RESOLUTION NO. 2548 RESOLUTION ABANDONING FREIGHT L~ADING ZO~S UNDER ORDINANCE NO. 103(~, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SANTA ANA, as follows: WHEREAS, by Resolution No. 2486 of the City Council of the City of Santa Aha, dated the 5th day of October, 1936, pursuant to the provisions of the Vehicle Code of the State of California, and pursuant to the provisions of Ordinance No. 1030 of the City of Santa Ana, entitled "An Ordinance Regulating the Use of Public Highways Within said City", adopted April 6, 1936, the City Council did declare that the following curbs along the public highways in the City of Santa Ana shall be painted yellow as provided in Subdivision "h" of Section 9 of said Ordinance No. 1030, and the City Engineer was thereby directed to cause said curb to be painted as above described on the following curbs, to-wit: BROADWAY On the East side between Church and Sixth Streets, located as follows: The Southerly 23 feet of the Northerly 148 feet. The Southerly 35 feet of the Northerly 218 feet. On the West side between Fourth and Third Streets, located as follows: The Southerly l0 feet of the Northerly 134 feet. SMCA~fORE STRET On the West side between Church and Sixth Streets, located as follows: The Southerly 30 feet of the Northerly 160 feet. The Southerly 32 feet of the Northerly 227 feet. RESOL~UTION NO. 2549 RESOLUTION CONCERNING TAX-IFEEDED LANDS AND REPI~C!NG SAZ~ ON TAX ROLLS WHEREAS, Section 3897d of the Political Code of the State of California, as amended, provides among other things, that whenever any property has been deeded for delinquent taxes and/or assessments to the State of California, and said property is subject to a llen which constitutes a deed, under sections 3897.3 and 3897d of the Political CSde, for delinquent taxes and/or assessments to any municipality, and such lien has been in existence for at least five years, the governing body of said municipality may enter into an agreement wi th the Board of Supervisors in the County in which said property is situated, subject to the approval of the State Controller, for the purchase of, or for the option to purchase the property so held by the State, or any part or parts thereof; and WHEREAS, all of the One~Huud~ed forty-six (146) lots or parcels of property hereinafter mentioned and described in Exhibit "A" hereto attached, are wholly within the City limits of the City of Sauta Ana, in the County of Orange, State of California, and are now delinquent for city taxes and for county taxes, or for public improvement assessm~ts of the City of Santa Ana, aud further, all of said lots or parcels of land hereafter described in Exhibit "A" aforesaid, have been deeded to the State of. California, for non-payment of County taxes, and are subject to a lien for delinquent taxes and/or assessments of the City of Santa Ana, which has been in existence for at least five years, and has not been paid; and which lien constitutes a deed for delinquent taxes within the meaning of Sections 3897d and 3897.3 of the Political Code, and WHEREAS, there has this day been presented to the City Council of the City of Santa Ana a plsn marked Exhibit "C" dated January 17, 1938, under which it is expected to return to the City tax rolls and to the County tax rolls all that certain real property situated in the City of Santa Ana, County of Orange, State of California, and being more particularly described and set forth in Exhibit "~" hereto attached and made a part hereof; and WHEREAS there has also been presented to the City Council of the City of Santa Aha, an ~greement, a copy of which is annexed and marked Exhibit "B", dated the 17th day of Jauuary, 1938, wherein the Board of Supervisors of the County of Orange, State of California, acting u~.der the authority granted to it by Section 3897d of the Political Code of the State of California, therein designated as the Seller, and the City Council of the City of Santa Aua, acting under the authority granted to it by Sections 3897d and 3897.3 of the Political Code of the State of California, is designated as the Buyer, wherein the said Buyer agrees, among other things, to purchase said delinquent tax lots heretofore mentioned and more particularly described in said agreement, for the sum of One Hundred Forty-six ($146.00) Dollars cash, lawful money of the United States of America, said agreement, however, to be subject to the approval of the State Controller of said State, and subject and pursuant in all respects to Sections 3897d and 3897.3 of the Political Code of the State of California. