RESOLUTION NO. 2510 RESOLUTION ACCEPTING D~ED FRON COU~ITY OF ORANGE FOR PARK AND PLAYGROUND PURPOSES BE IT RESOLVED BY THE CITY COUNCIL OF THE CI~I~Z OF S~TA ANA, AS FOLLOV~: That that certain deed, dated the E6th day of Jau~ary, 1937, executed by the County of Orange to the City of Santa Ana, pursuant to Resolution of the Board of Supervisors duly made and seconded on the 29th day of September, 1938, conveying certain property therein described to this City be and the Same is hereby accepted and this City hereby agrees to the terms and conditions thereof therein set forth. Layton, officio Council ~ta Ana, RESOLUTION NO. 2511 RESOLUTION CONCERNING PARIT[NG LIMITATIONS UNDER ORDINANCE NO. 1030. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, AS FOLLOWB WHEREAS, by Resolution No. 2484 of the City Council of the City of Santa Ana, dated the 5th day of October, 1936, pursuant to the provisions of the Vehicle Code of the State of California, and pursuant to the provisions of Ordinance No. 1030 of the City of Santa Ana, entitled "An Ordinance Regulating th. Use of Public Highways within said City", adopted April 6th, 1936, the City Councl did declare that the following curbs along the public highways in the City of Santa Ana shall be painted Red as provided in Subdivision ~(e) of Section 9 of sai~ Ordinance No. 1030, and the City Engineer was thereby directed to cause said curb to be painted as above described on the following curbs, to-wit: MAIN STREET On the East side between Sixth and Seventh Streets, located as follows: The South 32 feet ~of the North 180 feet. The South 12 feet. AND, WHEREAS, it is the desire of this Council to abandon such no park- ing zone; NOW, THEREFORE, ing zone be and the ssane be it resolved that a portion of the foregoing no park- is hereby eliminated, and the City Engineer is hereby directed to cause the paint on said curbs to be removed or covered, as follows: The South 5 feet of the North 180 feet. BE IT FURTHER RESOE~VED that pursuant to said Ordinance ~o. 1030, the following curbs along the public highways in the City of Santa Aha shall be painte Green, and shall bear a legend in white letters thereon indicating that the maximum time limit for parking shall be twenty (20) minutes as provided in Sub- division (f) of Section 9 of said Ordinance No. 1030, and the City Engineer is hereby directed to cause said curb to be painted as above described on the follow- ing curbs, to-wit: MAIN STREET On the East side between Sixth and Seventh Streets, located as follows: The South 34 feet of the North 244 feet. RESOLUTION NO. 2515 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DECLARING ITS INTENTION TO ORDER THE ABANDONMENT OF A PORTION OF A CERTAIN STREET KNOWN AS SANTA ANA BOULEVARD WITHIN SAID CITY, WHICH PORTION OF SAID STREET IS DESCRIBED AS BEING A CERTAIN PORTION OF THE PROPERTY OVER V~tlCH TH~HE EXISTS AN EASEMENT FOR SLOPE 'AND/OR REVET~NT WORK AND D~CLARING IT TO BE FOR THE PUBLIC INTEREST AND CONVENIENCE, AND FIXING THE TI~.~ AND PLACE FOR P~ARING OBJECTIONS TO SAID PROPOSED IMPROVEMENT. SECTION 2: That the said City Council of the City of Santa Ana does hereby further resolve and declare that the lots, lands and premises to be affected by the closing up and abandonment of said easements for said slopes and revetments in said street~ and benefitted by said improvement are described as being that certain real property situate in the City of santa Ana, County of Orange, ~tate of California, described as follows, to-wit: Beginning at the Northeast corner of Block "C"~ Tract No. 512, as per map thereof recorded in Book 19, Page 16, of Miscellaneous Maps, Records of Orange County, California; thence South to an intersection with the South line of Lot 27, Potts, Borden and Sidwell Trhct, as per map thereof recorded in Book 4~ Page 624 of Miscellaneous Records of Los Angeles County, California; thence Westerly along the Southerly line of said Lot 27 to an inter- section with the Northeasterly right of way line of Santa Ana Boulevard; thence Northwesterly along said right of way line to an intersection with the Southerly line of Roe Drive; thence Easterly along the Southerly line of Roe Drive to the point of beginning. That the public work herein provided for is the closing up and abandon- ment of that portion of Santa Aha Boulevard and its slopes and revetments describ~ in Section 1 of this Resolution, and it appearing to the City CoUncil that there will be no costs, damages or expenses occasioned thereby or arising out of said work and improvement, no assessment is intended to be made upon any of said property in said district. SECTION 3: That the proceedings for the closing up of the aforesaid street shall be had and taken under snd in accordance with an Act of the