GRANTING A LIFE ESTATE
?;HEREAS, in the negotiation for the acquisition of a parcel of
real property located at ~he Southwest corner of Eighth and Ross
Streets, i~he Civic Center site, the City of Santa Ana entered into a
compromise a~reement whereby,~nong other things, it agreed to grant
a life estate to one Charles Smith in exchange for his one-third
interest in said parcel needed for Civic Center purposes, as a nec-
essa~y step in obtaining immediate oossession to said property, and
to deliver the same to the $o~nty ~erk of Orange County to be deliv-
ered to said Charles Smith only upon Order of the Court.
NOW, THEREFORE, BE IT RESOLVED THAT the L~ayor and the Clerk
of the Council are hereby directed to execute a deed granting a life
estate to Charles Smith in ar~ to that certain real property in the
Cit~ of Smuta Ana, County of Orange, State of California, described
as:
The easterly 13-1/2 feet of Lot ll and the westerly 28
feet of Lot l0 of Gildmacher,s Addition, as per ~ap
recorded in Book 23, Page 37 of ~iscellaneous Records
of Los Angeles County, California,
and to deliver the same to L.
County;

BE IT FURT~fER RESOLVED THAT the City Council hereby agrees to
reimburse Charles Smith for his costs of moving in an amount not to
exceed ~7~.00, the s~me to be paid upon presentation by said Charles
Smith to the Finance Officer of the City of Santa Ana of a statement
and receipts showing his actual cash disbursements necessary in the
~oving of his household snd personal effects from his present home
at Eighth and Ross Streets to the residence located at 10~3 West
Sixth Street, Santa Aha, Califo~ia; and
BE IT FURTiER RESOLVED THAT tne City of S~ ta Ana, California
hereby agrees with said Charles Smith that upon the termination of
said life estate it will pay to the estate of said Charles Smith the
sum of ~,~00.00, less any an]ount necessary to repair the property at
10~3 West Sixth Street, Santa Ana, C~ifornia, to preserve the s~me in
as good condition as when said Charles Smith took possession thereof,
and any a~nount necessary to oay unpaid taxes that became due on said
property during the lifetime of said Charles Smith, it being under-
stood that said Charles Smith shall have all the o~ligations of a
life tenant, except that the City will carry fire insurance on struc-
tures standing on said property to protect its interest as a remainder-
man and said Charles Smith shall carry his own insurance to protect
his life estate interest, and destruction or damage by fire shall not
relieve the City of paying the $~,~00.00 herein provided for.