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Santa Ana approves the Plan No. 2, dated the 17th day of January, 1938, sub- mitted to it for the purpose of placing said delinquent tax property back on the tax rolls of the City of Santa Aua and the County of Orange, and orders the same to be attached to this Resolution and filed as a permanent record with the City Clerk of the City of Santa Ana, and BE IT FURTYER RESOLVED, that the City Council of the City of Santa Ana by reference thereto, makes said plan and the whole thereof, a part of this Resolution to the same extent and purpose as if the same were herein set out in full; and BE IT FURTHER RESOLVED, that the agreement heretofore mentioned be, and the same is hereby approved as written, and the Mayor of the City of Santa Ana, and the City Clerk of said City are hereby directed and authorized to sign and execute the same on behalf of the City of Santa Ana, and the Clerk is directed and instructed to deliver a duly executed copy thereof to the Seller therein named. Controller of the State of California By Deputy PLAN NO. ~ PLAN OF THE CITY OF SANTA ANA COVERING THE SECOND PURCHASE OF TAX DELINQUENT LOTS Plan of the City of Santa Ana, Orange County, California, to return to the City Tax rolls and to the County Tax Rolls, One Itundred forty-six (146) lots, all within the City limits of the said City of Santa Aha, and being the property as listed on Exhibit "A" as attached to a proposed agreement dated January 1Vth, 1938, between the Board of Supervisors of Orange County, California, and the City Council of said City of Santa Ana, California. At the present time all such lots or parcels of property as shown on said Exhibit "A" have been deeded to the State of California, and are at present completely off of the assessment rolls of the City of Santa Aha and the County of Orange, and will produce NO TAX revenue until some effective plan is worked out to get the taxes and asses sm~ent~'brought up to date and the property back into the hands of private owners, who will pay the current taxes and assessments as they bec~me due. The group of lots included in this plan ~re all located in Tract No, 597. This tract was subdivided in 1923 and only a small percentage of the lots sold under contract. During 1928 the sewers were placed in this tract under Improvement District No. 130, and in 1929 certain lots facing St. Gertrude Place were included in Improve- ment District No. 154 covering lights in the Southwest District. Both of these improvements were placed under th6 1915 Bond Act, 1/10 of such improvement bonds maturing each year and collected with the general taxes. Came the depression and nearly all the lots sold under contract defaulted. At present 146 lots of the 223 lots in the tract are deeded to the State of California for non-payment of taxes and assessments. It has been necesssry to levy annually a rate of ten cents per hundred, assessed value, on all property within the City limits, to pay the amounts due under the various 1915 Act Bonds of the City of Santa Ana now in default. The successful working of this plan will place these 148 lots back on the assessment rolls of both the City and the County and should help eliminate the ten cent levy now required to service the delinquent 1915 Act Bonds. e This plan in general is as follows: (a) The City of Santa Ana will purchase from the County of Orange, under Section 3897d of the Political Code and amendments ~ereto, the tax title now held by the State of California, subject, however, to the approval of the State Controller. At this point the state tax title and the city tax lien will both be vested in the Cit~ of Santa Ana. (b) The City of Santa Ana will then offer to the record owner of each lot so purchased from the County, a small sum of money in cash for a quitclaim deed to such lots. At this point the city will have a good and marketable title to any such lots for which it holds quitclaim deeds, thereupon the City will cancel all city ~axes and penalties, to date, against such lots. (c) In part consideration for the above described quitclaim deeds, the City will in each case, where requ&sted, execute an option in favor of the former owner. This option will be for a limited period only (thirty days) and will provide that the City will re-convey to the former owner any grant deed, his lot, upon his payment in Full covering all improvement bond assessments against such lots to date. (d) Under this plan any lots not redeemed prior to the expiration of said option, will be owned by the City of Sauta Ana in fee, without the necessary litigation to clear up the title. (e) Where quitclain deeds to the lots involved in this sale are not secured quickly and at a very small cost, the City will immediately institute a court action to quiet its title to such lots as are secured under tax deed. (f) Upon the COurt decree, granting title to ~he City (it is expected that most parties will default, by failing to answer the city's complaint), the city will then hold good title and will then cancel all taxes and penalties outstanding against these lots and will then sell said lots to the best advantage of the city. (g) If it is fouud that some of these lots cannot be sold for the full amount of the improvement bonds outstanding