HomeMy WebLinkAbout59-097RESOLUTION NO. 59-97 AUTHORIZING CONDE~NATION OF CERTAIN REAL PROPERTY FOR THE WIDENING OF SEVENTEENTH STREET ON THE SOUTH SIDE, EAST OF TUSTIN AVENUE WHEREAS, Seventeenth Street as it now exists is inadequate in width for the present smd future demands of traffic thereon; NOW, THEREFORE, BE IT EESOLVED: That the City Council of the City of Santa Ana hereby finds, declares and orders: 1. That the public interest and necessity require the ac- quision of m easement for street right of way purposes across the real property hereinbelow described. 2. That said proposed improvement is located and planned in a manner which will be most compatible with the greatest public good and the least private injury. 3- That an action in eminent domain be filed to take and acquire an easement for said purposes and for all the purposes of a public street on, over sad through that certain real property in the City of Smta Ana, County of Orange, State of California, described as follows: Parcel 1. The Northerly 52 feet of the North half of the ~est l0 acres of Lot ~ of "Felipe Yorba Tract", as shown on a map thereof recorded in book 4, page 206, Miscellan- eous Records of Los Angeles County, California; EXCEPTING the Easterly 87.33 feet; EXCEPTING the Westerly 197 feet; EXCEPTING that portion previously granted for street pur- poses. Parcel 2. The Northerly 4© feet of the ~esterly 197 feet of Lot ~ of "Felipe Yorba Tract" as shown on a map thereof recorded in book 4, page 206, ~¥;iscellmeous Records of Los ~ngeles County, C~ ifornia; EXCEPTING therefrom that portion previously granted for street purposes. BE IT FURTHER RESOI~fED: That public interest, necessity, and convenience require and it is hereby ordered that the City of Santa Ama, a municipal Corporation, take immediate possession and use of the property herein ordered to be acquired upon complying ~th the re:~uirements of law applicable thereto, and to make deposit of money by way of security as the Court may direct for said purpose. BE IT ~JRTHER RESOLVED: That said action is taken in accord- ance with t~e Code of Civil Procedure and the Constitution of the State of California relating to eminent domain.
