member of the City Council having received copies of the
Minutes of December 20th, 1943, further reading of the
Minutes was dispensed with and approved on motion of
Trustee Haan, seconded by Cheney and carried.

On motion of Trustee Deckert, seconded by Dixon and
carried, the application of R.W.Cole to drive a bus
and applicat~ons of Paul Albert Wagner, Irvin B. King
and Elvin B. King to drive taxicabs, were received,
filed and permits granted.
Communication from the Chamber of Commerce recommending
that the City Council provide Metropolitan Water at
once for the use of Santa Ana water users and that a
questionnaire be attached to all water bills to determi
the approval or disapproval of the use of Metropolitan
Water by all water users, was read and on motion of
Trustee Haan, seconded by Cheney and carried, the
communication was received and filed.

On motion of Trustee Haa~n, seconded by Dixon and
carried, the Water Supt., was instructed to conduct a
poll of the Santa Ana Water users to determine the
approval or disapproval of the use of Metropolitan
water.
On motion of Trustee Deckert, seconded by Dixon and
carried, communication 'from John L. Luxembourger, Chief
of Fire Dept. stating that Robert J. Cone has applied
for a leave of absence effective December 19th, 1943,
for the duration, to enter the armed forces, and that
Paul M. DesCamps was appointed to fill the vacancy
created by resignation of Mr. Cone, was received and
filed.
On motion of Trustee Dixon, seconded by Cheney and
carried, the bond of Delbert L, Larsh, City Judge, in
the amount of $5,000.00, written by the Hartford
Accident and Indemnity Co, was approved.
A lease was entered into between the City of Santa Ana
and Irvin F. Fickas, on approximately thirteen (13)
acres of land located south of Delhi Road and East of
Main Street, for the purpose of farming, for the period

On motion of Trustee Cheney, seconded by Haan and
carried, the monthly reports of Harold Rasmussen, Chief
Building Inspector, R.M.Crookshank, former Judge of the
City Court, for the period December 1st, 1943 to December
20th, 1943, inclusive, and of Delbert L. Larsh, City
Judge for the period December 21st, 1943 to December
31st, 1943, inclusive, were received and filed.
On motion of Trustee Dixon, seconded by Cheney and
carried, the Clerk was authorized to draw warrants
according to demands as audited by the Finance Committee,
numbering 1164 to 1316 inclusive.
On motion of Trustee Haan, seconded by Cheney and carried,
the recommendation, by Resolution, of the Planning
Com~ission was concurred in and the application of Dr. H.
Figdor to conduct the business of Chiropractor, at 1324
Bush Street, was approved.

On motion of Trustee Deckert, seconded by Dixon and
carried, the following Resolution entitled:
"Resolution Concerning Parking Limitations
Under Ordinance No. 1030"
establishing a loading zone on the south side of First
St. between Sycamore and Main Sts., located as follows:
The easterly 40 feet of the Westerly 50 feet,
was introduced, read, considered, designated Resolution
No. 3322 and passed by the following vote:

Streets
Mr, Everett White appeared before the Council, represenl
ing property owners on Lyon St. reference to flood
waters flowing and draining frqm property in the County
onto Lyon, Chestnut and McClay Sts. and stated that, in
his opinion, the County should assume full responsibili
to correct ~his condition.
On motion of Trustee Cheney, seconded by Haan and
carried, H.M.Neighbour, City Engineer, was instructed
to contact the County Engineer and the Board of
Supervisors in order to work out some relief from this
flood water condition and to report back at ~he next
meeting.

On motion of Trustee Deckert, seconded by Dixon and
carried, the bids on fire pumping engine were referred
to the Auditor and Chief of the Fire Department for
checking and to report back to the Council as soon as
possible.

carried, the notifications of the State Board of Equal-

On motion of Trustee Deckert, seconded by Dixon and
carried, the application of Clifford S. Wright to drive
a taxicab, was received, filed and permit granted.

