CERTAIN REAL PROPERTY FOR THE PURPOSE OF INSTALLING THEREON
UNDERGROUND PIPE LINES FOR SANITARY SEWERS AND DECLARING THE
PUBLIC NECESSITY FOR SAID USE
~HEREAS, the City of Santa Aha has determined the necessity for
the installation of a sanitary smwer line beginning at a point in
Clay Street at its intersection with the Easterly extension of Edinger
Street; thence Easterly to the Southerly extension of Lyon ~treet;
thence Northerly along the Southerly extension of Lyon Street and
Lyon Street to Main Street; thence Easterly along Main Street to a
point approximately 1,000 feet East of the Southerly extension of
Mabumy Street; thence Northerly to First Street, to service the Easter-
ly, SoutheaaSerly and No~'therly areas of the City; and
WHEREAS, after study by the Engineer of the City, the location
hereinbelow set out has been determined to be the area best designed
to service the properties in the vicinity and least likely to cause
damage to p~operties in the area;
NOW, THEREFORE, BE IT RESOLVED: That the C~ty Council of the
City of Santa Arm does hereby find and determine that the public inter-
est and necessity require that the City of Santa Ana do have, acquire
and take an easement across, through and upon those certain parcels
of real property in the County of Orange, described as:
PARCEL l: An easement for ~anitary Sewer purposes over a
twenty (20) foot strip of land, the center line of which is de-
scribed as follows: The Northerly 990 feet of the following:
Beginning at a point on the center line of McPadden Street,
which bears South 89° 00' 05" West 10.01 feet from the intersec-
tion of the center line of McFadden Streetowlth the monumented
center line of Lyon Street; thence South5 39' 49" West
feet; thence South 0° 32' 45" West 724.24 feet; thence South 0v
31' 20" West 1554.03 feet.
PARCEL 2: An easement for Sanitary Sewer pumposes over a
angular shaped parcel of land bounded Northerly by the South line
of McFadden Street, bounded Southeasterly by Parcel l, and bounded
Westerly by the Northerly extension of a line parallel with, and
10.00 feet Westerly from, measumed at right angles with, the
second course in Parcel 1.
PARCEL 3: An easement for sanitary sewer pumposes over the
Westerly 15 feet of the following described p~operty: The North
half of the Nest half of Lot C of Stafford and Tustin Tract in the
Count~ of Orange, State of California, as per map recorded in Book 2,
Page bls of Miscellaneous Records of Los Angeles County, California.
PARCEL 4: An easement for Sanitary 3ewer purposes over a
strip of la~ud 20 feet in width being 10 feet on each side,
memsur®d at right angles from the following described center line:
Beginning at a point on the center line of McClay Street, which
is 2500.38 feet Southerly from the intersection of the center line
of McFadden Street with the center line of McClay Street as it ex-
ists South of said McFadden Street._..and running thence Easterly in
a straight line for a distanceof 1615.44 feet to a point on the
City boundary line which is 2540.26 feet Southerly from the center
line of said McFadden ~treet measured along said City bmndary line.
PARCEL 5: An easement for Sanitary Sewer Purposes over a fifteen
(15) foot strip of land the center line of ~ahich is described as
follows: Beginning at a point on the center line of McFadden
Street, which bears South 89 00' 05" West 12.53 feet from the inter-
section of the center line of McFadden Street withthe monumented
center line of Lyon Street; thence South 5° 39' 49" West 274.74 feet;
thence South 0° 321' 45" West 724.24 feet; thence South 0° 31' 20"
West 1554.03 feet.
EXCEPTING the Northerly 990 feet,
and does hereby find and determine that said property is necessary for
the purpose of locating and constructing thereon and therein, an under-
ground pipe line for sanitary sewer to afford sewerage service to those
areas hereinabove set out.
BE IT FURTHER RESOLVED: That the City Attorney be and he is
hereby ordered and directed to bring an action in the name of the City of
Santa Aha in the Superior Court of the State of California in and for the
County of Orange, for condemnation of said property necessary to be taken
as herein ordered and heretofore described and do all things necessary
to prosecute said action to final determir~tion.
BE IT FURTHER RESOLVED: That the public interest, necessity and
convenience require and it is hereby ordered, that the City of Santa Ana,
a Municipal Corporation, Plaintiff in the condemnation action ordered
herein, take immediate possession and use of the property herein ordered
to be acquired, upon complying with the requirements ofthe law applica-
ble thereto and that the amount of money required by the Court to be
deposited to guarantee payment of any Judgment which may be rendered
against the City in said action, be so deposited.
BE IT FURTHER ~SOLVED: That the said action for condemnation
of said property so to be acquired shall be taken in accordance with
Section l~, Article I of the Constitution of the State of California.