Legislat~ of the State of California, designated and known as "An Act to Provide for Laying Out, Opening, Extending, Widening, Straightening or Closing up in Whole or in Part of any Street, Square, Lane, Alley, Court or Place within Municipalities, to condemn and Acquire any and all Land and Property Necessary or Convenient for that Purpose," approved March 6th, 1889, and amendments ~hereto. SEC~ION 4: That the Street Superintendent shall cause to be conspicuous~ ~posted along the line of said contemplated work and improvement, and at nor more than three hundred feet in distance apart, but not less than three in all, notices of the passage of this resolution, in the foEn and manner as required by law; aud he shall also cause a notice similar in substance to be published for a period of ten (10) days in the Orange County Reporter, a daily newspaper, published and circulated ~nd of general circulation in the City of Santa Ana, California~, and hereby designated for tha purpose by the City Council, containing a statement of the fact of the passage of this resolution of intention, the date thereof, and briefly describing the work or improvement proposed, and referring to this resolution for further particulars? SEC.TION 5: That any person interested, objecting to said work or improve- ment, or to the extent of the district or lands to be affected or benefitted by slid work and improvement a~d liable to be assessed to pay the costs and expenses thereof, may make written objections to the same, within ten (10) days after the expiration of the time of the publication of said notices, which objections shall be delivered to the Clerk of the City Council of the City of Santa Ana. SECTION 3: The StrDet Superintendent shall keep an account of the cost of abating said nuisance in front of or on each separate lot or parcel of land where the work is done by him or his deputies, and shall render an itemized report, in writing to the City Council of the City of Santa Aha showing the cost of removing such weeds on each separate lot, or in front thereof, or both, pro- vided, that before said report is submitted to said City Council, a copy of the same shall be posted for at least three days prior t'heroto, on or near the Chambe~ Door of said City Council, together with a notice of the time when said report shall be submitted to the City Council for confirmation. At the time fixed for receiving and considering said report, the City Council shall hear ~he same, together with any objections which may be raised by any of the property o~ners liable to be assessed for the work of abating said nuisance and thereupon make such modificstions in the report as they deem necessary, after which said report shall be confirmed. The amounts of the cost for abating such nuisance in front of or upon the various parcels of land mentioned in said report shall constitute special assessments against the respective parcels of land, and, as is made and confirmed, shall constitute a lien on said property for the amount of such assess- ments, respectively, and thereafter said amounts shall be collected at the same time and in the same manner as ordinary municipal taxes are collected and shall ne subject to the same penalties and the same procedure under foreclosure and s~le in case of delinquency as provided for ordinary municipal taxes. KELLOGG THE COUNCIL OF THE CITY OF SANTA AMA DO RESOLVE AS FOLLOWS: WHEREAS, the City of Santa Aha is desirous of acquiring certain property along the bed of the Santiago Creek, which said property belongs to M. R. Kellogg, and VU~rEREAS, said M. R. Kellogg has agreed to convey said property to the City of Santa Ana in exchange for a small portion of Lot 2 in Block "D" of Tract #512 in the City of Santa Ana, as shown on a map recorded in Book 19, page 18, of Miscellaneous Maps, Records of Orange County, California, which said property consists of an irregular-shaped piece of property lying adjacent to other property owned by said M. R. Kellogg, and is of purely nominal value when separated from the property belong- ing to said M. R. Kellogg, and which said property is further described as follows: Beginning at the Northeasterly corner of said Lot 2, thence South 0° 4§' West along the Easterly line of said Lot 2, 43.86 feet to an intersection with the Northeasterly right or w~ line of Santa Ana Boulevard; thence Northwesterly along the Northeasterly right of way line of Santa Ana Boulevard (said northeasterly~right of way line being a 19' 52" curve concave to the Southwest) a distance of 16.39 feet to the point of reverse curve, with a curve concave to the East whose radius is 20 ~eet and having a central angle of 104o 46' 44", thence NorthweSterly, Northerly and Northeasterly along said curve ~6.57 feet to its