On motion of Trustee Haan, seconded by Cheney and carried,
the request of Wm. L. Duerr, Pastor, Trinity Lutheran
Church to place small directional church signs on lamp
posts at 6th and No. Main Sts., Lacy and 1st Sts. and
Lacy and 4th Sts., was referred to the City Engineer to
report back at the next meeting.
On motion of Trustee Haan, seconded by Cheney and
carried, the request of Ernest Bias, Pastor of the Church
of the God of All Nations, for permission to preach the
gospel on Sunday mornings in Birch Park, was rejected.
On motion of Trustee Dixon, seconded by Deckert and
carried, the request of Glenn E. Eustts for permission to
keep 1200 to 2000 chickens on Lots 1,21,22,23,24 and 28,
Tract No. 953, was denied for the reason that such
permission would be in violation of the Zoning Ordinance.
The application of Henry Larrtva to conduct a pool hall
at 1810 W. 4th St., was read and on motion of Trustee
Deckert, seconded by Haan and carried, permit was
granted on recommendation of the Chief of Police.
On motion of Trustee Haan, seconded by Cheney and carried,
the Minutes of the Executive Board of the Outfall Sewer,
held January 6th, 1944, was received and filed.
On motion of Trustee Haan, seconded by Deckert and
carried, the application of C.L.Williamson to conduct the
business of dealing in motor vehicles at 306 West 8th St.

carried, the monthly reports of the Police Dept. and
of the Poundmaster, for the month of December, 1943,
were received and filed.
On motion of Trustee Deckert, seconded by Cheney and
carried, communication from John L. Luxembourger,
Chief of Fire Dept. stating that he had appointed
Lorle B. La Furgey to position as h0s eman, effective
Jan. 9th, 1944, to fill vacancy created by resignation
of Paul Burnett, was received and filed.
On motion of Trustee Deckert, seconded by Cheney and
carried, the report of Phil M. Brown, Secy. Civil
Service Board, relative to various appointments and
resignations in the Police and Fire Departments, was
received and filed.

carried, the 25th Annual Report of the Fire Department
was received and filed and Chief of Fire Department and
his assistants were con~nended for their work in
compiling the data and submitting such a complete
report.
On motion of Trustee Deckert, seconded by Cheney and
carried, the request of Frank ~muo to conduct public
dances on Saturday nights at the Woodmen's Hall, on
E. 4th St., was referred to the Chief of Police to
report back at the next meeting.
On motion of Trustee Deckert, seconded by Dixon and
carried, the supplementary agreements to dispense with
notices of renewals of lease No. 509 Eng-1529 on the
Military Reservation, Air Corps Replacement Center,
United States Army Air COrps and Lease No. W-509 Eng.-
1709 on the Wemt Coast Air Force Training Center, were
referred to the City Attorney to report back at the
next meeting.
The communications of the Fire Chief and of the
Cormnittee appointed to check the bids on fire equipment
stating that the bid of the Seagrave Corp. is the
lowest acceptable bid, were received and filed, and on
motion of Trustee Deckert, seconded by Cheney and
carried, all bids on fire equipment were ordered held

the Auditor was f nstructed to make necessary arrangement
for a certified census of the City of Santa Ana, which
would cost approximately $3,000.00, such census to be
secured by June 20th, 1944, for the purpose of securing

California.

carried, a Resolution urging the United States Government,
in its negotiations and proposed treaty with the Republic
of Mexico guaranteeing 1,500,O00~acre feet of Colorado
River water annually, to assure users of Colorado River
water in the United States their present rights to said
water and such treaty to make available to the Republic
of Mexico only such sdditfonal water as may be available
after present rights of users by people of this country

On motion of Trustee Deckert, seconded by Cheney and
carried, the Mayor w~s authorized to write to the Office
of Defense T~ansportation stating that the population of
the City of Santa Ana has increased greatly and that
five additional t~xicabs are urgently needed to provide
transportation and requesting that the extra gasoline be
furnished the Broadway Cab Co. for such taxicabs.

Honor Roll
Mr. Perry Childs, Commander, Veterans of Foreign Wars,
appeared before the Council requesting permission to
erect an Honor Roll on municipal property showing names
of male and female residents of the City of Santa Ana
who hn. ve entered the armed forces.
The Mayor ad~ised Mr. ~hilds that this plan would be
taken under advisement by the Council as a ~hole and
suggested that Mr. Childs be present at the next
meeting.

carried, request of E.D.Gregory, Pastor,Southern
Missionary Baptist Church, to place three directional
church signs at 4th and Ross, Nashington and Main and
l?th and Ross Sts, was referred to the City Engineer

to be kept the uniform size of 18" x 24".
On motion of Trustee Cheney, seconded by Dixon and
carried, request of Nm. L. Duerr, Pastor, Trinity
Lutheran Church to place small directional church signs
on lamp posts at 6th and No. Main Sts., Lacy and 1st
Sra. and Lacy and 4th Sts., was granted and signs to
be installed under supervision of City Engineer.

