HomeMy WebLinkAbout52-074 RESOLUTION NO. 52-74 RESOLUTION OF THE COUNCIL OF THE CITY OF SANTA ANA CALLING A SPECIAL ELECTION TO SUBMIT TO A VOTE OF THE ELECTORS OF SAID CITY, AN ORDINANCE FOR THE PURPOSE OF LEVYING AND COL- LECTING A TAX OF $0.15 ON EAOH $100.00 ASSESSED VALUATION OF PROPERTY WITHIN SAID CITY FOR THE PURPOSE OF CONSTRUCTING A SWIm, MING POOL AND BATH HOUSE IN MEMORIAL PARK AND PROVIDING ADDITIONAL RECREATIONAL EQUIPMENT FOR PARKS IN SAID CITY; AND AUTHORIZING CONSOLIDATION OF SAID ELECTION WITH THE GENERAL ELECTIONS TO BE HELD NOVEMBER ~, 1952 THE COUNCIL OF THE CITY OF SANTA ANA DOES RESOLVE AS FOLLOWS: SECTION 1. That a special election shall be held in the City of Santa Ann en the 4th day of November, 1952 for the purpose of submit- ting to the electors of said City, the proposition of the adoption of an Ordinance providing for the levying and collection of a tax of $0.15 on each $100.00 of assessed valuation of property within said City, the first levy to be made and collected during the fiscal year beginning July 1, 1953 and the last levy to be made and collected during the fiscal year beginning July 1, 1955, a period of three years, to be used exclusively to provide a swimming pool, bath house, and other customary portions of a swimming pool in and as a part of Memo- rial Park in the City of Santa Ann, and providing that any money re- maining unexpended for said purposes be used to provide a stage with shell, backboard, and dressing rooms in said Park and any money remain- ing thereafter to Be used for additional recreational equipment for the parks in said City; providing that no tax be levied thereunder after the fiscal year beginning July 1, 1955 and that all money resulting from such tax be placed in a special fund and expended only for the purpose set forth in said Ordinance which said Ordinance is entitled and contains the exact provisions, words, and figures as next hereinbelow set out: "AN ORDINANCE FOR THE I~uEPOSE OF LEVYING AND COT.~.W. CTING A TAX OF $0.15 ON EACH $100.00 ASSESSED VALUATION OF PROPERTY WITHIN THE CITY OF SANTA ANA FOR THE PURPOSE OF CON- STRUCTING A SWIMMING POOL AND BATH HOUSE I~N MEMORIAL PARK AND PROVIDING ADDITIONAL RECREATION EQUIPMENT FOR PARKS IN THE CITY OF SANTA ANA. THE PEOPLE OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS: SECTION l: That the City Council as the Legislative Body of the City of Santa Ann, shall levy and collect in addi- tion to all other taxes, a tax of FifteenCents i$0.15) on each One Hundred Dollars ($100) of assessed valuation within said City for each of three years. The first year in which said tax shall be levied and collected shall be the Fiscal Year beginning ~uly 1, 19~3. SECTION 2. That the tax herein provided for shall be collected at the same time and in the same manner as other direct taxes upon property within said City. SECTION 3. That the money produced by such tax shall be used exclusively to provide a swtmmt~g pool, bath house, and such other parts and portions of a swimming pool as are custo- mary, in and as a part of Memorial Park in the City of Santa Ans. Any money which remains unexpended for said purpose shall be used to provide a stage with shel~backboard and dressing rooms in said Memorial Park, and any money remaining after the completion of said facilities shall be used for ad- ditional recreation equipment for the parks in said City. SECTION 4. That no tax shall be l&vied under the authorization of this Ordinance after the fiscal year beginning July l, 1955. SECTION 5: That the money resulting from the levy of the tax herein provided for, shall be placed in a special fund and shall be expended for no other purpose than those purposes provided for herein." SECTION 2. That said special election is called by the City Council of the City of Santa Ann under and by virtue of the provisions of Article I, Chapter 3, Division 4, of the Elections Code of the State of California, pursuant to a petition therefor signed by more than fifteen percent of the Qualified electors of the City of Santa Ana con- raining a request that the City Council call a special election for the purpose of submitting to the qualified voters of the City of