HomeMy WebLinkAbout54-153RE~0LUTION NO. 54-153 AUTHORIZING ~CUTION OF QUITCLAIM D~J~ TO SOUTHERN PACIFIC RAILROAD COMPANY COVERING THREE RAILROAD CROSSINGS NOW CLOSED BY FREEWAY CONSTRUCTION WITHOUT PAYMENT OF MONEY. WHEREAS, the construction of the Santa Aha Freeway has resulted in the closing of three railway crossings and the City of Santa Aha has no further need of said crossings except as to certain easements hereinbelow reserved. NOW, THEJtEFO~E, BE IT RESOLVED: That the City Council of the City of Santa Aha hereby authorizes its Mayor to execute that certain Indenture quit- claiming all the city's interest in and to the real property in said city, County of Orange, State of California, described as: PARCEL A: All that certain piece or parcel of land situate in the City of Santa Ana, County of Orange, State of California, in the Santiago de ~anta Ana Rancho, described as follows: Being that portion of the strip of land 100 feet wide, described in the Deed, dated October 8, 1877 to the Los Angeles and SanDiego Railroad Con~0any, recorded in Book 57, page 370 of Deeds, in the Office of the Recorder of Los Angeles County, California, lying be- tween the northerly prolongations of the easterly and westerly lines of Bush Street,60 feet wide, shown on map of the Re-subdivision of Phelps Subdivision, recorded in Book 5, Page 35 of Miscellaneous Records, in the Office of the Recorder of said Orange County, bounded northeasterl~ by the northeasterly line of said strip 8f land, bear- ing North 26~ 39' 40" West and a line bearing North 30 16' 18" West from the intersection of said northeasterly line with the center line of said Bush Street, and bounded southwesterly by the southwesterly line of said strip of land, that is parallel with and 100 feet south- westerly, at right angles, ~rom said northeasterly line having a bearing of North 26° 39' 40' West, containing an area of 12,990 square feet, more or less. RESERVING~ however, an easement for sanitary sewer purposes over a strip of land 10 feet in width, within above described property, ly- ing 5 feet on each side of said center line of Bush Street, the side lines of said strip to terminate in the northeasterly and southwesterly boundary lines described above, containing an area of 2,182 square feet, more or less; ALSo RESERVING an easement for storm drain purposes over a strip of land 10 feet in width, within above-described property, lying 5 feet on each side of a line which is distant westerly 25 feet, measured at right angles, from said center line of Bush Street, the side lines of said strip to terminate in the northeasterly and south- westerly boundary lines as described above, containing an area of 2,118 square feet, more or less. PARCEL B: All that certain piece or parcel of land situate in the City of Santa Ana, County of Orange, State of California, in the Santiago de Santa Ama Rancho, being a portion of the strip of land 100 feet wide, described in the deed dated October 8, 1877 to the Los Angeles and San Diego Railroad Company, recorded in Book 57, page370 of Deeds in the Office of the Recorder of Los Angeles County, California, des- cribed as follows: That portion of said strip of land lying Easterly of the south- erly prolongation of the west line of Block "F" of Tract lB9, as shown on map recorded in Book ll, page 36 of Miscellaneous Maps in the Office of the Recorder of said Orange County and Westerly of a curved line, concave Southwesterly, having a ra~lius of 17,209.00 feet, being also concentric with and distant 30.00 feet Southwesterly, measured radially from the Southwesterly line of said Block "F" of said Tract 139 and the Southeasterly prolongation thereof, said southwesterly line shown as having a radius of 17,239.00 feet, and lying within the limits of Santa Clara Street, 50 feet wide, as shown on said romp, containing an area of 3,~O0 square feet, more or less. PARCEL C: -----~hat certain piece or parcel of land ~tuate in the City of Santa Aha, County of Orange, State of California, in the Santiago de Santa Aha Rancho, described as follows: Being that portion of the strip of land, 100 feet wide, described in the deed dated October 8, 1877 to the Los Angeles and San Diego R~ilroad Compsay, recorded in Book 57, page 370 of Deeds, in the Office of the Recorder of Los Angeles County, California, lying be- tween the westerly prolongations of the northerly and southerly lines of 20th Street, 60 feet wide, as shown on map of Resubdivision of Nob Hill Tract, recorded in Book 6, page 3 of Miscellaneous Maps in the Office of the Recorder of said Orange County, containing an area of 6,705 square feet, more or less, to the Southern Pacific Railroad Company.
