet of any fire apparatus which is stopped in answer to a fire alarm. Ride a bicycle or skateboard upon a sidewalk within a business district, as that te,m is defined in California Vehicle Code, Section 235. Whenever any person is riding a bicycle or skateboard upon a sidewalk other than in a business district, or in any other public place, such person shall yield the right-of-way to any pedestrian. (9) Drive a vehicle into an intersection or a marked crosswalk unless there is sufficient space on the other side of the intersection or crosswalk to accommodate the vehicle he is operating without obstructing the passage of other vehicles or pedestrians in such intersection or crosswalk, notwithstanding any official traffic- control device or signal indication to proceed. (10) Drive any motor vehicle upon or over a median. SECTION 5: That Santa Ana Municipal Code section 36-118 is hereby adopted to read as follows: Sec. 36-118. Standing in median. No person shall stand, walk or sit on any median other than in a safety zone or in a crosswalk. This section shall not apply to any public officer, construction worker or employee of a public utility or its agent acting in the line of duty if such presence on the median is necessary to carry out the functions of the job.
