CERTAIN REAL PROPERTY FOR THE PURPOSE OF INSTALLING
THEREON UNDERGROUND PIPE LINES FOR SANITARY SEWERS AND
DECLARING THE PUBLIC NECESSITY FOR SAID USE
WI~EREAS, theCity of Santa Aha has determined the necessity for the
installation of a sanitary sewer line northerly from Roe Drive to and across
West Orange Road to service the area within the City of S~nta Ana, between
Main Street and the Santa Ana Freeway, north of said Roe Drive; and
W~tEREAS, after study by the Engineer of the City, the location herein-
below set out has been determined to be the area best designed to service the
properties in the vicinity and least likely to cause damage to properties in
the area.
NOW~ THEREFORE, BE IT RESOLVED: That the Council of the City of Santa
Aha does hereby find and determine that the public interest and necessity re-
quire that the City of Santa Ana do have, acquire and t~dke an easement across,
through and upon that certain real property in the City of Santa Aha, County of
Orange, described as:
A strip of land twenty feet in width, extending from West Orange
Road to Roe Drive, the East line of said twenty foot strip being
parallel with and 655 feet Westerly, measured at right angles,
from the center line of Main Street,
and the Council of the City of Santa Ana does hereby find and determine t~t
said property is necessary for the purpose of locating and constructing thereon
and therein an underground pipe line for sanitary sewer to afford sewerage
service to all those properties north of Hoe Drive, between Main Street and
the Santa Ana Freeway, within the City of Santa Ana.
BE IT FURTHER RESOLVED: That the City Attorney be and he is hereby
ordered end directed to bring an action in the name of the city of Santa Ana
in the Superior Court of the State of California in and for the County of
Orange, for condemnation of said property necessary to be t~ken as herein ordered
and heretofore describe~ and do all things necessary to prosecute said action
to final determination.
BE IT FURTHER RESOLVED: That the public interest, necessity and con-
venience require and it is hereby ordered, that the City of Santa Ana, a
Municipal Corporation, Plaintiff in the condemuation action ordered herein,
take i~ediate possession and use of the property herein ordered to be acquired,
upon con,plying with the requirements of the law applicable thereto ahd that the
City Attorney report to the City Council, the amount of money required therefor
as soon as the same has been ascertained.
BE IT FURTHER RESOLVED: That the said action for condemnation of said
property so to be acquired shall be taken in accord~nce with Section 14,
Article I of the Constitution of the State of California.
