HomeMy WebLinkAbout54-135 RESOLUTION NO. ~4-!~_.._AUTHORIZING CONDEMNATION OF CERTAIN PROPERTY FOR PUBLIC STREET PURPOSES TO WIDEN SEVENTEENTH STREET AND DECLARING THE PUBLIC NECESSITY THEREFOR WHEREAS, Seventeenth Street, as it exists in the City of Santa Ana, California, adjacent to the Easterly City Limits, is inadequate in width to accommodate the present and future demands of traffic thereon and constitutes a present and continuing traffic hazard; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Aha does hereby find and determine that public interest and necessity require that East Seventeenth Street be widened to a standard width of 80 feet from Grand Avenue to the Easterly City Limits as shown on a map thereof on file in the Of- fice of the City Enginee~ and hereby referred to for greater detail, to accommodate the present and future demands of traffic thereon and further require that said City do, have, take and acquire an ease- ment for said purpose in, over and through that certain parcel of real property lyin~ in the City of Santa Ana, County of Orange, State of California, described as: The:North 40 feet of that portion of the Northwest quarter of Section 8, in Township 5 South, Range 9 West, San Bernardino Base and Meridian, in the City of Santa Ana, County of Orange, State of California, described as follows: Beginning at the Northeast corner of the tract allotted to Rosa Sore in the Partition of the Rancho Santiago de Santa Aha in 1868 by decree in Case No. 1192, in the District Court of the 17th Judicial District of the State of California in and for Los Angeles County; runnin~ thence South along the East line of said Tract, 196.00 feet, thence West, parallel with the North line of said Tract, 96.00 feet; thence North parallel with said East line, 196.00 feet to said North line; thence East along said North line 96.00 feet to the point of beginning. EXCEPTINg FROM said North 40 feet the portions inc]uOed ~lthin the lines of Seventeenth Street on the North and M~!bury S$~eet on the East. BE IT FURTHER RESOLVED: That the City Attorney be and he is hereby ordered and directed to brin~ an action in the name of the City of Santa Aha in the Superior Court of the State of California in and for the County of Orange, for condemnation of said property necessary to be taken as herein ordered and heretofore described and do all thin~s necessary to prosecute said action to final determination. BE IT FURTHER RESOLVED: That the public interest,necessity and convenience require and it is hereby ordered, that the City of Santa Ana, a Municipal Corporation, Plaintiff in the condemnation action ordered herein, take immediate possession and use of the property herein ordered to be acquired, upon complying with the re- quirements of the law applicable thereto and that the City Attorney report to the City Council, the amount of money required therefor as soon as the same has been ascertained. BE IT FURTHER RESOLVED: That the said action for condemna- tion of said property so to be acquired shall be taken in accordance with Section 14, Article I of the Constitution of the State of Cal- ifornia. PASSED AND ADOPTED by the Council of the City of Santa Ana at its regular meeting held on the 2nd day of August, 1954.
