HomeMy WebLinkAbout53-107RESOLUTION NO. 53-107 AUTHORIZING EXECUTION OF QUITCLAIM DEED
WHEREAS, by the dissolution of the NeWb~rt Protection Dis-
trict, the City of Santa Ana acquired all properties held by said
District for flood control purposes within the City of Santa Ana,
California; and
WHEREAS, it appears that an error occurred in that certain
deed from JOHN T. ENGLISH and MAY M. ENGLISH to said New~ert Pro-
tection District granting an easement for the purpose of repairing
dikes so that the line of the easement was some 60 feet Southeast-
erly from said dikes and the area upon which the same are maintained;
and
V~EREAS, the property affected by said deed is now being sub-
divided and the Orange County Flood Control District is not inter-
ested in said easement and said easement in so far as it affects
said subdivision, is of no value;
NOW, THEREFORE, BE IT RESOLVED: That the City hereby quit-
claims the interest hereinbelow referred to, affecting Tract No.
1788 and the Mayor and the Clerk of the Council are instructed to
execute their deed quitclaiming to WALTER W. COLE and MATRYCE H.
COLE, husband and wife as joint tenants, the following described
property:
Any interest which said Grantor may have by reason of a
deed recorded October 20, 1924 in Book 540, Page 359 of
Deeds of Orange County, California from JOHN To ENGLISH
and MAy M. ENGLISH to the Newt~ert Protection District,
and to deliver the same.
PASSED AND ADOPTED by the City Council of the City of Santa Aha
at its regular meeting held on the 20th day of Jul7 ,