against them, then it is the intention of the City of Santa Aha to make such sales at the best price obtainable on the present market, so as to get this property back on the assessment rolls. (h) It is net too early to start now to have this group of lots ready for sale to the public during the next spring and sun~uer. Any and all lots to which the city has perfected its title, will be o~fered for sale in groups of fifty to one hundred lots, for cash to the highest and best bidder. It is expected that a sale in groups of around one hundred lots will compel the successful bidder to support the real estate market. Section 4 of Assembly Bill 1129, being Chapter No. 396 of the Statutes of 1935 is pertinent to this plan and reads as follows: "The facts constituting such necessity are as follows: Due to the depression which has existed in the past several years many landowners have been unable to Meet the taxes and assessments levied by the State, political subdivisions, agencies, reclamation, drainage and levee districts, with the result that their lands have been sold to the State and such taxing and assessing agencies. The heavy penalties assessed by law, have made it impossible for the landowners to redeem their lands, hence ~housands of acres of land (together with thousands of lots), have been sold for the non-payment of such taxes and assessments, and deeds have been executed thereon to the State and such taxing and assessing agencies. That as long as such lands (or lots) remain State lands, the same are non-assessable for tax or assessment purposes, and the tax and assess- ment burden becomes heavy upon the paying lands, causing more delinquencies and los sess The legislature hereby declares that the welfare of the State requires that such lands (or lots) be placed in p~ivate ov~ershi~ as promptly as possible so that such land (or lots) henceforth bear its Just proportion of current taxation and assessments." RESOLUTION NO. 2550 RESOLUTION FOR }~E-ALLOCATION OF FUNDS UNDER AGREE~.~NT BETWEL~ CITY OF SANTA ANA AND DEPARTMENT OF PUBLIC WORKS WHEREAS, the City of Santa Aua has heretofore entered into an agreement with the Department of Public Works of the State of California, acting through the Director of Public Works, governing the expenditure of one-quarter cent gas tax on streets of mayor importance; and Wt~REAS, under said agreement there is set up a project known as Project #15, which is entitled "Contingency Pro~ects", in which the sum of $3031.10 has been allocated to such project; and WHEREAS, money available under such contlngeucy project now appears to be necessary under Project #13 as set up in said contract for general maintenance of streets of major inportance between July 1st, 1937, and June 30th, 1938; NOW, THEREFORE, be it resolved by the City Council of the City of Santa Ana that pursuant to the provisions of the last paragraph of Article V of said agreement, the said City Council does hereby request the Department of Public Works of the State of California, acting by and through the Director of l~bllc Works, to grant its written consent to the use of the funds heretofore allocated to Project #15 to general maintenance work under Project #13 as set forth in said agreement, and that the amount thereof as approved for expenditure, be paid to the City of Santa Ana. RESOLUTION NO. 2551 WHEREAS, the Alcoholic Beverage Control Act provides in effect that the proceeds derived from the taxes collected thereunder shall be applied to the preservation of public peace, health and safety and to promote temperance in the use of alcoholic beverages, and WHEREAS, the amounts of such taxes sad licenses allocated to this City are not sufficient to defray the police costs to this City for the time and efforts consumed in this phase of police work, and WHEREAS, no part of the erctse taxes collected by the State are now allocated to this City, and WHEREAS, the principal cost of enforcing police reD~lations falls upon Municipalities NOW, THEREFORE, BE IT RESOLVED, that this City Council does hereby request the ~overnor of the State of California to include in his agenda for the Special S'esslon of the Legislature a revision of the Alcoholic Eeverage Control Act so as to provide a return or allocation to the Cities of a portion of the excise tax collections, to aid in carrying out the intention of the Act in promoting'temperance. RESOLUTION NO. 2558 REQUESTING AID FRO~ DEPA~ T~NT OF FINANCE FOR REPAIR OF JOINT OUTFALL S57;ER BE IT RESOLVED BY THE CITY COI~CIL OF THE CITY OF S~TA ANA: WHEREAS, flood waters of the Santa Ana river between the 2nd and 15th days of Hatch, 1958, completely destroyed portions of the outfall sewer which served the City of Santa Ana and other municipalities and sanitary districts in the County of Orange for the disposal of domestic sewage; and %~{EREAS, estimates of the cost of reconstruction of such outfall sewer amount to approximately