On motion of Trustee Tubbs, duly seconded by Greenleaf, the Clerk was instructed to write the R.R.Commission informing them that a committee had been appointed on the matter. The applications of 26 Jitney Operators for renewal licenses accompanied by bonds of $10,000 each with the Western Indem- nity Co. as surety, were on motion of Trustee Gr..hi.al, duly seconded by Tubbs, license granted and bonds z~$erred to the President of the Board for approval. The application of Millard/an~dd Scott Prather for permission to operate an auto stage line between this City and Tustin ~on motion of Trustee Greenleaf, duly seconded by Tubbs the hearing in this matter was set for Jan. 21st,1918, at ?:30 pm The application of E.E. Wood for a plumber's license accomp- license anied by a $500.00 bond with M.F. Doig and C.MoNeil a~ sureties, was on motion of Trustee Greenleaf, duly seconded by Tubbs, license granted and bond referred to the President of the Board for approval. # On motion of Trustee Tubbs, duly seconded by Gte,hi.al,the Clerk was instructed to grant a free license to Mfs.Ethel Baker, in order that she might sell home made candy. A petition signed by the paid members of the Fire Dept. for an increase in salary, was read and on motion of Trustee Tubb duly seconded by Greenleaf, same was referred to a committee, the P.i~- appointing Trustees Tubbs and Greenleaf as such committee. Engineering and Construction Co. for 17½ cts. per sq. ft., being the only bid receivec was accepted. On motion of Trustee Tubbs, duly seconded by Greenleaf, Street Supt.OBrien wa~ instructed to see that the guard rail on the West 5th St. bridge is painted white. Street Supt. OBrlen was on motion of Trustee McPhee,duly seconded by Tubbs, lnstruoted to secure some man who has knowledge of trimming trees to supervise the trimming of trees in ~.rkings.~ ~' '~ ~ ¢' ' On motion of Trustee MoPhee, duly seconded by Tubbs the So. Cal. Edison Co. were instructed to make the following changes in street lights; The arc light at Spurgeon and 5th Sts. to be replaced with an incandescent center sus- pension, and the small incandescent lamp at 5th and Bush to be replaced with a larger one. On motion o£ Trustee Tubbs, duly seconded by Greenleaf, cement curbing on Oak St. between First and Chestnut was ordered in wherever same is missing. On motion of Trustee Greenleaf, duly seconded by Tubbs, Street Supt. OBrien was instructed to tear up E.l?th from C. to Grand Ave. for repairing the same. On motion of Trustee McPhee, duly seconded by Tubbs,the lease of the Pest House g~ounds was renewed to E.O.Mo Clure for ! year at $50 with the proviso that the rent In Re Bread Ordinance in Re Demands E. 4th St. caving in the future be $100.00 per year. On motion of Trustee Tubbs, duly seconded by Greenleaf,the Clerk was inatruoted to draw warrants on the City Treasurer to cover the demands as audited Nos. g44 to 99g inclusive. On motion o£ Trustee McPhee, duly seconded by Greenleaf, S.S. On motion of Trustee Greenleaf, that a committee be appoin ed to investigate the running of lrrigation w~ter on North Baker St., was duly seconded by Tubbs, the Chair appointin Trustees Greenleaf and Tubbs as such committee. following motion was made by Trustee McPhee, that it ~s the w~h of this Board that bonds of the City of Santa Ana be issued and sold for the acquisition and con- struction of bridges in and for the City of Santa Ana, and that the City Attorney is hereby instructed to start pro- oeedings for that purpose. Mr. W.J. Jullen of Cypress Ave., was before the Board in reference to opening Cubbon St. from Main to Orange Ave. On motion of Trustee McPhee, duly seconded by Greenleaf, the matter was referred to a committee. The Chairman appointed Trustees Tubbs and McPhee as such Committee. A Resolution ax%opted by the Santa Aha School Board in referen to opening Parton St. from First to Camile and the widening of Walnut St., its full width beginning at the Northwest corner of the Polytechnic grounds and continuing West to Flower St., was mxt read and on motion of Trustee Tubbs that t)~e Resolution be accepted and that Trustee NePhee be appoint ed a committee of one for investi.