NS-2475 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ADOPTING SPECIFIC DEVELOPMENT PLAN NO. 71 (SD-71) AND REZONING PROPERTIES LOCATED AT 1101 THROUGH 1213 NORTH JACKSON STREET FROM NORTH HARBOR SPECIFIC PLAN (SP-2)/SINGLE FAMILY RESIDENCE TO SPECIFIC DEVELOPMENT PLAN NO. 71 (AA NO. 2001-02) CN: 06/25/0'1 THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: Section 1: The City Council does hereby find, determine and declare as follows: Amendment Application No. 2001-02 has been filed with the City of Santa Ana to change the zoning district designation of certain real property located at 1101 through 1213 North Jackson Street, in the City of Santa Ana from North Harbor Specific Plan/Single Family Residence to Specific Development Plan No. 71 (SD-71) which would allow an adult residential care facility as a conditional use. The Planning Commission of the City of Santa Ana held a duly noticed public hearing on May 14, 2001, on Amendment Application No. 2001-02. On June 11, 2001, the Planning Commission determined that Amendment Application No. 2001-02 is consistent with the General Plan of the City of Santa Ana, and recommended that the City Council approve Amendment Application No. 2001-02. This Council, prior to taking action on this ordinance, has held a duly noticed public hearing, on Amendment Application No. 2001-03. Specific Development Plan No. 71 (SD-71) as proposed in Amendment Application No. 2001-02 is hereby found and determined to be consistent with the General Plan of the City of Santa Ana and otherwise justified by the public necessity, convenience and general welfare. Section 2: Specific Development Plan No. 71, attached hereto as Exhibit "A" and incorporated herein, is hereby approved and adopted. Section 3: That certain real property located at 1101 through 1213 North Jackson Street and designated in Exhibit 1 is hereby reclassified, from North Harbor Specific Plan/Single Family Residence to Specific Development Plan No. 71 (SD-71). Section 4: Amended Sectional District Map number 10-5-10, showing the above described change in use distdct designation, is hereby approved. ADOPTED this day of ,2001. Miguel A. Date: Clerk of the Council City of Santa Ana EXHIBIT "A" Specific Development Plan No. 71 Scanlan Adult Residential Care Facility Section t. Applicability of Ordinance The specific development zoning district for the Scanlan Adult Residential Care Facility as authorized by Chapter 41, Division 26, Section 41-593 etJseq, of the Santa Ana Municipal Code (SAMC), is specifically subject to the standards and regulations contained in this plan for the express purpose of establishing land use regulations and standards. All other applicable chapters, articles and sections of the SAMC shall apply unless expressly stated or superseded by this ordinance. Section 2. Purpose The Specific Development Plan No. 71 (SD-71), consisting of standards and regulations, is hereby established for the express purpose of protecting the health, safety, and general welfare of the people of the City by promoting and enhancing the value of properties and encouraging orderly development. The Scanlan Care Home SD-71 sets forth the development and design criteria for a development consisting of approximately 2.3 acres. The purpose of this specific development plan is to permit flexibility in the site planning and design to respond to market conditions while assuring high quality development. Section 3. Uses Permitted Uses Permitted on all parcels in the SD-71 District: · One single-family dwelling per lot. Private greenhouses and horticultural collections for domestic noncommercial use, flower and vegetable gardens, fruit trees and any agricultural crop. One temporary real estate office devoted to the sale of real estate in the tract in which it is located, which use shall be for a period of time not to exceed one year. · Accessory buildings and structures except as otherwise provided in Section 41-232.5 of the Santa Ana Municipal Code. providing care to not more than 14 children, provided that if the number of children exceeds eight, a land use certificate must be first obtained pursuant to Division 4 of Article V of the Santa Ana Municipal Code. Adult day care facilities providing care to not more than six adults. Section 4. Uses Subject To A Conditional Uae Permit · Adult residential cam facilities as defined by Section 41-41.5 of the Santa Ana Municipal Code. Section 5. Development Standards The development standards for a residential project located within the SD-71 district will be those standards that are found in Sections 41-231 through 41-240 of the Santa Ana Municipal Code (Single-Family Residence). Non residential uses are subject to standards developed as conditions of approval for the required conditional use permit.