the sum of ~540,000.00; and WHEREAS, such damage has been incurred in what is known as Sections I and 2 of said outfall sewer, and the main sewer line of this City, which empties into said Joint outfall sewer, and which such estimates are divided as follows: Santa Aha Rain Sewer line, ~25,000.00; Sewer Screening Plant, ~75,000.00; Section No. i of Joint Outfall Sewer, ~145,000.00; Section 2 of Joint 0utfall Sewer, ~95,000.00. That all of such estimates are amounts necessary to be raised by Cities after allowance for W.P.A. assistance, except the ~25,000.00 for Santa Ana Hain Sewer Line which is total estimated cost of such reconstruction with ~lO,O00.00 to be raised by this City, and WHEREAS, this City is flnanci~lly unable to meet the costs necessary to be borne by it for such reconstruction, and WHEREAS, said estimates include said Section 2 which lies adjacent to the City of Santa Aha serves other cities in the community, the destruction of which may seriously affect the public health and safety in the City of Santa Ana; but is not maintained or operated by this City, and WtUEREAS, said Section No. I is jointly maintained and operated by the City of Santa Ana and other cities and sanitary districts in said County of Orange, and NOW, THEREFORE, the City Council of the City of Santa Ana does hereby petition the Department of Finance of the State of California to allocate to the relief and assistance of this City the sum of ~245,000.00 out of moneys made available for such purpose by the Special Session of the Legislature of the State of California, which convened on the 7th day of N~rch, 19~8, to the reconstruction of such joint outfall sewer in the County of Orange, and that such money be made available both for labor and material for such purposes. ~The foreg~fhg request is made for the reason that an emergency exists for the immediate reconstruction of said j$int outfall sewer in order to preserve the public health and safety of the City of San~a Ana, as well as the people of the County of Orange, and immediate relief is necessary to avoid the danger of disease resulting from such destruction. SECTIO~ 2~ Any property owner shall have the right to have any of said weeds removed at his own expense, providing the same is done prior to the arrival of the Street Superintendent or his representatives to do the same. SECTION 3: The Street Superintendent shall keep an account of the cost of abating said nuisance in front of or on each separate lot or parcel of land where the work is Cone by him or his deputies, and shal~ render an itemized report, in writing to the City Council of the City of Santa Ana showing the cost of removing such weeds on each separate lot, or in front thereof, or both, pro- vided, that before said report is submitted to said City Council, a copy of the same shall be posted for at least three days prior thereto, on or near the Chamber Door of said City Council, together with a notice of the time when said report shall be submitted to the City Council for confirmation. At the time fixed for receiving and considering said report, the City Council shall hear the same, together with any objections which may be raised by any of the property owners liable to be assessed for the work Of abating said nuisance and thereupon make such modifications in the report as they deem necessary, after which said report shall be confirmed. The amounts of the cost for abating such nuisance in front of or upon the various parcels of land mentioned in said report shall constitute special assessments against the respective parcels of land, and, as is made and confirmed, shall constitute a lien on said property for the amount of suc~ assessments, respectively, and thereafter said amounts shall be collected at the same time and in the same manner as ordinary municipal taxes are collected and shall be subject to the same penalties and the s. ame procedure under foreclosure and sale in case of delinquency as provided for o~dinary municipal taxes. PLAN OF THE CITY OF SANTA ANA COVERING THE THIRD PURCHASE OF TAX DELINQUENT LOTS Plan of the City of Santa Aha, Orange County, California, to return to the City Tax rolls and to the County Tax rolls, 1S9 lots all within the City limits of the said City of Santa Aha, and being the property as listed on Exhibit "A" as attached to a proposed agreement dated , 1958, between the Board of Supervisors of Orange County, California, and ~he City Council of said City of Santa Aua, California. At the present time all such lots or parcels of' property as shown on said Exhibit "A" have been deeded to the State of California, and are at present completely off of the assessment rolls of the City of Santa Ana and the County of Orange, and will produce ~0 TAX revenue until some effective plan is worked out to get the taxes and assessments brought up to date and the property back into the hands of private owners, who will pay the current taxes and