HomeMy WebLinkAbout55-116RESOLUTION NO. ~-ll6 A RESOLUTION ORDERinG THE STREET SUPERINT~DENT TO ABATE THE PUBLIC NUISANCE HERETOFORE DECLARED BY ~fE CITY COUNCIL OF THE CITY OF SANTA ANA, TO-WIT: WEEDS WHICH BEAR OF A WINGY OR DOWNY NATURE AND ATTAIN SUCH A LARGE GROWTH AS TO BECOME A FIRE M~IACE ~t~2~ DRY AND WHICH ARE NOXIOUS AND DANGEROUS, GROWING UPON CERTAIN STREETS, SIDEWALKS AND PRIVATE PDOPERTT IN THE CITY OF SANTA ANA, BY HAVING THE WEEDS REF~2{RED TO REMOVED. THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES RESOLVE AS FOLLOWS: SECTION ~: Pursuant to provisions of Chapter 13, Part 2, Division 3, Title & of the Government Code of the State of California, the City Council of the City of Santa Arm, having acquired jurisdiction so to do, hereby orders the Street Superintendent of said City to abate the public nuisance heretofore declared to exist in said City of Santa Ana, to-wit: Weeds which, when mature, bear wingy or downy seeds, which will attain a large gro~h as to become a fire menace when dry or which are otherwise noxious and dangerous, growing upon the streets or sidewalks in front of or upon all that private property described in Resolution No. 55-85 of the City Council of the City of Santa Ana, passed and adopted on the 21st day of March, 1955, to which Resolution reference is hereby made for further particular description of said private property. SECTION 2: Any property owner shall have the right to have any of said weeds removed at his own expense, providing the same is done prior to the arrival of the Street Superintendent or his representative to do the same. SECTION 3: The Street Superintendent shall keep an account of the cost of abating said nuisance in front of or on each separate lot or parcel of 1,nd where the work is done by him or his deputies, and shall render an itemized report, in writing, to the City Council of the City of Santa Arm, showing the cost of removing such weeds on each separate lot, or in front thereof, or both, provided that before said report is submitted to said City Council, a copy of the sam~ shall be posted for at least three (3) days prior thereto, on or near the Chamber Door of said City Council, together with a notice of the time when said report shall be submitted to the City Council for confirmation. At the time fixed for receiving and considering said report, the City Council shall hear the same, together with any objections which may be raised by any of the property ownersliable to be assessed for the work of abating said nuisance and thereupon make such mod~ Fications in the report as they deem necessary, after which said report sh=11 be confirmed. The amounts of the cost for abating such nuisance in front of or upon the various parcels of land men- tioned in said report shall constitute special assessments against the respective parcels of land, and, as is made and confirmed, shall constitute~a)_lien on said property for the amount of such assessments, respectively, and thereafter said amounts shall be collected at the same time and in the same manner as ordinary municipal taxes are collected and shall be subject to the same penalties and the same procedure under foreclosure and sale in case of delinquency as provided for ordinary .,micipal taxes. Reference is hereby made to said Resolution for further particulars. A copy of said Resolution is on file in the office of the Clerk of the Council. All property owners having any objection to the proposed removal of such weeds are hereby notified to attend a meet'lng ef t~ ~tty Council of said City of Santa Aha to be held on the ~nd~ day of Nayilf 19§5, when the objections will be heard and given due consideration.
