AN ORDINANCE OF THE CITY OF SANTA ANA
AMENDING SECTION 14-55 OF THE SANTA ANA
MUNICIPAL CODE REGARDING THE HOURS OF
FIREWORKS SALES
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS
FOLLOWS:
SECTION 1: The City Council hereby finds, determines and declares that citizen
complaints increase in both number and severity as the 4th of July holidaY proceeds. City

F re Department personnel have, m the past, worked late into the even ng hours on the '
of July responding to the backlog of complaints pertaining to the discharge of fireworks.
The shortened hours of sale on the 4th of July are in response to the citizens of the City; to
decrease the number of complaints received and to stop the impulse buying of fireworks.
The decrease in the number of complaints will result in a more efficient service response
by flrefighters to the emergency requests received.
SECTION 2: That Section 14-55 of Article II of Chapter 14 of the Santa Aha
Municipal Code is hereby amended to read as follows (additions to existing code ~shown
in underline and deletions in strike-out):
Sec. 14-55. Permit for sale of safe and sane fireworks; Hours of Sale.
No person shall display, sell, or engage in the business of selling safe and sane
fireworks without first having obtained a permit to do so as hereinafter provided.
No person shall sell any type of fireworks at any time except from 12:00 noon
through 10:00 p.m. on July lSt~, 3,",d from 10:00 a.m. through 10:00 p.m. on July
2nd~ and 3rd~_; and from 10:00 a.m throu~lh 8:00 p.m. on July 4th of any year.
SECTION 3: If any section, subsection, sentence, clause, phrase or portion of this
ordinance is for any reason held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this ordinance. The City Council of the City of Santa Ana hereby declares that
it would have adopted this ordinance and each section, subsection, sentence, clause,
phrase or portion thereof irrespective of the fact that any one or more sections,
subsections, sentences, clauses, phrases, or portions be declared invalid or
unconstitutional.
SECTION 4: Neither the adoption of this ordinance nor the repeal hereby of any
ordinance shall in any manner affect the prosecution for violation of ordinances, which
violations were committed prior to the effective date hereof, nor be construed as affecting
any of the provisions of such ordinance relating to the collection of any such license or
penalty or the penal provision applicable to any violation thereof, nor to affect the validity

of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited
pursuant to any ordinance and all rights and obligations thereunder appertaining shall
continue in full force and effect.
