HomeMy WebLinkAbout1932 (#2326-2347)RESOLUTION NO. 2326 WHEREAS, the City Council of the City of Orange hss filed with the Board of Supervisors of the Co~znty of Orange, State of California, a petition for the extension of Glassell Street from Fairhaven Avenue in the City of Orange to Grand A¥cnue at Santa Clara Street in the City of Ssnta Aha; and ~EREAS, the City Council of the City of Santa Aha· cooperating with the City of Orange and believing that said improvement is necessary and convenient for the travelling nublic going between the cities of Santa Aha and Orange: NOW, THEREFORE, be it resolved that the City Council of the City of Santa Ama hereby endorees the opening and extension of said Glassell S~reet as aforesaid, and respectfully urges that the Board of Supervisors of the County of Orange act favorably upon said petition. Ve~el~ Clerk of the City of Santa Ana. 55 RESOLUTION NO. 2333 A RESOLUTION ORDERING THE STREET SUPERINTENDENT TO ABATE THE PUBLIC NUISANCE HERETOFORE DECLARED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, TO EXIST IN THE CITY OF SANTA ANA, TO-WIT: WEEDS WHICH BEAR SEHDS OF A WINGY OR DOWNY NATURE AND ATTAIN SUCH A ~iRGE GRO~VTH AS TO BECOME A FIRE MENACE WHEN DRY AND WHIOH ARE NOXIOUS AND DANGEROUS, GROWING UPON CERTAIN STREETS, SIDEWALKS AND PRIVATE PROPERTY IN THE CITY OF SANTA ANA, BY HAVING THE WEEDS REFERRED TO REMOVED. The City Council of the City of Santa Ana resolves as follows: Section 1. Puralxant to provisions of an Act of the Legislature of the State of California, entitled "An Act Authorizing Municipalities to Declare Noxiou~ or Dangerous Weeds Growing upon the Streets or Sidewalks or Private Property with- in Municipalities to be a Public Nuisance, creating a Lien upon the Property Fronting upon such Streets or Sidewalks or upon which such Nuisance Exists for the Cost of Abating the same", approved May 26, 191§, and amendments thereto, the City Council of the City of Santa Ana, having acquired Jurisdiction so to do, hereby orders the Street Superintendent of said City to abate the public nuisance heretofore declared to exist i~ said City of Santa Aha, to-wit: Weeds which bea~ seeds of a wingy or downy nature and attain such a large growth as to become a fire menace when dry and which are nOXious a~d dangerous, growing upon the streets or sidewalks in front or upon private property, described as follows, to-wit: (See Weed File for Description of Properties) ~ Section 2. Any property owner shall have the right to have any of said weeds removed at his own expense, providing the same is done prior to the arrival ~of the Street Superintendent or his representatives to do the same. Section 3. The Street ~uperintendent shall keep an account of the cost of abating such nuisance in front of or on each separate lot or parcel of land where the work is done by him or his deputies, and shall render an itemized report in writing, to the City Council of the City of Santa Ana, showing the cost of removing such weeds on each separate lot, or in front thereof, or both; provided that before said report is submitted to said City Council, a copy of the same shal be posted for at least three days prior thereto, on or near the Chamber Door of said City Council, together with a notice of the time when said report shall be submitted to the City Council for confirmation. At the time fixed for receiving and considering said report, the City Council shall hear the same, together with any objections which may be raised by any of the property owners liable to be assessed for the work of abating said nuisance, and thereupon make such modificati. in the report as they deem necessary, afSer which said report shall be confirmed. AWARD NO. 2334 WHEREAS, the City Council of the City of Santa Ana, did in open session, at an adjourned regular meeting thereof, on the 23rd day of Nay, 1932, publicly open, examine and declare all sealed bids for the drilling of a water well located in the 600 block on North Olive Street, Santa Ana, California, pursuant to Notice Inviting sealed bi~s thereon. RESOLVED, that the City Council hereby rejects all of said bids, excepting the next herein mentioned, and hereby awards the contract for the drill- ing of said water well to the lowest responsible bidder, to-wit: Walter O. Hill, for the amount named in the bid, as follows, to-wit: Nineteen Hundred Ninety-th~e~ and no/lO0 ($1,1993.00). That the City Engineer is hereby authorized and directed to enter into a contract with Walter O. WHEREAS, the City Council of the City of Santa Aha did, on the 3rd day of August, 1931, pass Resolution of Intention No. 2316, for the paving and other- wise improving of portions of Seventeenth Street, Main Street, Broadway~ Durant Street, Ross Street, Greenleaf Street, Flower Street, Eucalyptus Street, Eighteenth Street, Nineteenth Street and a certain alley adjoining Lot 16, of NcIlwaints Sub- division, which subdivision is recorded in Book 4, page 76, Miscellaneous Naps~ Records of Orange County, California; WHEREAS, on the 18th day of Nay, 1932, the Superintendent of Streets of said City filed an