assessments as they become due. 5 The group of l~s included in this plan are scattered ~hrough out the City and are all encumbered with 1918 Act Bonds, for Paving, Street Lights, Sewers, etc., It has been necessary to levy annually a rate of ten cents per hundred, assessed value, on ALL property within the City Limits, to pay the amounts due under the various l~l'g Act Bonds of the City of Santa Aha now in default. The successful working of this plan will place these lots back on the assessment rolls of both the City and the County and will help eliminate the ten cent levy now required to service the delinquent 1915 Act Bonds. This plan in general is as follows: (a) The City of Santa Aha will purchase from the County of Orange, under Section 3897d of the Political Code and m~endments thereto, the tax title now held by the State of California, subject, however, to the approval of the State Controller. At this point the state tax title and the city tax lien will both be vested in the City of Santa Ans. (b) The City of Santa Aha will then offer to the record owner of each lot so purchased from the County, a small sum of money in cash for a quitclaim deed to such lots. At this point the city will have a good and marketable title to any such lots for which it holds quitclaim deeds, thereupon the City will cancel all city taxes and penalties, to date, against such lots. (c) Where quitclaim deeds to the lots involved in this sale are not secured quickly and at a very small c cst, the City will immediately institute a court action to quiet its title to such lots as are secured under tax deed. (d) Upon the Court decree, granting title to the City (it is expected that most parties will default, by failing to answer the City's Complaint), the City will then hold good title and will then cancel all taxes and penalties out- standing against such lots and will then sell such lots to the best advantage of the City. (e) If it is found that some of these lots cannot be sold for the full amount of the improvement bonds outstanding against them, then it is the intent- ion of the City of Santa Ana to make such sales at the best price obtainable on the present market, so as to get this property back on the assessment rolls. (f) It is not too early to start now to have this group of lots ready for sale to the public during the next spring and Sl~W~r. A~y and all lots to which the City has perfected its title, will be offered for sale in groups of fifty to one-hundred lots, for cash to ~e highest and best;bidder. It is ®xpect®d that a sale in groups of around one-hundred lots will compel the success- ful bidder to support the real estate market. Section 4 of Assembly Bill 1129, being Chapter No. 396 of the Statutes of 1935 is pertinent to this plan and reads as follows: "The facts constituting such necessity are as follows: Due to the depression which has existed in the past several years, many landowners have been unable to meet the taxes and assessments levied by the State, political subdivisions agencies, reclamations, drainage and levee districts, with the result that their lands have been sold to the State and such taxing and assessing agencies. The heavy penalties assessed by law have made it impossible for the landowners to redeem their lands, hence thousands of acres of land (together with thousands of lots,) have been sold for the non-payment of such taxes and assessments, and deeds have been executed thereon to the State and such taxing and assessing agencies. That as long as such' lands (or LotsJ remain State lands, the same are non-assessable for tax or assessment purposes, and the tax and assessment burden becomes heavy upon the paying lands, causing more delinquencies ~nd losses***. The legislature hereby declares that the welfare of the State requires that such lands (or lots) be placed in private ownership as premptly as possible so that such land (or lots) henceforth bear its Just proportion of current taxation and assessments". Any sum so borrowed by the City pursuant to the authority of said Section 3719 of the Political Code of the State of California shall constitute a first lien and charge against the taxes levied for the current fiscal year in which said money was borrowed and shall be repaid from the first moneys received by such City from said taxes. Vegely ' City Clerk RESOLUTION ORD~R!NG IMPROVE~SNT NO. 2609 WHEREAS, the City Council of the City of Santa Ana, on the 7th day of November, 1938, passed its Resolution of Intention No. 2601 to order the hereinafter described i~provement to be made and public work to be done in the City of Santa Ana~ and WHEREAS, after the passage and adoption of Resolution of Intention No. 2601, the Street SuperlntenSent of the City of Santa Ana conspicuously posted along the line of the contemplated work and improvement at not more than three hundred ~eet in distance apart, and three in all, notices of the passsge of said resolution