HomeMy WebLinkAbout54-157RESOLUTION NO. 54-157 GRA~ING VARIANCE ON APPLICATION NO. 525 WHEEE THE PLANNING COMMISSION RECOMMENDED THAT THE SAME BE DENIED WHEREAS, the Planning Commission, by Resolution No. 674, reconm~nded that a variance be denied and the City Council after hearing arguments and exam~uing the application and the protests thereto has determined that the granting of the variance should be made. NOW, THEREFORE, BE IT RESOLVED: That Variance Application No. 525 hereinabove referred to is hereby approved and the City Council finds that special circumstances here exists because said property has an unused front portion or present setback of 106 ft. from Martha Lane and a two-car garage and a second story apartment face on Pacific Street and in no way fronts on Martha Lane; that substantial property rights are involved and that hardship here exists because the larger portion of the property is presently unuseable and said property is immediately adjacent to the Santa Ana College and heavy traffic conditions, and because the undeveloped front portion is unsightly; and that material damage will not result to other properties in the neighbor- hood by the granting of the variance herein applied for. BE IT FURTHER RESOLVED: That the City Council hereby grants a variance on that property in the City of Santa Aha described as and known and numbered as 14~5 Martha Lane, being located at the Northeast corner of Martha Lane, to permit the construction of a single family residence on the front portion of said property, front and side yard setbacks to be observed. BE IT FURTH~ RESOLED: That this variance is granted upon the conditions that applicant construct a curb and pave out to the existing pavement on Pacific Street to bring this property up to City standards. PASSED AND ADOPTED by the City Council of the City of Santa Aha at its regular meeting held on the 20th day of September, 195k.