assessment to cover the sum due for the work performed and specified in the contract made unde~ proceedings for the said improvement, which assessment and diagram was approved by the City Council of said City on the 4th day of April, 1932; and WHEREAS, the Clerk of the City of Santa Aha has given notice as required by law, in which notice June 6, 1932, at the hour of 7:30 P.M. was fixed as'the time, and the Council Chamber o£ the City Hall of said City es the place where any end all persons interested in the said work might be heard; and WHEREAS, no person aggrieved has filed with the City Council a written objection to said assessment as required by law; and WHEREAS, at the time set for hearing protests or objections the City Council of said City proceeded to hear the same, and all of said protests or object ions to said assessment or the work done having been heard; IT IS HEREBY RESOLVA~ by ~he City Council of the City of Santa Ana that all of the said protests or objections against s~id assessment or the work done under said proceedings be, and the same are hereby overruled and denied and the assessment be affirmed, and that the Street Superintendent be, and he is hereby directed to attach to said assessment a warrant in the form and maoner required by /aw, and shall record the same in the office of said Superintendent of Streets. NO. 2337 WHEREAS, the City Council of the city of Santa Ana did, on the ~lst day of March, 1932, paws Resolution No. 2331 determining and declaring that weeds which bear seeds of a wingy or downy nature and which attain such a large growth as to become a fire menace when dry and which are noxious and dangerous, were growing upon the streets~ sidewalks and private property in the City of Santa Ana, described in the itemized report submitted herewith, and are a public nuisance; and WHEREAS, on the 25th day of April, 1932, the City Council further passed Resolution No. 2334, ordering the Street Superintendent of said City to abate such public nuisance; and WHEREAS, in pursuance to the above numbered Resolutions, the Street Superinten, ent did abate such nuisance and kept an itemized account and report of the costs and expenses thereof; and ~EREAS, the said Street Superintendent has given notice as required by law, in which notice Tuesday, July 5th, 1932, at the hour of 7:30 P.M. was fixed as the time, and the Council Chamber of the City Hall of said City as the place, where any and all persons interested in the said report might be~heard; and WHEREAS, at the time set the Street Superintendent submitted the said report, and all of said protests or objections to said report having been heard~ IT IS HEREBY RESOLVED by the City Council of the City of Santa Ana that all of said protests or objections to the said report of the work done, be and the same are hereby overruled and the report affirmed, and that the Street Superintendent be, and he is hereby directed to file a copy of said report with the Tax Collector. That bond in the penal sum of One Thousand Dollars ($1,000.00 which has been filed with said City Council by Southern California Telephone Company, a corporation, which bond runs in favor of and to said City of Santa Ana~ California, and is conditioned that the said Southern Ca3ifornia Telephone Company a corporation, shall well and truly observe, fulfill and perform each, every and all of the terms and conditions of the telephone and telegraph franchise which was awarded to it by this City Council pursuant to law upon its bid therefor, which was the highest bid, on the 29th day of August, 1932, is hereby accepted, approved and ordered filed with the City Clerk of said City of Santa Ana. RESOLUTION ORDERING I~."iPROVEMENT NO. 23~5 WHEREAS, the City Council of the City of Santa Ana on the 8th day of August, 1932, passed its Res61ution of Intention No. 2341 to order the hereinafter described improvement to be made and public work to be done in the City of Santa Aha; and WHEREAS, after the passage and adoption of Resolution of Intention No. 2341, the Street Superintendent of the City of Santa Ana conspicuously posted along the line of the contemplated work and improvement at not more than three hundred (J00) feet in distance apart and 8 in all, notices of the passage of said Resolution of Intention, headed, NOTICE OF PUBLIC WORK, in the manner, form and substance as required by law, and said Street Superintendent also caused a notice similar in substance to be published for a period of ten (10) days in the Santa Ana Daily Evening Register, a daily newspaper pub- lished and circulated in the City of Santa Ana, and named by said City Council in said Resolution of Intention as the paper in which said notice should appear, all as appears from the affidavit of W. Lee Millis, principal Clerk of the printers and publishers of said daily newspaper, and which affidavit was filed in the office of the Clerk of the City of Santa Ana on the 28th day of August, 19~2, and is now on file therein; and WHEREAS, the Street Superintendent of the City of Santa Ana, co~nenced the posting of the notices hereinbefore