Santa Ane, the proposed Ordinance hereinabove set out as a Proposition which said petition has been duly and regularly filed with the City Clerk of the City of Santa Aaa who has attached her certificate thereto, showing that said petition has been signed by not less than fifteen percent of the qualified electors of said City. SECTION 3. That the City council of the City of Santa Ann does hereby elect and does hereby authorize the Board of Supervisors of the County of Orange to consolidate this special election with the general elections held November 4, 1952 and further authorizes the said Board of Supervisors to form the precincts within the City of Santa Ann for such election, to fix the polling places, ~$~ appoint the precinct boards, and to provide for the expenses of said election. SECTION 4. That said City Council does further authorize the -2- Board of Supervisors of the County of Orange, to canvass the returns of said special election. SEOTION 5. T~at the said special election voting precincts, election boards and the polling places shall ~e those named and estab- lished by the Board of Supervisors of the County of Orange for the general election of November 4, 1952. SECTION 6. That the polls shall be open between the hours of 7 o'clock A. M. and 7 o'clock P. N. SECTION 7. That the election officers serving at said consol- idated election to be held November 4, 1952, shall receive as compensa- tion for their services in serving upon said election boards, the sum to be fixed by the Board of Supervisors of the County of Orange. SECTION 8. That said election shall in all respects be conducted as provided by law. SECTION 9. The City Clerk is hereby directed and instructed to publish before the day of such election, by two insertions in the Santa Aha Register, a daily newspaper of general circulation, printed, pub- lished, and circulated in the City of Santa Aha, a notice containing a synopsis of the question or measure to be submitted at said election, and which notice shall be substantially as follows: "MEASUB~ TO BE VOTED ON "NOTICE IS HEREBY GIVEN that the following measure is to be voted on at a special municipal election to be held in said City of Santa Aha on Tuesday the Sth day of November, 1952, to-wit: INITIAT£¥~ MEASURE "Shall the ordinance entitled 'AN ORDINANCE FOR THE PURPOSE OF LE¥~ING AND COT~CTING A TAX OF $0.15 ON EACH $100.00 ASSESSED VALUATION OF PROPERTY WITHIN THE CITY OF SANTA ANA FOR THE PURPOSE OF OONSTRUCTING A SWIPING POOL AND BATH HOUSE IN ~EMORIAL PARK AND PROVIDING ADDITIONAL RECREATION EQUIPMENT FOR PARKB IN THE CITY OF SANTA ANA', be adopted?" -3- Said Ordinance provides: That the City of Santa Aha shall levy and collect, in addition to all other taxes, a tax of $0.15 on each $100.00 of assessed valuation within said City for each of t~ree years, the first year being the fiscal year beginning July l, 1953 and the last year being the fiscal year beginning July l, 1955; that said tax shall be collected at the same time and in the same manner as other di- rect taxes upon property within said City; that the money produced by said tax shall be placed in a special fund and used exclusively to pro- vide a sw~mmlng pool, bath house and other parts of a swimming pool in Memorial Park and any money remaining unexpended for said purposes shall be used to provide a stage with shell, backboard, and drewsing rooms in said Park and any money thereafter remaining shall be used for additional recreation equipment for the parks in said City. The City Clerk shall cause the proposed Ordinance or measure to be printed, and she shall mail a copy thereof, enclosed in an envelope with a sample ballot to each voter at least ten days prior to the said election. SECTION ll.' That in addition to the foregoing notice the City Clerk shall, not later than the thirty-first nor earlier than the six- tieth day before the election, give notice of said election by causing a notice of the same to be published at leas~ once in the Santa Aha Reg- ister, a daily newspaper printed, published and circulated in the City of Santa Ana; said notice shall be headed: "Notice of Election", and shall contain the information required by law. SECTION 12.