On motion of Trustee Deckert, seconded by Haan and
carried, the application of the Holiness Mission Church,
Inc. to solicit funds on Fridays or Saturdays, such
funds to be used for preaching the gospel and for radio
work, was denied, account Ordinance requires only 10%
of the amount to be collected to be used for solicitation
expenses.
On motion of Trustee Deckert, seconded by Cheney and
carried, communication from J.J.Zimmerman requesting
removal of two large trees, which are in danger of
crashing on his property at 210 So. Sycamore St., was
referred to Trustee Dixon and Chairman of the Forestry
Board with power to act.

was read requesting that the Council make proper invest-
igation to determine the cost and feasibility of

in order that a retirement system may be set up for all

Auditor with instructions that he secure all necessary

On motion of Trustee Deckert, seconded by Dixon and
carried, the Mayor and Clerk were authorized to sign
lease between the City of Santa Ana and the Citrus
Growers, Inc. c overin~ City owned Property in Tract No.
59, for the period of one year beginning January 1st,
1944, and continuing for the duration of the war and
six months thereafter, at the rental of $600.00 per
year.
On motion of Trustee Deckert, seconded by Cheney and
carried, house mover,s bond of Evart V. Almas, Charles
F. Almas and Bruce R. Almas, co-partners, doing business
as Almas House Moving, of South Gate, California, in
the amount of $1,000.00, written by the National Surety
Corporation, was approved.

The Mayor submitted a plan covering the installation of
welcome signs to Santa Aha at the East, West, North and
South entrances to the City, approximate size to be 12
ft. in width and 8 ft. high, to be of redwood and
concrete construction, at an estimated cost of $350.00,
with Luncheon Club emblems to be hung in the center span.
On motion of Trustee Haan, seconded by Cheney and carried,
the plan was approved and signs to be erected un,er the
supervision of the City Engineer and no other signs to
be permitted until such requests have approval of the
Council.

Mr. Perry Childs, Commander, Veterans of Foreign Wars,
appeared before the Council relative to location of the
Honor Roll to be erected on City owned property and
suggesting that such Xonor Roll be erected on the north-
east corner of 20th and North Main Streets.
On motion of Trustee Dixon, seconded by Deckert and
carried, permission was granted to the Veterans of Foreig~
Wars to erect this Honor Roll subject to submission of
plan to the Council showing exact location of this sign.

The Mayor suggested that the position of Civilian
Defense Coordinator be abandoned due to the fact that no
emergency exists at the present time and that the office
is primarily engaged in the activities of the War Counci
such as promoting sale of War Bonds, salvaging war
materials, etc. but that Secretary be retained to take
care of correspondence, files, etc. necessary to that
office.
On motion of Trustee Haan, seconded by Dixon and carried
the Mayor was appointed, as a committee of one, to
ascertain whether the City of Santa Ana is in Civilian
Defense Class No. 1 or 2, with power to act, on the
abandonment of the position of Coordinator.

Santa Ana detex~min~ng and declaring that weeds
which bear seeds of a wingy or downy nature and
attain such a large growth as to become a fire
menace when dry, and which are noxious and
dangerous, are growing upon certain streets,
sidewalks, and private property in said City
of Santa Ana, and are a public nuisance:
Directing the Street Superintendent to post
notices to destroy said weeds as required by
law: Fixing the time for hearing objections
and protests, and directing the abatement
thereof in accordance with an act of the
legislature of the State of California entitled,
"An Act authorizing municipalities to declare

The Mayor recormuended to the Council that office of
full-time Coordinator of Civilian Defense be done away
with and that a qualified pa~t-time Coordinator be
appointed; that Martha Starkey, Secretary, be retained
in the office as a full-time director, keeping all files
and records up to date. That the auxilliary fire and
police be placed under the Police and Fire Departments
and that the Control Room be kept in order and ready
for immediate operation. The Mayor stated that this
in no way effects the efficiency of Civilian Defense
but would be a saving to the tax-payers of approximately
$2600.00 a year. The Mayor thanked John Sylvester for
his splendid work as Coordinator and that this move in
no way reflects on his ehility. He further recommended
that Sidney Lowry be appointed as part-time Coordinator
of Civilian Defense, effective as of April 15th, 1944.
A motion was made by Trustee Dixon, seconded by Cheney
that the recommendation of the Mayor be accepted and
adopted.

