HomeMy WebLinkAbout58-150RESOLUTION NO. 58-150 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, CALIFORNIA, FINDING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE IMPROVEMENT OF ST. ANDRE~ PLACE AND OTHER STBEI~.TS, ALL WITHIN THE CITY OF SANTA ANA WHEREAS, a public hearing has been held, duly and regularly, pursuant to Resolution No. 58-139 and the laws and Constitution of the State of California, on the proposed improvement of St. Andrew Place and other streets, all within the City of Santa Ana, by the removal of existing improvements, grading, preparing of subgrade, paving with asphaltic plant mix, construction of concrete curbs, gutters, and driveway aprons, and appurtenant work thereto; and WHEREAS, said improvement has been considered fully: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA AMA DOES RESOLVE AS FOLLOWS: SECTION 1. That the said City Council hereby finds and determines that the public convenience and necessity require the improvement of: Oak Street between Delhi Road and the north line of Tract No. 560; Kilson Drive between Delhi Road and the north line of Tract No. 560; Hickory Street between Delhi Road and the north line of Tract No. 560; Halladay Street between Delhi Road and the north line of Tract No. 560; The easterly portion of Rousselle Street between Anahurst Place and the north line of Tract No. 560; Cedar,Street between St. Andrew Place and a point 415 feet - north of the center line of St. Andrew Place; Evergreen Street between St. Andrew Place and a point feet · uorSh of the center line of St. Andrew Place; The westerly portion of Standard Avenue between St. Gertrude Place and a point ~15 feet north of the center line of St. Andrew Place; -1- ATTEST: St. Andrew Place between Rousselle Street and Standard Avenue; St. Gertrude Place between Rousselle Street and Cedar Street, and the northerly portion of St. Gertrude Place between Cedar Street and Standard Avenue; Anahurst Place between Rousselle Street and the east line of Tract No. 668; and The northerly portion of Delhi Road between Rousselle Street and the east line of Tract No. 668, all within the City of Santa Aha, by the removal of existing im- provements, grading, preparing of subgrade, paving with asphaltic plant mix, construction of concrete curbs, gutters, and driveway aprons, and appurtenant work thereto, the nature, location, and ex- tent of the proposed improvement and the district to be assessed for the cost and expense thereof shown, respectively, on the pro- file and improvement plan No. AD199, and specifications entitled "Specifications for Street Improvements in Assessment District No. 199", and assessment district map No. AD 199, Sheet 1. SECTION 2. That the said City Council hereby finds and determines further that the "Special Assessment Investigation, Limitation, and Majority Protest Act of 1931" shall not apply to the making of said improvement. SECTION 3. That the said improvement shall be conducted under the Improvement Act of 1911 which is Division 7 of the Streets and Highways Code of the State of California, and the City Engineer and the City Attorney hereby are instructed to present to the said City Council the said Resolution of Intention required by said Improvement Act to initiate the proceedings for the improve- ment. SECTION 4. The Clerk of the Council shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect.