of Intention headed NOTICE OF PUBLIC WORK, in the manner, form and substance as required by law, and said Street Superintendent also caused a notice, similar in substance, to be published for a period of ten days in the Orange County Reporter, a daily newspaper, published and circulated in the City of Santa Ana and named by the City Council in said Resolution of Intention as the paper in which said notice should appear, all as appears from the affidavit of W.P.Hagthrop, the printer and publisher of said daily newspaper, and which affidavit was filed in the Office of the Clerk of the City of Santa Ana, on the 30th day of November, 1938, rand is now c~u file therein; and WHEREAS, the Street Superintendent of the City of Santa Aha cGnmenced the posting of the notices hereinbefore referred to on the 14th day of November, 1938, and fully completed the posting thereof on the 14th day of November, 1938, as appears from the affidsvlt of J.L.McBride, Street Superintendent of the City of Santa Ana, and more than ten days having expired after the expiration of the time of the publication of sai, notice within which protests or objection to the proposed work, or improvement, might be made by any person interested, objecting to said work or improvement, or to the extent of the district or lands to be affected or benefited by said work or improvement and to be assessed to pay the costs or expenses thereof; and WHEREAS, at the next meeting of the City Council, after the expiration of said ten (lC) days after the expiration of the time of the l~UbIication of said notice, and no objection to said work or improvement having been made or on file, why said proposed improvement should not be carried out in accordance with said Resolution of Intention, the City Council of the City of Santa Ana, having now acquired Jurisdiction to order the proposed improvement; IT IS HEREBY RESOLVED AND ORDERED that the pUblic interest and convenience require the work hereinafter described and the City Council of the City of Santa Ana hereby orders the following work to be done and improvement made in the City of Santa Aha, as follows: That that portion of Heliotrope Drive, as hereinafter described, in the City of Santa Ana, be closed up and abandoned, to-wit: All of the North 424 feet of Heliotrope Drive as shown on Tract No. 1010 as per map thereof, recorded in Book 33, page 15, Miscellaneous Maps, Records of Orange County, California, not included within Heliotrope Drive as shown on Tract No. 1035 as per map thereof recorded in Book 33, page 46, Miscellaneous'Maps, Records of Orange County, California. That the public work ordered and the improve~e nt to be made is for the purpose of closing up and abandoning that portion of Heliotrope Drive as hereinbefore described and for that reason no district is chargeable therewith. All of the herein proposed work shall be done in pursuance of an Act of the Legislature of the State of California designated "Street Opening Act of 1889", and the amendmen~ thereto. For further particulars, reference is hereby made to said Resolution of Intention No. ~801, which is dated the ?th day of November, 19~8, and on file with the Clerk of the City of Santa Aha. The Clerk of the City of Santa Aha is herewith instructed to record a copy of ~his Resolution Ordering this Improv~nent in the Office of the County Recorder of the County of OranEe, State of California. RESOLUTION NO. 2610 RES0~UTION ESTABLISHING TI~ LIMIT PARKING ZONE UNDER SECTION 9 OF ORDINANCE NO. 10~0 BE IT RES0~VED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, AS FOLLOWS: That pursuant tb the provisions of the Vehicle Code of the State of Californ! and pursuant to the provisions of Ordinance No. 1050 of the City of Santa Ana, entitle~ "An Ordinance of the City of Santa Aha Regulating the use of Public Highways within said City", adopted April 6, 19~6, the City Council does hereby declare that the following curb along the public highways in the City of Santa Aha shall be painted green and shall bear a legend in white letters thereon indicating that the maximum time limit for parking shall be twenty (20) minutes, as provided in Subdivision "F" of Section 9 of said Ordinance No. 1050, and the City Engineer is hereby directed to cause said curb to be painted as above described, on the following curb, to-wit: THIRD STREET On the North side between Birch Street and Broadway, located as follows: The Westerly 17 feet of the Easterly 26 feet. BE IT FURTH~H RESOLVED, that pursuant to said Ordinance No. 10~0, the following curb along the public highways in the City of Santa Aha shall be painted Yellow, as provided in Subdivision "H" of Section 9 of said Ordinance No. 1050, and thc City Engineer is hereby directed to cause said curbs to be painted Yellow, as follows, to-wit: THIRD STREET On the North side between Birch Street and Broadway, located as follows: The Westerly 20 feet of the Easterly 86 feet.