point of tangency with the Northwesterly line of said Lot 2, said point of tangency being South 70o 17! BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA: WHEREAS, the City Council of the City of Santa Aha did, on the 15th day of March, 1937, pass Resolution No. 2516, deteEnining ~nd declaring that weeds which bear seeds of a wingy or downy nature and which attain such a large growth as to become a fire menace when dry and which are noxious and dangerous, were growing upon the streets sidewalks and private property in the City of Santa Ana, described in the itemized report submitted herewith; and WHEREAS, on the 19th day of April, 1937, the City Council further passed Resolution No. 9591, ordering the Street Superintendent of said City to abate such public nuisance; and WHEREAS, in pursuance to the' above numbered Resolutions, the Street Super- intendent did abate such nuisance and kept an itemized account and report of the costs and expenses thereof; and WHEREAS, the Street Superintendent has given notice as required by law, in which notice the 6th day of July, 1937, at the hour of 7:30 o'clock P.M., was fixed as the time, and the Counci$ Chamber of the City Hall of said City as the place, where any and all persons interested in the said report might be heard; and WHEREAS, at the time set the Street Superintendent submitted the said report and all of said protests or objections to said report having been heard; IT IS HERE~Y RESOLVED by the City Council of the City of Santa Ana that all of said protests or objections to the said report of the work done, be and the same are hereby overruled and the report affirmed, and that the Street Superintendent be, and he is hereby directed to file a copy of said report with the Tax Collector. The Council of the City of Santa Aha resolve as follows: WHEREAS, for several years mast past the Board of Supervisors of the County of Orange has allocated to the several cities in this County for the benefit of Street Improvement Districts for paying for streets of general use a certain portion of the "Highway Fund" of said County as received by it through the State of California, from the receipts from the sale of motor vehicle fuel in this State~ and WHEREAS, this Council is advised that for the fiscal year 1937-1938 the said Board of Supervisors intends to discontinue such allocations to this City for the benefit of the Street Improvement Districts created to pay the cost of improvement of streets in this City which are of more than local importance or use, and WHEREAS, the reason assigned by said Supervisors for such discontinuance is the necessity for increasing their tax rates to meet other obligations not connected with Street Improvements, AND WHEREAS, such discontinuance will require an increase in the tax rate to be levied by this Board and will cause the expense of the othe~ obligations so paid by the Board of Supervisors to be actually, though indirectly, met and paid by the taxpayers within the incorporated area of this City, NOW, THEREFORE, we hereby respectfully protest against such discontinuance and request that such special obligations to be paid by the Board of Supervisors be met by a general increase, if necessary, in the general tax rates over the entire County, including both that which is within and that which is outside of incorporated cities, thus distributing the cost thereof equally over all the County instead of placing the entire cost upon property within the Cities thereof. SECTION 12: LEAVE OF ABSENCE Any member who is called or volunteers to serv§ in any branch of the service of the United States shall, upon his return, and with an honorable discharge, maintain his priority rights within this ordinance, provided, however, that he shall make application for reinstatement within ninety (90) days after discharge from the service of the United States. Leave of absence for any purpose may be taken by written consent of the Civil Service Board, and temporary appointments may be made to fill such vacancies in the manner herein provided for permanent appointments. SECTION 13: REDUCTION, SUSPENSION AND DISCHARGE (a) No person in the Classified Civil Service shall be removed or discharged from his position or reduced in rank except for inett~ciency, misconduct or insubordination. Whenever the Chief of any department under Civil Service shall detern~ne that discharge, reduction in rank or disciplinary action should be taken against any member of his department, and if he determines that such member should be discharged, he may suspend such member from active duty, and shall, upon so determining or upon so suspending any member, immediately file charges with the Civil Service Board, setting forth in detail the grounds for such suspension, disciplinary