HomeMy WebLinkAbout56-151RESOLUTION NO. 5g-151 AUTHORIZING EXECUTION OF AOREENENT ~NITH STATE OF CALIFORNIA RE ENGINEERING PROJECTS WHEREAS, the City of Santa Ana has submitted a project state- ment to the State of California, Department of Public Works, Division of Highways, showing proposed expenditure of gasoline tax allocation for major city streets for the 1957 fiscal year, and agreement has been reached regarding the same; NOW, THEREFORE, ~E IT RESOLVED: That the Nayor and the Clerk of the Council are hereby directed and authorized to execute that certain agreement, a copy of which is attached hereto and by refer- ence made a part hereof, in the name of the City of Santa Ana, and to forward one original and one duplicate to the Los Angeles office of the Division of Highways. Chandler COUNCIL~EN: None COUNCI IA~N: ~' f~one CLERK OF THE COUNCIL MEMORANDUM OF AGREEMENT FOR EXPENDITURE 01~ ENGINEERING ALLOCATION FOR CITY STREETS E~GINEERING PROJECT AGREEMENT -1957 FISCAL YEAR MEMORANDUM OF AGREEMENT entered into by and between the City of Santa Ana, hereinafter referred to as the city, and the Department of Public Works of ~he State of California, hereinafter referred to as the department, WITNESSETH, THAT, WHEREAS, in accordance with the pro- visions of Section 2107.5 of the Streets and Highways Code, certain sums shall be transferred to the State Highway Fund for expenditure exclusively for engineering costs and admin- istrative expenses in respect to city streets; and WHEREAS, in accordance with the requirements of Section 196 of the Streets and Highways Code, the city has set up by Ordinance No. 1022 a Special Gas Tax Street Improve- ment Fund in which shall be deposited all amounts allocated pursuant to Section 194 and 2107.5 and received by the city; NOW, THEREFORE, in consideration of the premises and of the several promises to be faithfully performed by each as hereinafter set forth, the city and the department do hereby mutually agree as follows: -1- ARTICLE I. PROJECT The project and the estimated expenditure therefor as listed hereinafter constitute the budget heretofore sub- mitted by the city, which bas been, and is hereby, approved by the department: Project No. E 2 I Preliminary Engineering _ $5,000.00 (Surveys, plans, specifications, estimates of cost) II Construction Engineering III Advance Planning Traffic studies - Planning surveys Estimating cost of correcting deficiencies Materials,Other research and testing 2,500.00 IV Curb and gutter grade surveys V Miscellaneous Total $7,500.00 -2- ARTICLE II. DELEGATION OF WORK The city will perfor~ the work herein described. ARTICLE III. FUNDS Funds to defray the cost of the work described in Article I and payable from revenue accruing under the provisions of Section 2107.5 of the Streets and Highways Code are available as follows: Esti~mted to accrue du~ing the fiscal year ending June 30, 1957 ~7,500.00 The amount of $ 7,500.00 is budgeted to defray the cost of the work described in Article I. The department will pay to the city its share of the money allocated under the provisions of Section 2107.5 of the Streets and Highways Code until $ v ~00 OO budgeted herein and delegated to the c~%~ f~r expenditure has been paid, in addition to the amount of $ none previously paid to the city and remaining unexpended in the city, s special gas tax street improvement fund. -3- The amount provided for the project listed in Article I must not be exceeded, and no moneys may be expended by the city from the special gas tax street improvement fund except for the project listed in Article I without amendin~ the budget by supplemental agreement. Such supplemental agreement shall be valid only when executed by the city and the department~ All funds allocated under the provisions of Section 2107.5 of the Streets and Highways Code in excess of such funds budgeted herein for expenditure will accumulate for future budgeting and expenditure. ARTICLE IV. ANNUAL AND FINAL REPORTS Within sixty days after completion of each project the city shall submit to the department a final report. If the work is not completed prior to the end of the fiscal year, an annual progress report of expendi- tures shall be su~mitted to the department by the city, within sixty days after the end of the fiscal year. The report shall show the work accomplished in such detail as required by the department. -4- ARTICLE V. MISCELLANEOUS PROVISIONS No State officer or employee shall be liable for any- thing done or omitted to be done by the city in the per- formance of any work delegated to the city under this agreement. The city shall, in the event any claim is made against any State officer or employee by reason of such work, indemnify and hold harmless such officer or employee from any damage or liability by reason of any such claim.
