CLAIMING SEWER EASE~ENT AND ACCEPTING A DEED GRANTING
SEWER EASF2~d~NT
WHEREAS, heretofore the City of Santa Ana acquired an easement
for the construction and maintenance of a certain sewer line over the
West 15 feet of Lot 5 of the ~;~abury Tract, as shown on map recorded in
Miscellaneous Records, Book 36, Page 65, Records of Los Angeles County,
California, which said easement is not in a desired location for City
use, and should be quit-claimed to the H. & J. Mabury Company, and
V~qEREAS, the H. & J. t~labury Company has offered to the City a
deed granting an easement for the construction, maintenance, operation
and repair of sewer mains, all as set forth in a deed dated ~.Iarch 3,
1958, without cash consideration being paid therefor by said City.
NOW, TiCEREFORE, BE IT RESOLVED: That the Mayor and the Clerk
of the Council are hereby directed to execute, in the name of the ]ity,
the deed quit-claiming the sewer easement hereinabove referred to to
the H'. & J. ~abury Company, a corporation, ~nd to deliver the same to
said corporation.
BE IT FURTHER RESOLVED: That the City of Sauta Ana hereby
accepts said deed granting the sewer easement hereinabove referred to
from the H. & J. }~abury Company, and C. J. Thornton, the designated
agent of the City, is hereby instructed to attach to said deed his
Certificate of Acceptaace on behalf of t.he City.