~ating conditione of same and report at next regular meeting, was duly seconded by Trustee Greenleaf and carried. The committee heretofore appointed consisting of Trustees Tubbs and Greenl~af to consult with and employ special counse on behalf of the City in conducting the legal proceedings pro riding for the voting, issuance and sale of bonds for the acquisition and construction of bridges over and across Santiago Creek at Main and Flower Streets, in the City of Santa Ana, reported that they had employed Clyde Bishop to take charge of in conjunction with the City Attorney of the entire bond issue to and including the making up of the Ab- stract proceedings at a consideration of $200.00. On motion of Trustee Geo. McPhee, seconded by Trustee J.W.Tub and carried, the report of the committee wa~ approved and its action ratified. Trustee J.W. Tubbs presented a Resolution for consideration by the Board o£ Trustees, the same being a Resolution entitle A Resolution of the City of Santa Ana, a municipal corporation incorporated under the laws of the State of California, by the legislative branch of said City, being the Board o£ Trustees thereof, determining and declaring that t~c public interest and also the public necessity demands the acquisition and con struction of m certain municipal improvements in the city of Santa Aha, consisting of two bridges over and extending acros~ that certain water course known ms, named and called Santiago Creek~and that the said bridges are necessary and convenient to ca~ry out the obJeots,purpoees and powers of said munlci- CS in Re Street roller repaira % Cit Cl pality, the cost of which will be too great to be paid out of the ordinary annual income and revenue of the City of Santa And. OBrien was instructed to tear down the street roller and purchase necessary pa~ts needed and secure assistance from the Water Dept. in the rebuilding of same. In the matter of the application of Mtllard Foster and Scott Prather for permission to operate an auto stage line between this City and Tuetin, same was granted permission and the application ordered filed on motion o£ Trustee Tubbs, duly seconded by McPhee and carried. Resolution No.594 entitled as follows: "A Resolution of the City of Santa Ana, a muni- cipal corporation, incorporated under the laws of the State of California, by the legislative branch of said City, declaring that the public interest and also the public necessity demands the acquisition and construc- tion of certain municipal improvements in the City of Santa Aha, consisting of two bridges erected over and extending across that certain water course known,as, named and called Santiago Creek; And that the said bridges are necessary and convenient to carry out the objects, purposes and powers of the City of Santa Aha, the cost of which will be too great to be paid out of the ordinary annual income and revenue of the said municipal 1 tM." having bee~put in proper form for final consideration by the Board of Trustees, was taken up, read and con- sidered, and on motion of Trustee Walter A. On motion of Trustee Tubbs, duly seconded by Greenleaf, the Board is to meet as a committee of the whole, Satur- day Feb. 2nd, at 2 p.m. for the purpose of taking up the matter of insurance for the city employees with the State Compensation Insurance Fund. On motion of Trustee McPhee.duly seconded by Greenleaf and carried, it was decided that the City would pay the cost of making sewer connections on that portion of West 4th St. necessary for the completion of the paving there- on. On motion duly seconded and carried, the committee appointed at laat meeting for investigating conditions for opening Cubbon St. from Main to Orange were granted further time in making a report. The verbal report of Trustee Maryatt who was appointed a committee of one for investigating condition for open- ing Broadway through from Santa Clara to Chapman Ave. was on motion of Trustee Tubbs, leaf, and carried, accepted. The motion of Trustee Greenleaf, duly seconded by Green- duly seconded by Maryat~ and carried that the President appoint a committee with Water Supt. Reid as one of the committee in reference to having the gum trees on the sewer rs_tm cut down, Trustees Greenleaf and Maryatt and Water Supt. Reid were appoints as such committee. On motion of Trustee NoPhee, duly seconded by ~sryatt, the foregoing committee is empowered to secure the services of ~ ex~ert in getting the valuation on the gas plant in this City should it be deemed necessary by the committee. The motion of Trustee MoPhee that it is the sense of the Board that an appropriation of ~5000.00 be made in reference to paying a portion of the cost of paving Bristol St. from 5th to the City Limits on the South. A grade of_a portion of Bristol St. wa~ established by Ordinance No. BZO, adopted by the Board of Trustees on the 5th day of March, 191?, which Ordinance I think was valle but thereafter the Board of Trustees of said City endeavore~ pursuant to part ~ of the Improvement Act of 1911, to change, modify and establish the official grade -* emisting under Ordinance No.6ZO. The ResOlUtiOn of Intention No.60~ under which this proceeding is being conducted, u~es ae its baals for gradin~ the grade sought to he established by Resolution of Inten- tion No 591, and not the grade provided for in Ordinance No 6 o. Therefore, if Ordinance No.620 did establish the and Resolution of Intention So.