action or reduction in rank or position, together with his recommendation thereon. Such charges shall be in writing and a copy thereof served upon the member so charged. Such member so charged shall have the right to file an answer to such charges within five (5) days from the date of service upon him of a copy thereof, which answer shall be filed with the Civil Service Board, and with the Chief who filed such charges. The Civil Service Board shall thereupon set said matter for hearing not leas than five nor more than ten days after the filing of the answer to the charge. If the member who is charged by the Chief of his department fails to file an answer within five days to the charges filed by the Chief of the depart- ment, the charges shall be deemed to be admitted, and the recommendation of the Chief accompanying such charges shall take effect, and the suspension of such member shall become a permanent discharge us of the date of the original suspension. If the member so charged files an answer within the five days, then the Civil Service Board shall convene as a "Trial Board" as provided in Section 8 thereof, and shall inquire into the charges made by the Chief of the de- partment, and may make such inquiry in such a manner as it deems best by ex parte investigation by the Board or any committee thereo~, but said Board shall hold a meeting as herein above provided, at which time such mem- bet so charged and the Chief of the department shall be permitted to make such showing as they may desire be- fore said trial hoard. The member so charged and the Chief of the Department, may, at the hearing of such charges, be repre- sented by counsel, and shall have the right to produce such witnesses as he may desire to testify in his behalf. The Chairman of the Board shall have the right to issue subpoenas and compel the attendance of witnesses. After such hearing the trial board shall determine whether or not such charges or any part thereof are true, and if they determine that none of the charges are true, the said member shall be reinsatted and rstored to duty, and shall be entitled to receive compensation during the period of his suspension, and pending such hear. ing and reinstatement. If the Trial Board shall determine that such charges or any of them are true, they shall make their findings in accordance therewith, and shall recommend such disciplinary action as they may deem proper under the circumstances and findings. If such recommendations do not consist of a recommendation for discharge, the person charged and found guilty as herein provided, shall be privileged to accept such disciplinary action ss recommended by the Trial Board, but if such recommendation shall be presented to the City Council of the City of Santa Ana, and the City Council shall take such action in the matter us in the judgment of such City Council shall be proper and adequate under the findings of the Trial Board. If such recommendation of the trial board is for disciplinary action, and the person charged and found guilty does not acquiesce or consent thereto, then such recommendation shall be presented to the City Council for hteir action as provided in Section 8 hereof. Verified written charges may he filed by any qualified elector of the City of Santa Ana with the Chief of any department, under such rules and regulations as may be prescribed by the Civil Service Board, and the truth of such charges shall be determined by the Chief of the department, and if he deems it proper he may file charges with the Civil Service Board. (b) No member shall be dismissed because of the discontinuance of the particular office or position held by him, but employees dismissed because of curtailment of expenditures, reduction in force, and for like causes, shall be the last employee or employees, including temporary appointees, that have been appointed to the Fire Department or Police Department, as the case may be, until such reductions necessary shall have been accom. plisbed. Vacancies to be filled in the lowest rank, resulting from such removal, shall be filled from the last em- pioyee or employees that have been appointed to the nexthigher rank, and their places likewise filled until proper distribution has been accomplished; provided further, that in event the said department shall again be in- creased in numbers, the said men dismissed, or reduced in rank, under the terms of this section, shall have the privilege of being reinstated before any new appointments to said department shall be made. SECTION 30:AMENDMENTS OF THIS ORDINANCE The City Council may from time to time, by ordinance, add additional departments, appointive officers or employees of the City to the list originally designated in this ordinance creating a system of Civil