RESOLUTION NO. 59-45 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DECLARING ITS INTENTION TO IMPROVE TOWN]ER STREET AND OTHER STREETS IN THE CITY OF SANTA ANA, DETERMINING THAT BONDS SH~LL BE ISSUED TO REPRESENT THE COST THEREFOR, DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT, AND THAT THE EXPENSE THEREOF SHALL BE ASSESSED UPON A DISTRICT WHEREAS, the City Council of the City of Santa Aha, by Resolu- tion No. 59-37, adopted February 16, 1959, set a hearing, pursuant to Section 17 of Article XIII of the Constitution of the State of California, for March 2, 1959, to determine whether the public con- venience and necessity require the improvement of the streets re- ferred to in said resolution, by the doing of the work described iu said resolution; and WHEREAS, on said date said hearing was held and said City Council, by Resolution No. 59-44 , adopted by a four-fifths vote on March 2, 1959, determined that the public convenience and neces- sity require the said improvement of Santa Aha, by the doing of said work, lution; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Santa Ana to order, the following work to be done, to wit: the im- provement of: Towner Street between Fairview Avenue and Russell Avenue; Russell Avenue between Rosewood Avenue and Shelton Street; Russell Avenue between Towner Street and Lowell Street; Rosewood Avenue between Borchard Avenue and a point 280 feet ! north of the center line of Borchard Avenue; Borch~rd Avenue between Rosewood Avenue and a point 164.22 feet i east of the center line of Shelton Street; Milshire Avenue between Olive Street and a point 166.70 feet ~ west of the center line of Olive Street; said streets in the City of all as set forth in said reso- -1- Wilshire Aveuue between Shelton Street and a point 155.08 feet ! west of the center line of Shelton Street; Baker Street between Fairview Avenue and Cubbon Street; and Cubbon Street between Baker Street and a point 281 feet ~ east of the center line of Baker Street; all within the City of Santa Aha, by the construction of Portland cement concrete sidewalks, curbs, gutters, cross-gutters, and drive- way aprons, the grading, preparing of subgrade, aud Daving with as- phaltic coucrete plant mix, and appurteuant work thereto. That all of the foregoing work shall be done in accordance with the profile and improvement plan, No. AD 202, and any supple- mental drawings mentioned thereon, which said profile and improve- ment plan was adopted by Resolution No. 59-35 of the City Council on February 16, 1959, and is on file iu the office of the City Engi- neer of the City of Santa Aha, and in accordance with specification entitled "Specifications for Improvement in Assessment District 202," which was adopted by Resolutiou No. 59-35 of the City Council on February 16, 1959. The work and improvement herein described shall be con- structed to the grades, subgrades, and elevations severally shown upon said profile and improvement plan, No. AD 202, and detailed drawings thereon, in the respective locations thereof. Reference hereby is made to the profile aud improvement plau, No. AD 202, for a description ~ the grades to which all the work and improvements under this Resolution of Intention shall be doue, which said grades hereby are adopted and established as the official grades therefor, for all purposes in connection with the proceedings pursuant to this Resolution of Intention. Notice hereby is given that said grades are or may be, in part, new and different from those hereto- fore established or existing, or may be, and in some cases are, different from existiug ground levels. SECTION 2. The estimated cost of this improvement is $i6,800.00. -2- That a portion of the cost and expenses of the work described herein in the amount of ~6j940.00 shall be paid out of the treasury of the city from the general fund thereof. That said proposed work or improvement, in the opinion of the City Council of the City of Santa Aha, is of more than local or ordinary public benefit, and the Council hereby proposes that the district in the City of Santa Aha to be benefited by said work or improvement and to be assessed to pay the cost and expenses thereof is shown on that certain plan or map, ~. Sheet No. l, AD 202, indicating the exterior boundary thereof, approved by Reso- lution No. 59-36 of the City Council on February 16, 1959, and on file in the office of the City Engineer. Said plan or map hereby is referred to and shall govern for all details as to the extent of the assessment district. The assessment district includes, in gen- eral~ the lots and parcels of land abutting upon or contiguous to the hereinabove described streets, but reference hereby is made to said plan or map for all details as to the extent of said assess- ment district and for any variation between the last mentioned gen- eral description and the extent of the assessment district as shown on the plan or map. All public streets or alleys~ or portions thereof, hereby are excepted from said district. SECTION 5. That serial bonds~ bearing interest at the rate of 6% per annum, shall be issued to represent each assessment of 950.00 or more remaining unpaid for thirty (30) days after the date of the recordation of the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October 15th following their date. Payments on the principal of unpaid assessments and interest shall be ma~by property owners to the City Treasurer, and the sums shall be disbursed by him or as provided in the Improvement Act of 1911 hereinafter referred to. SECTION 4. Notice hereby is given that on April 6, 1959, at 7:30 o!clock P.M., in the Council Chamber of said city in the City Hall located at Third and Main Streets, Santa Aha, California, any and all persons having any objection to the proposed work or improvement, to the extent of the assessment district, or both, may appear before the City Council and show cause why the proposed work or improvement should not be carried out in accordance with this Resolution of Intention. Protests must be in writing, must contain a description of the property sufficient to identify it, and must be delivered to the Clerk of the Council not later than the hour set for hearing. SECTION 5. The Superintendent of streets immediately shall cause notice of the passage of this Resolution of Intention to be posted conspicuously along the line of the contemplated work or im- provement and along all the open streets within said district, in the manner and form prescribed by law. The Clerk of the Council hereby is directed to mail notices, in the manner and form prescribed by law, of the adoption of this resolution to all persons owning real property in the here- inbefore described assessment district, whose names and addresses appear on the last equalized assessment roll for City taxes or as known to the Clerk of the Council. SECTION 6. The City Council of the City of Santa Aha, in making the improvement and in doing the work prescribed herein, elects to proceed under and in accordance with the provisions of the Improvement Act of 1911, being Division 7 of the Streets and High- ways Code of the State of California. SECTION 7. The Clerk of the Council shall certify to the adoption of this Resolution of Intention and shall cause the same to be published twice in the "Santa Aha Register," a newspaper published and circulated in the City of Santa Ana, the first of which public~ tions shall be not less than ten (10) days prior to April 6, 1959, the date of said hearing, and which hearing shall be not less than fifteen (15), nor more than sixty (60) days after the date of adoption of this resolution. SECTION 8. The Clerk of the Council shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
