Home My WebLink About53-035RESOLUTION NO. 53-35 RESOLUTION APPROVING ~,~P, DECL;~ING INTENTION TO VACATE A PORTION OF 0~'~NGE AVE~k~JE AND FIXING TI~.~ ~fD PIECE FOR h~ARING OF ALL PERSONS INTERESTED IN OR OBJECTING TO THE PROPOSED VACATION WH~qEAS, the City Council after study, concluded that a ocr- tion of Orange Avenue should be abandoned on the ground that it is unnecessary for present or prospective street purposes; and V~EREAS, the City Engineer has presented a certain map show- lng said portion of Orange Avenue for the purpose of this proceeding; NOW, THEREFORE, BE IT RE$OLVED: That said map be and the same hereby is approved and the City Clerk is ordered to file the same in the proceedings for the abandonment of that portion of Orange Avenue hereinbelow described that said map may be available for inspection by the public. BE IT FURTHER P~ESOLVED: That the City Council hereby declares its intention to vacate, abandon and close up, a portion of Orange Avenue in the vicinity of Adams Street as shown on and in accordance with an official map thereof adopted by this l(esolution and hereby ordered filed in the office of the City Clerk and reference is hereby made to said map for further particulars. That the portion of said Orange ~venue herein prooosed to be vacated lies in the City of Santa ~na, County of Orange, otate of California and is described as: PARCEL 1. Beginning at the Northwest corner of Lot 18, Block "H" of South Santa Ann, as per map thereof recorded in Miscellaneous }~ap Book 5, at page 43, Records of Orange County, State of California, and running thence due south along the west line of said Lot 18 150.00 feet to the Southwest corner thereof; thence South 896 59' 30" West 50.00 feet; thence due North 52.68 feet thence North 30° 00' 00'? East 15.65 feet to the beginning of a curve; thence Northeasterly along the arc of a curve concave Northwesterly having a radius of 350.00 feet through a central angle of 14° 53' 27" an arc length of 90.96 feet and tangent to the last described course; thence North 89° 59' 30" East 7.39 feet to the point of beginning; Above bearings based on the East and West lines of Orange Avenue running due North and South. PARCEL 2. Beginning at the Northwest corner of Lot l, Block "I" of South Santa ~na, as per map thereof recorded in Miscellaneous Map book 5, at page &~, ~ecords of Orange County, State of California, and running thence ~outherly along the West line of said Lot l, 151.73 feet to the ~outhwest corner thereof; thence Westerly in a straight line 50.00 feet to the Southeast corner of Lot 8, ~lock "J" of said south Santa Aha; thence Northerly along the east line of said Lot 8, 151.71 feet to the Northeast corner thereof; thence Easterly in a straight line 50.00 feet to the Point of Beginning. That the 20th day of npril, 1953 at the hour of 7:30 P. M. on said day in the Council Chambers in the City Hall, 3rd and Main Streets in the City of Santa ann is hereby fixed as the time and place for hear- ing all persons interested in or objecting to the proposed vacation and sbandonment of a portion of Orange ~venue as hereinabove described. That the City Council hereby declares and determines that pub- lic convenience and necessity re. ire the reservation of an easement and right of way for the maintenance, operation, replacement and en- largement of lines of pipe for the operation of gas pipe lines in, upon and over that part of 0range ~venue herein prooosed to be vacated described as follows: Beginning at the Northwest corner of Lot l, Block "I" of South Santa Aha as per map thereof recorded in ~iscellaneous ~ap Book 5 at page ~3, Records of Orange County, California, running thence Southerly along the West line of said Lot 1, 56.00 feet; thence due West in a straight line, 50.00 feet to a point on the East line of Lot 8, Block "g" of said South Santa ~na; thence Northerly along the East line of said Lot 8, 12.00 feet; thence due East in a straight line, 38.00 feet; thence Northerly and parallel to the ~esterly line of said Lot 1, 44.00 feet to the ~outherly line of ~dai~ Street; thence Easterly along the ~outh line of ~dams Otreet to the Point of Beginning, and these proceedings are subject to such reservations and exceptions. That Resolution N~mber 53-19 adopted February 16, 1953 is here- by rescinded. That the City Council hereby declares its intention to proceed with this vacation of a portion of Orange Avenue under the provisions of the Street Vacation Act of 1941, Part 3, Division 9, of the Streets and Highways Code of the ~tate of California. That the City Olerk is hereby directed and ordered to publis~ this Resolution in the manner prescribed by law for the publishing of Ordinances of the City and the Street Superintendent is hereby or- dered and directed to oost conaoicmously alon~ the lines of that por- tion of Orange Avenue herein prooosed to be vacated, at least 10 days before the date herein set for hearing, notices stating the -2- passage of this Resolution of intention and the time and place of hearing herein fixed; such notices shall be posted not more 300 feet apart and at least 3 of such notices shall be poated along said Street herein proposed to be abandoned.
