OF CERTAIN REAL PROPERTY FOR PUBLIC USE AND DECLARING
THE PUBLIC NECESSITY THEREFOR.
WItEEEAS, there now exists, in the City of Santa Arm, i~nediate need
for the property herein described to be used in connection with the Public
Park property contiguous thereto;
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City
of Santa Aha does hereby find and determine that the public interest s~nd
necessity require that the Public Park property, bounded on the North by
the South line of Tenth Street, on the South by a line parallel to and distant
125 feet North of the North line of Eighth Street, on the West by a line parallel
and distant 228.82 feet East of the East line of English Street, and on the
East by a line parallel to and distant 125 feet West of the West line of Artesia
Street be enlarged and brought to rectangular shape by inclusion of the property
herein described as the Southwesterly portion thereof; and that said public
interest and necessity require that said City do have, take and acquire, in
fee, for said purpose all that real property lying in the City of Santa Ana,
County of Orange, State of California and described as:
PARCEL 1: Commencing on the North line of Hickey Street, now
Eighth Street, at a point 401.6 feet West of the intersection
of said Hickey Street, now Eighth Street, with the West line of
Artesia Street, as said Artesia Street existed prior to September
l, 192~; running thence West on said North line of Hickey Street,
now Eighth Street, 200.8 feet; thence Northl~rallel with said
West line of Artesia Street, 355 feet; thence East 200.8 feet;
thence South 355 feet to the point of beginning;
EXCEPTING THEREFROM the South 125 feet.
PARCEL 2: That portion of Section ll, in Township 5 South, Range
l0 West, San Bernardino Base and Meridian, in said Orange County,
described as follows:
Beginning at a point in the West line of Artesia Street as said
street was established by deed to the City of Santa AmA dated
September 19, 1924, and recorded October 17, 1924, in book 545,
page 55, Deeds, records of said Orange County, said point being
125 feet North of the intersection of said line with the North
line of Eighth Street (formerly Hickey Street); thence Northerly
along said West line of Artesia Street 184 feet, more or less, to
the South line of the land conveyed to Deborah Carter Tr,~m~n by
deed recorded December 3, 1924, in book 552, page 227, Deeds,
records of said Orange County; thence Westerly along said South
line 125 feet; thence Northerly parallel to the said West line of
Artesia Street 46 feet; thence Westerly parallel to the North line
of Eighth Street 271.6 feet to the Northwest corner of the land
conveyed to Benjamin Walker and wife by deed recorded May 18, 1923,
in Book 473, page 73, said Deeds; thence South along the West line
of the land conveyed to Benj,mln Walker and wife by said deed 230
feet to a point 125 feet North of the North line of Eighth Street;
thence East and parallel with said North line of Eighth Street
396.6 feet to the point of beginning,
for such public improvement.
BE IT FURTHER HESOLVED: That the City Attorney be and he is hereby
ordered and directed to bring an action in the name of the City of Santa Aha
in the Superior Court of the State of California in and for the County of
Orange, for condemnation of said property necessary to be taken as herein
ordered and heretofore described and do all things necessary to prosecute
said action to final determination.
BE IT FURTBER RESOLVED: That the public interest, necessity and
convenience require and it is hereby ordered, that the City of Santa Aha,
a Municipal Corporation, Plaintiff in the condemnation action ordered herein,
take immediate possession and use of the property herein ordered to be acquired,
upon complying with the requirements of the law applicable thereto and that
the City Attorney report to the City Council, the amount of money required
therefor as soon as the same has been ascertained.
BE IT FURTHER RESOLVED: That the said action for condemnation of
said property so to be acquired shall be taken in accordance with Sectic~
Article I of the Constitution of the State of California.
PASSED AND ADOPT~iD by the City Council of the City of Santa Aha at
its regular meeting held on the 4th day of April, 1955.