~91 was invalid, the grade has not been changed and the grade used in this proceeding is not the official grade. The proceedings taken under Resolution of Intention 591, seeking to change, modify and establish the grade on the streets and at designated points therein mentioned are invalid for the reason that they wholly fail to contain two Ju~isdictional features required of part 2 Beotion ~ of th Improvement Act of 1911. These two Jurisdictional features are as follows: (quoting from the statute): 'Sec. ~3- let. If no objection to said proposed change coo or modifications of grade shall be filed with the Clerk of the Council within thirty days from the first publication of the Resolution of Intention hereinbefore mentioned' oo~ 'the City Council shall have power to order and deol~ such grades to be changed and established in conformity to said Resolution., Resolution of Intention No.591 was panned by the Board of Trustees on the 19th day of November 1917, it was first published on the 22nd day of November, l~l?,(see affidavit of publication) it provides no opportunity for the filing of objections with the Clerk within thirty days after the first publication, but sought to fix a hearing and to give an opportunity to he heard before the Board of Trustees tc show cause why the improvement should not be carried out at a designated hour and day, to-wit: ?:30 o'clock p.m. on the l?th day of December,l~lT,the giving of thirty days' opportunity after the first publication of the Resolution for the filing of objections was Juris- dictional and a failure to pursue the statutes at least substantially in a fatal defect. You will observe that the time fixed for the hearl~ before the Board of Trustees was but 2~ days after the dat~ of the adoption of Resolution of Intention No.5~l and but ~5 days after the date of the first publication thereof, therefore, if the holding of this hearing was competent to take the place of an opportunZty to file objections it was wholly fatal for the reason that it,d not give the statu- tory time, to-wit: 30 days. I have carefully checked the grade with 7ou~ engineer from the prSflee in hie office used in this pro- oeedlng and find that they ars the grades as sought to be established by Resolution of Intention No.~91, which, being invalid, never established the grade. Therefore, you are not under Re~ution of Inten- tion Vo.60~ ~nd its succeeding proceedings grading or paving Bristol St. to the official grade and your acts are not authorized by Sections a and ~ of the Improvement Act of 1911. There are two other defects in these proceedings which in my Judgment are fatal to their validity,but in view of the absolute failure of Jurisdiction as above ex- plained, ! deem it that you do not desire a detailed state- ment of these. One of the provisions of Resolution of Intention ~60~ is that one-half of the expenses pertaining tc the public work to be done under the proceedings shall be paid out of the public treasury of the city of Basts Ann, and unless these proceedi~ authorize that expenditure then no legal authority to do so exists. ! therefore advise ~ha you that in view of the defects pointed out above a~ that all proceedings under · asolution of Intention No.60~ are invalid and that to expend the public money pursuant thereto would be an illegal act. Gentlemen:- Contractor MoNelll has finished the excavation of Pier No.1 on the North Main St.brldg to the required elevation Of 69.0 as shown on the plane. ~fter reaching this required elevation the writer had a test pit sunk a distance of ten feet further and found five feet more of moist cla and five feet of sand, gravel and large rock,in lizee, ranging from small pebbles to one man stone making it impraotlca~eto drive concrete piles. In my opinion this last erratum of gravel and boulders will make an excellent foundation f=r the bridge and I recommend that the piling in this pier be omitted and the foundation be continued down to elevation 6].0 and that I be given instruc ions to carry out the provisions of the epeoifica- tlonl as contained in paragraph ], page 9 of the General Provisions of the specifications.
