RESOLUTION AUTHORIZING THE CONDEMNATION OF CERTAIN REAL PROP-
ERTY FOR PUBLIC STREET PURPOSES TO WIDEN EAST FIRST STREET
AND DECLARING THE PUBLIC NECESSITY THEREFOR
WH~, East First Street as it now exists in the City of Santa Aha,
California, is inadequate in width to accommodate the present and future demands
of traffic thereon and because thereof, is a present and continuing traffic
hazard;
NOW, THEREFORE,.BE IT RESOLVED: That the Council of the City of
Santa ~Lna does hereby find and determine that the public interest and necessity
require that East First Street between Hathaway Street and the Easterly City
Limits be widened and improved as shown on a map thereof on file in the office
of the City Engineer and herein referred to for greater detail, to accommodate
the present and future demands of traffic thereon and further require that said
City do have, take and acquire an easement for said purpose in and to those
parcels of land lying in the City of Santa Aha, County of Orange, State of
California and described as:
PARCEL 1: The Northerly 17 feet of the follqwing described property:
Lot A of the Stafford and Tustin Tract, in the City of Santa ~Lua,
County of Orange, State of California, as shown on a map thereof re-
corded in book 2, page 618~ Nhiscellaneous Records of Los Angeles County,
California; the Northwest corner of said Lot A being South 50 links
and East 50 links of the exterior boundaries as established by said
Stafford and Tustin Tract; excepting therefrom the Easterly 379.00
feet granted to the City of Santa Ana by deed as recorded in Book 1876,
page 280, Records of Orange County, California.
PARCEL 2: Beginning at the Northeast corner of Lot "A~' of "Menges
and Crook's Sub. of G. B. Lyon's Subdivision", in the City of Santa Ana,
County of Orange, State of California, as shown on a map thereof recorded
in Book l, page 98, Miscellaneous Maps, records of said Orange County;
thence South 75 feet; thence West 130 feet; thence North 75 feet; thence
East 130 feet to the point of beginning;
EXoF_J~TING therefrom that certain 10 foot strip off the Eastside
conYeyed to the City of Santa Ana by deed recorded March 29, 1904, in
book 103, page 243, Deeds, records of said Orange County.
BE IT FURTHER RESOLVED: That the City Attorney be and he is hereby
ordered and directed to bring an action in the name of the City of Santa Ana in
the Superior Court of the State of California in and for the County of Orange,
for condemnation of said property necessary to be taken as herein ordered and
heretofore described and do all things necessary to prosecute said action
to final determination.
BE IT FURTHER RESOLVED: That the public interest, necessity and con-
venience require and it is hereby ordered~ that the City of Santa Ana, a
Municipal Corporation, Plaintiff in the condemnation action ordered herein,
take immediate possession and use of the property herein ordered to be acquired,
upon complying with the requirements of the law applicable thereto and that the
City Attorney report to the City Council~ the amount of money required therefor
as soon as the same has been ascertained.
BE IT FURTHER RESOLVED: That the said action for condemnation of said
property so to be acquired shall be taken in accordance with Section
Article I of the Constitution of the State of California.
PASSED ANDADOPTED by the City Council of the City of Santa Aha at its
regular meeting held on the ?th day of Februar~ , 1955.