referred to on the 15th day of August, 1982, and fully completed the posting thereof on the 1Sth day of August, 1932, as appears from the affidavit of DeWitt Dudley, Street Superintendent of the City of Santa Ana, and more than ten (10) days having expired after the expiration of the time of the publication of said notice within which protests or objections to the proposed work or improvement ~might be made by any person interested objecting to said work or improvement, or to the extent of the district or lands to be affected or benefited by said work or improvement and to be assessed to pay the costs and expenses thereof; and WHEREAS, at the next meeting of the City Council after the expiration of said ten days after the expiration of the time of the publication of said notice, and no objection to said work or improvement having been made or on file, why said proposed improvement should not be carried out in accordance with said Hesolutton of Intention, the City Council of the City of Santa Ana having now acquired jurisdiction to order the proposed improvement: IT IS HEREBY RESOLVED AND ORDERED that the public interest and ~nvenience requires the wort hereinafter described and the City Council of the City of Santa Ana hereby orders the following work to be done and improvement made in the City of Santa An: as follows: That the following portion of West Walnut Street and the following portion of West Pine Street be closed up and abandoned, to-wit: That portion of Walnut Street, as shown on Map of Tract No. 810, recorded in Book 19, page 12 of Miscellaneous Naps, Records of Orange County, California, lying between the Westerly line of Baker Street and Easterly of a line drawn from the Southeasterly corner of Lot Seventeen (17) in Block "A" to the Northeasterly corner of Lot Twelve (12) in Block "B" of said Tract No. 810; and that portion of Pine Street lying between the Westerly line of Baker Street and Easterly of a li~e drawn from the Southeasterly corner of Lot Seventeen (17) in Block "B" to the Northeasterly corner of Lot Twelve (12) in Block "C" of said Tract No. 610. The public work ordered and the improvement to be made is for the purpose of closing up and abandoning a portion of Walnut Street and a portion of Pine Street, as hereinbefore described, and for that reason no district is chargeable therewith. All of the herein proposed work shall be done in pursu~nce of~an Act of the Legislature of the State of California, designated "Street Opening Act of 1889", and amendments thereto. Vesely Cler'k of the City of 'Santa Ana. 2 RESOLUTION NO. 2846 WHEREAS, it is evident that municipalities within the State of California have not received a fair proportion of the motor tax funds with which to constr~ct and maintaim streets and highways required by increasing automobile traffic, and WHEREAS, a more equitable distribution of said funds is necessary and desirable, BE IT THEREFORE RESOLVED THAT the City of Santa Ana go on record aa favoring the following: 1. The apportionment to each county as heretofore of one-third of the total proceeds of the existing three cent motor fuel tax; however, the amount acc~aing directl from the tax on the sale of gasoline shall be apportioned amongst the cities of said county and the unincorporated areas of said county on the basis of registration of motor vehicles. Of said apportionment, three-fourths of the amount resulting from city registration shall be paid to the cities; the remaining one-fourth resulting from city registration, together with all revenue r~sulting from rural registration and all receipt for license plates, etc., shall be paid into the county treasury. The same restrictiom on expenditures shall be made for the cities as now exists for the counties, with the further provision that all such funds shall be expended only according to a financial plan in each case which shall be bamed upon a competent physical plan, including a classification of existing traffic routes and proposed alterations therein and extensions thereto. 2. Nothing in the resolution shall be construed to limit the existing authorit of counties to meot needs within incorporated cities. Y RESOLUTION NO. 2347 THAT WHEREAS, the City of Santa Ana has acquired the real property hereinafter described, and has erected upon said property a public building known as "The Charles W. Bowers Museum"; and WHEREAS, the real property and the building situated thereon are devoted ~ntirely to public use; and WHEREAS, before the first of March of this year, the City of Santa Aha he actually taken steps to acquire said real property, but was prevented from taking title thereto by reason of the Trust concerning said real property; and WHEREAS, the City of Santa Ana feels that the real property hereinafter described and the buildings situated thereon should be exempt from taxation by reason of ~he fact that they are devoted entirely to public use: NOW, THEREFORE, BE IT RESOLVED, that the City of Santa Ana request the Board of Supervisors of the County of Orange to cancel the County taxes now levied and assessed against said property.
