COMMISSION AND GRANTING A VARIANCE ON
APPLICATION NO. 1842 FILED BY LOUIS EARL
AND ALBERTA GONZALES, SUBJECT TO CONDITIONS
WHEREAS, after hearing on notice, the Planning Commission
DENIED a variance on Variance Application No. 1842, filed by
LOUIS EARL GONZALES and ALBERTA GONZALES, and Appeal Application
No. 105 was duly filed presenting the matter to the City Council;
and
WHEREAS, the City Council, after public hearing on notice,
has determined that said Variance Application meets the require-
ments of Section 9250.8 of the Santa Ana Municipal Code, that the
decision of the Planning Commission should be overruled and that
said Variance should be granted subject to certain conditions.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of
the City of Santa Aha does hereby overrule the decision of the
Planning Commission and does hereby grant a variance on Variance
Application No. 1842 to permit the operation of a drive-in food
service establishment in an R-2 District and located at 2328 West
McFadden Avenue in the City of Santa Aha, California. Said
Variance is granted subject to the following conditions:
1. That a minimum of one covered parking stall be provided for
the residence at 1101 South Golden West Avenue;
2. That development be according to plot plan;
3. That the following conditions are to be complied with prior
to issuance of utilities release by the Building Department:
a. That a 25-foot radius property line spandrel easement
be provided for at the southeast corner of McFadden
Avenue and Golden West Avenue.
NOTE: Dedication shall be initiated by owner, through
the Department of Public Works, at least two
weeks prior to application for a building permit
to avoid delay.
b. That the owner pave between the gutter and the edge of
existing pavement on McFadden Avenue.
c. That the owner place sidewalk on all frontage where
sidewalk does not exist.
PASSED AND ADOPTED by the City Council of the City of Santa
Aha at its regular meeting held on the 20th day of January, 1964.