Trustee Deckert moved that this matter be tabled until
next meeting in view of the fact that a survey is being
made in regard to retention of Civilian Defense set-up
and that this report would be available the first of
April. Motion lost for lack of a second.
The City Attorney stated that dignitaries of the Army
are of the opinion that Civilian Defense set-up should
be retained for the present.

period of one year, was approved.
The Chair gave a report on the Mayor's Conference on
Civilian Defense and Post-War Planning, which w~s held
at San wrancisco on April 13th, and on motion of
Trustee Dixon, seconded by Cheney and carried, the Mayor
and Auditor were given a vote of thanks for submitting
such a complete report on the Conference.

Joint Outfall Sewer, held at Anaheim, on June 1st, 1944,
were received and filed.
On motion of Trustee Haan, seconded by Dixon and carried,
the notification of the State Board of Equalization of
alcoholic beverage application made by Gabriel Palacios,
dba Bristol Market, 211 No. Bristol St., was received
and filed.
The application of E.W.Kunzel for permission to conduct
a roller skating rink at 924 E. let St., was read and
on motion of Trustee Cheney, seconded by Dixon and
carried, the permit was granted subject to the approval
of the Building Inspector, Fire and Police Departments.

On motion of Trustee Haan, seconded by Dixon and
carried, the application of the Powell Neon Sign Co. to
hang a neon sign for Mona's Cocktail Lounge, 800-502
So. Main St., was granted and sign ordered hung under
the supervision of the Electrical Inspector.
On motion of Trustee Cheney, seconded by Dixon and
carried, the applications of Carl C. Brown and Newton
Royce Shoemaker, to drive buses for the Santa Ana Bus
Co., were received and permits granted.
On motion of Trustee Cheney, seconded by Dixon and
carried, the application of Leslie A. Doyle to drive a
bus for the Santa Ana Bus Co. was received and permit
denied.
On motion of Trustee Dixon, seconded by Haan and
carried, the monthly reports of the Poundmaster, Juvenile
Bureau and of the Police Department, for the month of
May, 1944, were received and filed.
A petition was read,signed by 222 Cit~ Employees request-
ing the Council to place on an election ballot; a prop-
osition enabling the City of Santa Ana to Join ~n the
State Employees' Retirement System.
Messrs. C.W.Wolford and C.A.McCullough, representing the
Santa Ana City Employees Association appeared before the
Council relative to said petition.

Communication from Office of Defense Transportation
denying the a~pplication of Staton Bros. operating the
Broadway Cab Co. to add five taxicabs to their present
fleet of ten, was read and on motion of Trustee Deckert~
seconded by Cheney and carried, the communication was
received and filed.
Communication was read from the Executive Secretary of
the State Employees Retirement System stating that the
City of Santa Aha would be required to pay $4§2.§0 for
the services of a Consulting Actuary in making the
report which would give the ultimate annual cost to the
City if a contract is made to bring its employees into
the State Employees Retirement System.
On motion of Trustee Deckert, seconded by Haan and
carried, the Clerk was authorized to request the
Consulting Actuary to proceed wi th the investigation and
valuation to bring the employees of the City of Santa An
into the State Employees Retirement System and that the
retirement age of Policemen and Firemen be set at 60
years of age.
The report of M.L.Pearson, Public Accountant, stating
that 3,1V5 votes were cast for the use of Metropolitan
water and 1,4~1 against and that a total of 4,844 ballot
were cast, was read and on motion of Trustee Dixon,
seconded by Haan and carried, the report was accepted
and filed, and the City of Santa Ana to accept and use
,~etropolit an Water.
On motion of Trustee Deckert, seconded by Cheney and
carried, the notification of the State Board of Equal-
ization of alcoholic beverage application made by Sam L.
Finney, dba Charcoal Broiler, 522 No. Main St., was
received and filed.
On motion of Trustee Deckert, seconded by Dixon and
carried, the applicatiors of Aloha Lucile Maddox and
J.B.Kinzer, to drive taxis for the Breadway Cab Co.
and application of Norman P. Kennedy to drive a bus for
the Santa Aha Bus Co., were received and permits
granted.

