RESOLUTION NO. 59-252 INITIATING PROCEEDINGS FOR THE AiYNEXATION OF TE--~Y TO THE CITY CF SANTA ANA, DESIG- NATti~G "TUSTIN AND SEVENTEENTH N. E. ANNEX" AS AN APPRO- PRIATE NAME AND GIVIi~G NOTICE OF TIME A~) PLACE OF HEARING PROTESTS THERETO WHEREAS, at the request of property owners in the territory hereinbelow described, a map and description were presented and were approved by the Santa Aha Planning Co_uzmission and the Boundary Com- mission of Orange County, California; NOW, THEREFORE, BE IT ~SOLVED: That the City Council of the City of Santa Aha hereby initiates proceedings for the mnexation of the real property described herein to said City for the following reasons: · 1. That said area is rapidly developing with the constr~c- tion of residenti~ and comEercial buildings and has a present ~d increasing need and effective demand for sewerage facilities, con- nections with trunk lines to dispose of the increasing sewage pro- duced in the area. 2. That said area has a ~esent and increasing demand for municipal services, and th~ property values in the area ~ould be increased, stabilized and maintained by the availability of high- grade municipal services. 3- That the area can best be served by the City of Santa Aha with municipal services of the highest caliber anywhere obtain- able, and that there is at this time no other government ageney or city that can provide connections for the disposal of the rapidly increasing volume of sewage produced in the area. 4. That said territory would receive the greatest economic benefit by becoming a part of the City of Santa Ana, an established and stable City~ that has consistently cut its City advalorem tax rate during the critical eight-year period just passed, when prac- tically all other agencies, districts and governmental units were raising such tax rates. BE IT FJRTHER RESOLVED: That the City Council hereby declares its intention to annex all of the territory hereinbelow described under the provisions of the Annexation of Uninhabited Territory Act of 1939, and hereby finds and declares that said territory is un- inhabited within the meaning of "uninhabited" as defined in Govern- ment Code Section 35303, on the date of the adoption of this Reso- lution; that said territory is contiguous to the City of Santa Ana, lies in the County of 0range~ State of California, and is described as: Beginning at the point of intersection of the north line of Seventeenth Street which is parallel with and 40.00 feet northerly measured at right angles frcE the center line of Seventeenth Street with the West line of 01d Tustin Avenue, 60.00 feet wide, said point being an angle point in the present city boundary of the City of Santa Aha, Califor- nia, and running thence north along said City boundary 621.32 feet; thence continuing north, departing from said City bound- ary, along the west line of 01d Tustin Avenue to the inter- section of said west line with the westerly extension of the north line of Tract Number 2~93, as ~ahow~ on a map thereof recorded in Book 113, pages ~5 and 36, ~ilscellaneous Maps, Records of Orange County, California; thence easterly along said north line and its extension to the east line of Ponderosa Street, 50 feet wide, thence southerly along said east line of Ponderosa Street to the north line of Lot 9, in Tract No. 1031 as shown on a map thereof recorded in Book 33, page 43, Miscellaneous Maps, Records of Orange County; thence easter- ly along said north line of Lot 9 to the northeast corner of said Lot 9; thence southerly along the east line of Lots 9 and 8 in said Tract No. lO31, 33?.36 feet; thence easterly parallel with the South line of Lot 5 in said Tract No. 1031, l0 feet; thence southerly along a line parsllel with and l0 feet easterly, measured at right angles, from the east line of Lots 8 and 7 in said Tract No. 1031, 196.00 feet; thence easterly along a straight line parallel with the south line of Lot 4 in Tract No. 1031 to the east line of Deodar Street, 64.00 feet wide; thence northerly along said east line 21 feet; thence easterly along a line parallel with the north line of Lot I in said Tract No. lO31, to a point on said par- al lel line which is 8' westerly, measured along said paral- lel, from the east line of said Lot l; thence northeasterly in a straight line 141.88 feet to a point on the east line of Lot 2 in said Tract No. 1031, whici~ is 44.74 feet northerly from the southeast corner of said Lot 2; thence northerly along the East line of Lots 2 and 3 in said Tract No. 1031; thence northerly along the west line of Lot 14, Block B, of the A. B. Chapman Tract as surveyed by LECOUVREUR in 1870 and filed for record in Los Angeles County, California, to the northwest corner of said Lot 14; thence easterly along the north line of said Lot 14, to the northeast corner of the west one-half of said Lot 14; thence southerly along the east line and its extension of said west one-half of Lot 14 to a line parallel with and 25.00 feet southerly, measured at right angles, from the centerline of Seventeenth Street; thence easterly along said parallel line to a point 622.38 feet easterly, measured along said parallel line, from the westerly line of the first tract allotted to TEODOCIO YORBA by Decree in Partition of the Rancho Santiago de Santa Ana, in the suit of Abel Stearns and others versus LEONARDO COTA and others; thence southerly parallel with said west line 1019.27 feet; thence westerly parallel with said center line of Seventeenth Street 622.38 feet; then northerly along said west line to the southeast corner of Lot 2 of the VICENTE YORBA TRACT as shown on a map thereof recorded in Book 2, Page 14 of Niscellaneous Naps, Records of Orange County; thence westerly along the south line of Lots I and 2 and their exten- sion of said VICENTE YORBA TRACT to the west line of YORBA Street, 4© feet wide, and to the City boundary of the City of Santa Ana; thence northerly along said City boundary and along said west line of YORBA Street to a tine parallel with and 52.00 feet southerly, measured at right angles, from said centerline of Seventeenth Street and to an angle point in said city boundary; thence westerly along said parallel line and along said City boundary to the west line of the east half of Lot 5 of the FELIPE YORBA TRACT, as shown on a map thereof recorded in Book 4, Page 206, Niscellaneous Records of Los Angeles County and to m~ angle point in said City boundary; thence northerly along said west line and its ex- tension and along said City boundary to a line parat lel with and 25.00 feet northerly, measured at right angles, from said center line at Seventeenth Street and to an angle point in said City boundary; thence westerly along said parallel line and along said City boundar~ to the east line of the new alignment of Tustin Avenue ~0.00 feet wide as it exists im- mediately north of said Seventeenth Street and to an a~q~le point in said City boundary; thence Northerly along said east line of Tustin Avenue and along said city boundary ~ its intersection with a line p~rallel with sad 40 feet north- erly, measured at right angles, from said centerline of Seventeenth Street and to ~ angle point in said City boundary; thence westerly along said parallel line and al ong said City boundary to the west line of 01d Tustin Avenue 60.00 feet wide and to an angle point in said City boundary and to the point of beginning. BE IT FURTHER RESOLVED: That "Tustin and Seventeenth N. E. Annex" is hereby designated as an appropriate name for said terri- tory for the purpose of this annexation. BE IT FURTHER RESOLVED THAT NOTICE IS HEREBY GIV~: That November 2nd, 1959, at the hour of ?:30 P.M. in the Council Chambers, City Hall, ~rd and ~ain Streets, Santa Ana, Cd ifornia, is the time and place fixed at which said Council will hear protests against this annexation made by any person owning real property within the said territory. At any time before said hour any such person who desires to protest must file written notice against said annexation. The statute requires that such protest must state the owner's name and the description and area of the property owned by him in gen- eral terms.
