CERTAIN F~AL PROPERTY FOR THE WIDENING OF BORCHARD
STREET ON THE NORTH SIDE, IMMEDIATELY WEST OF OLIVE
STREET
WHEREAS, Borchard Street, from Olive Street to
feet West of Olive Street, in the City of Sauta Aha,
adequate in width for the present and future demands
and
a point 136.71
California, is in-
of traffic thereon,
WHEREAS, Borchard Street, from Olive Street to a point 136.71
feet West of Olive Street is only one-half the width of a normal street,
snd the northerly one-half of a normal street does not there present-
ly exist, and it being necessary to open said street to a full normal
width to accomodate the present and future traffic in the area;
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of S~a Aha hereby finds, determines and declares that:
1. Public interest and necessity requires the acquisition of
an easement for street right-of-way across the resl property he~-eln-
below described:
2. That said proposed improvement is located in a manner which
will be most compatible with the greatest public good and the least
private inJu~y.
3- That an action in Eminent Domain be filed to take and ac-
quire an easement for said pumposes and for all the purposes of a
public street over and thmough that certain real property in the
City of Santa Ana, County of Orange, State of California, described as:
Beginning at a point on the Northerly extension of the West
line of Lot 12 in Tract No. ?53, as shown on a map thereof,
recorded in Book 22 at Page 39~ Niscellaneous Maps, Records
of Orange County, California; bO feet northerly from the North-
west corner of said Lot 12; thence South 0° 36' 40"oWest along
said ex.tended West line 26.03 feet; thence South 89 32' 35'I
East 13b. T1 feet; thence North 0° 36' 40" East 25.23 feet;
thence North 89 12 35 West 136.?1 feet to the point of be
ginning. All bearings and distances are as shown on a licensed
surveyor,s map filed in Book 10, Page 43, of Record of Survey
in the office of the County Recorder of Orange County, California.
~E IT FURTHER RESOIPED: That the City Attorney be and he is
hereby ordered and directed to bring an action in the name of the
City of S~ta Ana in the Superior Court of the State of California in
and for the County of Orange, for condemnation of ssi d property
necessary to be taken as herein ordered and heretofore described
and do all things necessary to prosecute said action to final deter-
mination.
BE IT FURTHER RESOLVED: That the public interest, necessity
and convenience require and it is hereby ordered, that the City of
Santa Aha, a Municipal Corporation, Plaintiff in the condemnation
action ordered herein, take immediate possession and use of the prop-
erty herein ordered to be acquired, upon complying with the require-
ments of the law applicable thereto and that the City Attorney report
to the City Council the amount of money required therefor as soon as
the saree has been ascertained.
BE IT FURTHER RESOLVED: That the said action for condemnation
of said property so to be acquired shall be taken in accordance with
Section ~, Article I of the Constitution of the State of California.
