HomeMy WebLinkAbout56-218RESOLUTION NO. 56-218 GIVING NOTICE OF PROPOSED ANNEXATION TO T~HE CITY OF SANTA ANA OF THAT CERTAIN UI~Ii~tABITED TERRITORY DESCRIBED HEF~IN AND DESIGNATED '~BERNSTEIN FIFTH STREET ANI~EX", AND GIVING NOTICE OF TI~E ~D PLACE FOR HEARIi~G OF PROTESTS THERETO ~HEREAS, the Boundary Commission of Orange County, California has approved the description of certain real property as herein set out for the purpose of annexation; and WHEREAS, t~le o~mers of said real property have filed a petition with the Clerk of the Council, requesting that the City of Santa Ana, California annex said real property, stating that the same is uninhabited, consenting in writing that said real property may be taxed to pay any indebtedness or liability of said City contracted prior to such annexation; NOW, THEREFOP~, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby declares its intention to annex all of said territory under the provisions of the Annexation of Unin- habited Territory Act of 1959 and finds and hereby declares that said territory is deemed uninhabited since it had less than 12 registered voters residing in it on August 6, 19~, the date when said petition was filed, that City of Santa Ana, California, is described as: said territory is contiguous to the lies in the County of Orange, ~nd That portion of the South half of the Southeast quarter of Section 10, Township 5 South, Range l0 West, S. B. B. & ~., described as follows: Beginning at a point in the centerline of West Fifth Street as conveyed to the County of Orange by deed recorded in Book 2~2, Page 327, Deeds, Records of Orange County, California, said point being located 77.17 feet South 89° 3~' 00" West from a bolt marking the Westerly end of the first course de- scribed in said deed to the County of Orange, said point of beginning also being an angle point in the Westerly boundary of the City of Santa Ana, said point also being the Northwest corner of "Fifth at King Annex~, adopted by Ordinance NS-92, April 4, 1955; running thence South 23° 23' 10" West 741.01 feet along the Westerly boundary of the City of Santa Ana to a point in that certain boundary line established by agreement between J. H. Stewart and wife and L. L. Merchant and wife re- corded February 28, 192~ in Book ~6~, Page 1~9, Deeds, Records of Orange County, California; thence North 89° 4a' 00" West 324.56 feet along said boundary line and along the Northerly boundary of the City of Santa Aha; thence North 23o 23' 49" East 735.54 feet to a point in the centerline of West Fifth Street as conveyed to the County of Orange; thence North 89° 35' 00" East 326.41 feet to the point of beginning. Bearings and distances shown on Record of Survey filed in Book 33, Page 8. That said Council hereby designates "Bernstein Fifth Street Annex" as an appropriate name for said annexation. That said Council hereby declares its intention to and it will munex said territory to and include it within the Santa Aha Elementary School District, Santa Aha High School District and Santa Ana Junior College District and upon the completion of said annexation, said territory shall be and become a~part of said School Districts. NOTICE IS HEREBY GIVEN that September 17, 1956 at the hour of 7:30 P.M. in the Council Chambers in the City Hall at Third and Nain Streets, in the City of Santa Ana, California, is the time and place fixed at which said Council will hear protests made by any person owning real property within said territory so proposed to be annexed. At any time before said hour, any owner of any of said property may file written protest against this proposed an- nexation. Such protest should state the owner's name and, in general terms, a description and area of the property owned. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 6th day of August, 1956.