A petition was read signed by 52 residents and property
owners in the vicinity of 1st & Lyon Sts. requesting
that a warning sign be placed at this corner in order to
eliminate traffic hazards.

Communication from the Santa Ana Junior Chamber of Commerce
was read, advising t~at their organization was in full
accord and agreement with the resolution presented by the
Citizens' Charter Fact Finding Committee on the proposed
City Charter for the City of Santa Ans. On motion of
Trustee Deckert, seconded by Dixon and carried, the commu-
nication was received and filed.
On motion of Trustee Deckert, seconded by Dixon and car-
ried, the Mayor was authorized to concede to the request
of the Planning Commission to hold Joint meetings of the
various public bodies in Ssnta Ana together wi th the Orange
County Planning Commission to discuss Post War Planning.
On motion of Trustee Deckert, seconded by Cheney and car-
ried, the application of the Powell Neon Sign Company to
hang an electric sign for Dr. Herman Bassler's Rest Home

The committee requested more time to study the fire

payment of a monthly charge of $9.00 for two telephone
lines from the Fire Dep~tment headquarters to the
County Sheriff,s office, to be used for remote control
in operation of radio station EGHX.

taxpayers opposing the use of the present Junior College
site for a Civic Center and remindin~ the Council that
the present City Hall is only ten years old and that
there is objection to the expenditume of public funds
unless absolutely necessary; also sug~estin~ that such
proposed Civic Center be grouped with present Court
House site as property in that vicinity could be
purchased from the County. Messrs. Everett White and
R.B. Spra~ue also appeared before the Council obJecttn~

Trustee Deckert reported on condition of busses and
overloading of same during peak periods of travel and
that the Manager of the Santa Aha Bus Co. had promised
to replace broken straps and endeavor to maintain busses
in as good condition as is possible under prevailing
circumstances; also that advertisements would be pub-
lished in the new~paper advising the public that every-
thing is being done to serve the public as efficiently
as possible under O.P.A. regulations.
Trustee Deckert stated that Mexican dances are being
held at V.F.W. Hall on Sunday nights and that the permit~
are issued by the Police Department to hold such dances
without payment of City license tax due to the fact that

Comunication from Phil M. Brown, Secy. Civil Service
Comission, advising of adoption of Amendment to Rule. IV
Section 16, of the Official Rules and Regulations, to
permit emergency appointees to take future recruitment
examinations at the discretion of the Civil Service
Board, was read, and on motion of Trustee Deckert,
seconded by Haan and carried, the Amendment to the
Civil Service Ordinance was approved.
Request of Southern California Telephone Co. for
temporary parking zone to permit parking of two cars

was read and on motion of Trustee Haan, seconded by

carried, the Mayor and Clerk were authorized to sign
the Request for Tender providing for the services to
be rendered in accordance with Agreement between the
United States of America and the City of Santa Ana, Cal.
for the disposal of sewage from the Naval Air Station,
Santa Ana and for construction of sewage connections,
dated January 18th, 194~.
A petition signed by twenty-four residents and property
owners in the vicinity of property lying adjacent to
the alley extending in m easterly and westerly directic
through Block 4 of the Salisbury Addition, located in
the 1000 block between W. 4th and W. 5th Sts., request-
ing that said alley be closed~ was read.
On motion of Trustee Deckert, seconded by Dixon and
carried, matter was referred to a committee for study
and report back at next meeting.

Mayor Hoffman, representative of the Joint Outfall Sewer
Board presented an amendment to the present agreement
of the City of Newport Beach for permanent connection
at a point where the City of Newport Beach now has a .
temporary connection for disposal of sewage and recommen~-
ed the same be approved.
On motion of Trustee Deckert, seconded by Haan and
carried, the Council approved the amendment to the
present contract of the Joint Outfall Sewer with the
City of Newport Beach as submitted by Newport Beach.
Pursuant to Resolution of Intention, the Clerk read the

The Committee reported that the quotation on general
liability insurance of E.D.Holmes, Jr. representing the
Pacific Indemnity Co. was the second lowest quotation
received, the lowest quotation having been withdrawn,
and recommended that this quotation be accepted.

carried, the recommendation of the Committee was
accepted and action ratified on the quotation of the
Pacific Indemnity Co. covering a premium for three year~
in the amount of $8,829.00, payable $1,843.00 annually
and if the City wishes to pay the premium in advance~