Service. All these improvements were placed under the 1915 Bond Act, 1/10 maturing each year and collected with the general taxes. Tract No. 517 During 19~B this tract was included in the Southwest Sewer District under the 1915 Bond Act. The various parcels North of First Street, are all encumbered with 1915 Act Bonds, for Paving, Street Lights, etc. It has been necessary to levy annually a rate of ten cents per hundred, assessed value, on all property within the City Limits, to pay the amounts due under the various 1915 Act Bonds of the City of Santa Aha now in default. The successful working of this plan will place these 139 lots back on the assessment rolls of both the City and the County and should eliminate the ten cent levy now required to service the delinquent 1915 Act Bonds. This plan in general is as follows: (a) The City of Santa Ana will purchase from the County of Orange, under Section 3897d of the Political Code and amendments thereto, the tax title now held by the State of California, subject, however, to the approval of the State Controller. At this point the state tax title and the city tax lien will both be vested in the City of Santa Ans. (b) The City of Santa Aha will then offer to the record owner of each lot so purchased from the County, a small sum of money in cash for a quitclai~ deed to such lots. At this point the city will have a good and marketable title to any such lots for which it holds quitclaim deeds, thereupon the City will cancel all city taxes and penalties, to date, against such lots. (c) In part consideration for the above described quitclaim deeds, the City will in each case, where requested, execute an option in favor of the former owner This option will be for a limited period only (thirty days) and will provide that the City will reconvey to the former owner any grant deed, his lot, upon his payment in full covering all improvement bond assessments against such lots to date. (d) Under this pl~ any lots not redeemed prior to the expiration of said option, will be owned by the City of Santa Ana in fee, without the necessary litigation to clear up the title. (e) Where quitclaim deeds to the lots involved in this sale are not secured quickly and at a very small cost, the City will immediately institute a court action to quiet its t~tle to such lots as are secured under tax deed. (f) Upon the Court decree, granting title to the City (it is expected that most parties will default, by ~ail~ng to answer the city's complaint), the city will than hold good title and will then cancel all taxes and penalties outstanding against these l~ts and will then sell said lots to the best advantage of the city. (g) If it is found that some of these lots cannot be sold for the full amount of the improvement bonds outstanding against them, then it is the intention of the City of Santa Ana to make such sales at the best price obtainable on the present market, so as to get this property back on the assessment rolls. (h) It is not too early to start now to have this group of lots ready for sale to the public duriug the next spring and summer. Any and all lots to which the city has perfected its title, will be offered for sale in groups of fifty to one- hundred lots, for cash to the highest and best bidder. It is expected that a s~le in groups of around one-hundred lots will compel the successful bidder to support the real estate market. of 1935 Plan 6 Section 4 of Assembly Bill 1129, being Chapter No. 396 of the Statutes is pertinent to this plan and ~eads as follows: "The facts constituting such necessity are as follows: Due to the depression which has existed in the past several years many landowners have been unable to meet the taxes and assess- ments levied by the State, poliO%cai subdi~tsicns, agencies, reclamation, drainage and levee districts, with the result that their lands have been sold to the State and such taxing and assessing agencies. The heavy penalties assessed by law have made it impossible for the landowners to redeem their lands, hence thousands of acres of land (together with thousands of lots), have been sold for the non-payment of such taxes and assessments, and deeds have been executed thereon to the State and such taxing and assessing agencies. That as long as such lands (or lots) remain State lands, the same are non, assessable for tax or assessment purposes, and the tax ~ assessment burden becomes heavy upon the paying lands, causing more delinquencies and losses * * * The legislature hereby declares that the welfare of the State requires that such lands (or lots) be p~aced in prtvat~ ownership as promptly as possible so that such land (or lots) henceforth bear its Just proportion of current taxation and assessments." dated November 15th, 193V.~ Exhibit "A"
