HomeMy WebLinkAbout52-041 RESOLUTION NO. 52-~2 RESOLUTION AUTHORIZING QUITCLAIM DEED .W~EAS, heretofore on December 12, 1951, Agreement of Sale and Purchase of certain rights of way, sewer mains and facilities was entered into between the CITY OF SANTA ANA and COUNTY S~NITA- TION DISTRICT NL~ER ONE of Orange County, California; and WHEREAS, the conditions precedent to the carrying out of such Agreement have occurred and said District now desires to buy and said City now desires to sell in accordance with the terms of said Agreement; NOW, THEREFORE, BE IT RESOLVED: That the CITY OF SANTA AMA in accordance with and under the terms of the Agreement of Sale and Purchase herein above referred to, does remise, release and forever Quitclaim to COUNTY SANITATION DISTRICT i~B~BER ONE of Orange County, California, all its right, t'itle and interest ia and to that cer- rain real property in the 0ounty of Orange, State of California, de- scribed as follows: ITEM 1. A strip of land 14 feet in width, being 7 feet wide on each side of and measured at right angles to a line which is the center line of said strip of land and which center line is described as follows: Beginning at the common corner of Sections 23, 24, 25 and 26, Township 5 South, Range l0 West, S.B.B. & M., said common corner is designated as Engineer's Station 40 ~- 20.40; thence South 69° 3' West a distanc~ of 2,222.7 feet to Engi- neer's Station 62 ?~ 43.1; thence South 62° 33' West a dis- tance of 4,115.22 feet to Engineer's Station 103 ~ 55.32, which is also Engineer's Station 103 ~ 49.05 for the follow- lng lime; thence South 58° 59' West a distance of 4,797.9 ~ feet to Engineer's Station 151 ~ 47, which point ~ears South 89° 21, East, and distant 577.03 feet from the common corner of Sec~tions 27, 28, 33 and 34, Township 5 So~h, Range l0 West, S.B.B. & M.; thence continuing South 58 59' ~est a distance of 5,453 feet to Engineer's Station 206 w~ 00; thence South 67° 19' West a distance of 1,184.61 feet to Engineer's Station 217 ?~ 84.61, which point is on the West right of way line of the Santa Aha River; and also ITEM 2. A strip of land 14 feet in width, being 7 feet wide on each side of and measured at right angles to a line which is the center line of said strip of land, and which center line is described as follows: Commencing at a bolt markin~ the Roint of intersection of the center line of Talbert Road with the center line of Greenville Road; thence North 0° 20' Nest along the center line of Greenville Eoad a distance of 1,901.13 feet; thence South 62° 33' West a distance of 17.64 feet to the point of beginning, said point is designated as Engineer's Station 0 ?A 00 on Line No. 2 of the 0utfall Sewer of the City of Santa ~na, also known as Engineer's Station 103 ?& 58.32 of Line No. l; thence North 0o 20' West parallel to and 15 feet from, measured et right angles to the center line of Greenville Road a ~istance of 2,345.3 feet to Engineer's Station 23 ?A 45.3, thence North 15° 46' East parallel to and 15 feet from, measured at right angles to the center line of said Greenville Road a distance of 4,5~0.55 feet to Engi- neer's Station 68 ~ 85.85; thence South 89© 52' East par- allel to and 15 feet from, measured at right angles to the center line of Edinger Street a distance of 632.88 feet to Engineer's Station 75 ?& 18.73, said point being in the center line of Center Street, extended Southerly; thence North 0° 19' West along the center line of Center Street, and the center line produced North 0° 19' West a distance of 5,259.27 feet to Engineer's Station 127 ?& 78; and also I'1'~ 3. A strip of land 20 feet in width being 10 feet on each side of a line described as follows: Beginning at a point on the center line of Harbor Boule- yard, Southerly 358.65 feet from the common corners of Sec- tions 27, 28, 33 and 3&, said point being designates as Engineer's Station 158 ?~ 26.4; thence South 58o 59' W~st a distance of 4,75~.52 feet to Engineer's Station 205 -~ 80.92, which is on the center line of Ellis Avenue extended Easterly; thence from a point in the South line of Northwest quarter of Section 3~, Township 5 South, Range l0 West, S.B.B. & M., Easterly 1187.84 feet from the one-quarter section corner of Sections 32 and 33, iownsh~p 5 curb, Range l0 West, S.B.B. & M., which said South line is the center line of Ellis Avenue extended Easterly, South 67° 19,' West 42.15 feet to a point which is 17 feet measured at right angles, South- easterly from the center line of the right of way of the Santa ~na Sewer where it intersects the ~outh line of the Northwest quarter of Section 33, which point is Engineer's Station 206 ~ 13.50 of the Santa Ana Sewer line; thence South 67° 19' West a total distance of 12&0.68 feet more or less to the West right of way line of the Santa Aha River; Together with that portion of the Southwest quarter of said Section 33 lying mouth of the North line of said South- west quarter, Northwest of the ~orthwest line of said 20 foot strip end Southeast of the Southeast line of said 14 foot strip, together with the sewer mains and facilities located on said real property described as: A sewer main extending in a Northeasterly direction from the existing J.0.S. Sewage Treatment Plant to the in- ters$ctio~ of Bristol Street and Delhi Road. This line or outfall comprises in the main approximately 1,59~ feet of 39-inch vitrified clay sewer pipe at the Santa Ana River crossing which was constructed in 1942 by the U.S. Govern- ment to serve the Santa Ana Army Air Base, approximately -2- 2,143 feet of 39-inch vitrified clay sewer pipe of which construction was completed in 1947, approximately 8,420 feet of 30-inch concrete pipe, and approximately 6,338 feet of 24-inch concrete pipe; and also A sewer main extending from its intersection with Line No. i at 01d Newport Road in a Northerly direction along 01d Newport Load to Edinger Street, thence East on Edinger Street to the intersection of the Southerly prolongation of Center Street, and thence in a Northerly direction along Center Street and its prolongations to the Sewer Chlorination Sta- tion just North of the ~esterly prolongation of Myrtle Street. This line comprises in the main approximately 10,140 feet of 20-inch concrete sewer pipe and approximately 2,6~0 feet of l$-inch concrete sewer pipe. BE IT FURTHER RESOLVED: That the Mayor and City Clerk of said City are hereby authorized and instructed to execute and deliver good and sufficient quitclaim deed conveying all of the right, title and interest of the CITY OF SANTA ANA in the sewer majors, rights of way, and other facilities hereinabove described, to COUNTY SANITA- TION DISTRICT NUMBER ONE and to deliver the same upon receipt of the purchase price, to-wit, the sum of One Hundred Fifty-six Thousand and Sixty-three Dollars ($156,063.00). PASSED AND ADOPTED by the Council of the City of Santa ~na at its regular meeting held on the 5th day of May, 1952.
