A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA PROPOSING MODIFICATIONS IN THOSE PROCEED- INGS FOR THE IMPROVEMENT OF TOWNER STHEET AND OTHER STR~,TS IN THE CITY OF SANTA ANA INSTITUTED PURSUANT TO RESOLUTION NO. 59-37 THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES RESOLVE AS FOLLOWS: SECTION 1. That said City Council hereby proposes to modify the hereinafter listed resolutions and documents pertaining Noo to those certain~oceedings instituted pursuant to Resolution/59-37 and Resolution of Intention No. 59-45 for the improvement of Towner Street and other streets in the City of Santa Aua by the construc- tion of Portland cement concrete sidewalks, curbs, gutters, cross- gutters, and driveway aprons, the grading, preparing of subgrade, and paving with asphaltic concrete plant mix, and appurtenant work thereto. Each of the hereinafter listed resolutions and documents are proposed to be modified by deleting therefrom: "Towner Street between Fairview Avenue and Russell Avenue; Russell Avenue between Rosewood Avenue and Sheltou Street; Russell Avenue between Towner Street and Lowell Street; Rosewood Avenue between Borchard Avenue and a point 280 feet ! north of the center line of Borchard Avenue; Borch~rd Avenue between Rosewood Avenue and a point 16~.22 feet - east of the center line of Shelton Street; Wilshire Avenue between Olive Street and a point 166.70 feet ! west of the center line of Olive Street; Wilsh~re Avenue between Shelton Street and a point 155.08 feet - west of the center line of Shelton Street; Baker Street between Fairview Avenue and Cubbon Street; and Cubbon Street between Baker Street and a.point 281 feet $ east of the center line of Baker Street; and substituting therefor, in each place in each of said resolutions and documents where the above quoted language appears, the following: "Towner Street between Fairview Avenue and Russell Avenue; Russell Avenue between Rosewood Avenue and Shelton Street; -1- Russell Avenue between Towner Street and Lowell Street; Rosewgod Avenue between Borchard Avenue and a point 280 feet· north of the center line of Borchard Avenue; Rosewood Avenue between Russell Avenue and a point 580 feet ! southerly of the center line of Russell Avenue; Borchard Avenue between Rosewood Avenue and a point164.22 feet ! east o£ the center line of Shelton Street; Wilsh~re Avenue between Olive Street and a point 166.70 feet - west o£ the center line of Olive Street; Wilshire Avenue between Shelton Street and a point 155.08 feet ! west of the center line of Shelton Street; Baker Street between Fairview Avenue and Cubbon Street; and Cubbon Street between Baker Street and a point R81 feet east of the center line of Baker Street;" Those resolutions and documents so proposed to be modified are: l) Resolution No. 59-37 adopted February 16, 1959; Affidavit dated February 28, 1959, relating to the publication of Resolution No. 59-37 ou February 19 and February 28, 1959; the copy of Resolution No. 59-37 made a part thereof, and Resolution No. 59-37 as so published ou said days; 3) Resolution No. 59-44 adopted March 2, 1959; Resolution No. 59-45 adopted March 2, 1959; 5) Affidavit of Publication dated March 28, 1959, re- lating to the publication of Resolution No. 59-45 on March 21 and March 28, 1959; a copy of the resolution made a part thereof, and said resolution so published on said days; Notice of Improvement signed by the Street Superintend- eut of said city, posted ou March 18, 1959, giving notice of the adoption of Resolution of Intention No. 59-45, and the copy of said notice so posted, attached to and made a part of the Affidavit of Posting dated March 19, 1959; Notice signed by the Clerk of the Council of said city and mailed on March 19, 1959, and the copy of said notice attached to the Affidavit of Mailing thereof dated March 19, 1959; and 8) Resolution No. 5~-00 adopted April 6, 1959. SECTION 2. That the plans and specifications adopted by Resolution No. 59-~35, include the work on all of the streets pro- posed by this resolution to be included within each of the resolu- tious and documents mentioned in said Section 1. -2- SECTION 3. The purpose of this resolution and the modi- fications proposed hereby is to clarify apparent inconsistencies in the above mentioned documents, the plans aud specifications pertai~ ing to the proceedings, and to set forth correctly the Factual data relating thereto. The plans and specifications called for the work to be done hereunder to be done in all of said streets as set forth in Section I hereof and, therefore, the modifications proposed here- in, if ordered, will not increase or decrease the estimated cost of the work. SECTION 4. Notice hereby is given that, on the 4th day of May, 1959, at 7:30 o'clock P.M. any person interested in the pro- ceedings referred to in said resolutions, notices, and affidavits above noted, said proceedings being for the improvement of Towner Street and other streets as set forth in said above resolutions and as proposed to be modified hereby, having any objections to the changes or modifications proposed herein may appear before said City Council and show cause why said changes or modifications should not be ordered and any person interested may file written objections to the proposed changes or modifications with the Clerk of the Council at any time not later than the time set for hearing. SECTION 5. The Clerk of the Council hereby is directed to publish this resolution in "The Santa Aha Register" at least once, such publication to be at least ten (10) days prior to the date of the above public hearing. SECTION 6. The Clerk of the Council shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
