THIS AGREEMENT made and entered into in quadruplicate this day of February , 194_4, by and between th~ STATE OF CA~, hereinafter called the State and the City of Santa Ana, a "Local Agency" as defined in Chapter 805, Statutes of 1943, hereinafter called "Local Agency, WITNESSETH: WHEREAS, Local Agency has filed an application for financial aid for civilian defense purposes under the provisions of Chapter 805, Statutes of 1943; and WHEREAS, the application and this agreement have been approved by the Director of Civilian Defense; NOW, THEREFOItE, the Director of Finance does hereby agree to allocate to Local Agency from the appropriation contained in Chapter 805, Statutes of 1943, for expenditure for civilian defense purposes in accordance with said act, the sum of Three Thousand Eight Hundred Ninety-nine and 21/100 ($3,899.21) Dollars, or so much thereof as may be necessary, to be paid to Local Agency as hereinafter provided. Local Agency agrees: 1. To hire and pay the salaries of a coordinator and a clerk and to purchase and pay for siren control and other expenses am required in con- nection with the ~lvi!lan defense activities of Lopal Agency during the period June 1, 19~3, to and including June 30, 19~, all substantially as outlined in Local Agency's application. 2. That this agreement may be terminated by the Director of Finance on thirty days written notice addressed to the City Auditor, City of Santa Ana, Santa Ana, California. 3- That in the event of any disagreement as to whether or not items of expenditure are reimbursable under this agreement, the decision of the Director of Finance thereon shall be final. 4. That ~laims for reimbursement for expenditures incurred under this a~reement during the period June 1, 1943, to and including December 31, 19~3, may be filed with the State immediately and that claims for re- imbursement for expenditures incurred under this agr~,ement during the period January 1, 19~d~, to and including June 30, 19'?~, shall not be filed with the State before July l, 19~. 5. To permit representatives of the State Department of Finance to inspect the employments and facilities provided for herein and to examine all facilities and records in connection therewith at any reasonable time. 6. That no part of any matching funds expended by Local Agency, and which will be used as a basis for reimbursement from the State hereunder shall be paid from sources emanating from the State Treasury, nor from any fund of any agency ~hich is a part ~f the executive department of the State of California. The State agrees: To reimburse Local Agency for not more than one-half of the cost of the expenditures paid under Paragraph No. 1 in this agreement provided, however, that the total amount of the reimbursement so made shall not exceed the sum of Three Thousand Eight Hundred Ninety-nine and 21/1OO ($3,~99.21) Dollars, and provided further that in the event this agreement is terminated under paragraph No. 2 hereof or for any other reason, no _ expenditures incurred by Local Agency for the period subsequent to the dmte of termination shall be used as a basis for reimbursement hereunder,' and provided further that no expenditures for telephone service nor for guards shall be used as a basis for reimbursement hereunder. Such re- imbursement will be made upon receipt of satisfactory invoices in dupli- cate supported by paid vouchers, if available, or if such ~muchers are retained as part of the records of Local Agency the hereinbef~re mentioned invoices shall have attached thereto an itemized list of the expenditures made a~xi paid for by Local Agency. Said itemized list shall include the date, name of each vendor, contractor or employee to ~hom payments have been made, the amount paid to each such person and a description of the materials supplied and services rendered. Said invoices shall also be accompanied by a sworn statement by the fiscal officer of the Local Agency to the effect that all such expendit,~es have been paid. It is mutually agreed that any and all claims for reimbursement under this agreement must be filed by Local Agency with the Department of Finance, State Capitol, Sacramento, California on or before the clay of &ug~st, 19b~, and ~at the State shall not be liable for the pay- ment of any claims filed subsequent to the latter date. It is further agreed that this agreement may be terminated or amended by mutual consent of the parties hereto. Ail notices herein provided to be given, or which may be given, by either party to the other, shall be deemed to have been fully given when made in writin~ and deposited in the United States mail, registered and postage prepaid, and addressed as follows: To the State at the State Capitol, Sacramento, California, c/o Department of Finance and to Local Agency at Santa And, California, c/o City Auditor, City of Santa Am. The address to which the notices shall or may be mailed as aforesaid to either party shall or may be changed by written notice given by such party to the other, as hereinbefore provided; but nothing herein contained shall preclude the giving of any such notice by personal service. C. a proposed treaty with the Republic of Nexico, guarant~eefngto Nexico 1,500,000 acre feet of Colorado River water annually; and WHEREAS, the maximum historical use and maximum possible use of the waters of the Colorado River in the Republic of Nexico, prior to and without the benefit of the Boulder Dam project, was ?50,000 acre feet annually; and WHEREAS, the increase of waters of said river by said pro- posed treaty apparently to be made available to the Republic of Nexico will make impossible the satisfaction of present and future needs by present users of Colorado River waters in the United States of America, including particularly the people of Southern California, and will be in derogation of the provisions of the Boulder D~m Pro- ject Act; and WHEILEAS, the allowance to the Republic of Nexico by such pro- posed treaty of any amount in excess of 750,000 acre feet of water per annum in priority over users in the United States of 'America will result in irreparable injury to said users, including the City of Santa Ana; NOW, THEREFORE, BE IT RESOLVED, that, through its Council, the City of Santa Ana hereby goes on record urging the United States .Government, in its negotiations with the Republic of Nexico with re- spect to said treaty and the water rights therein involved, to aesur~ to users of Colorado River water in the United States of America their present rights to Colorado River water. Further that such treaty make available to the Republic of Mexico only such additional water as may be available after present rights of users by people of this country have been assured. 'RE80LUTION FOR RE-ALLOCATION OF FUNDS UNDER AGREEMENT BETWEEN CITY OF SANTA ANA AND DEPARTMENT OF PUBLIC WORKS WHEREAS, the City of Santa Ana has heretofore entered into an agreement with the Department of Public Works of the State of California, acting through the Director of Public Works, governing the expenditure of one-quarter cent gas tax on State Highways for the 1941-~3 Biennium; and WHEREAS, under said agreement there is set up a project known as Project ~25, which is entitled "Contingencies Project", in which the sum of $3,836.71 has been allocated to such proJect~ and WHEREAS, said Project #25 was reduced in the amount in August 1942, leaving a balance of $961. yl, and WHEREAS, the balance of the money available under such Con- tingency Project now appears to be necessary to resurface that portion of Fairhaven Avenue (Memory Lane), State Highway Route 179, from near Bristol Street to Flower Street, lying within the City of Santa Ana. NOW THEREFORE, be it resolved by the City Council of the City of Santa Ana that pursuant to the provisions of Article VI of said agreement, the said City Council does hereby request the Department of Public Works of the State of California, acting by and through the Director of Public Works, to grant its written consent to the use of the funds heretofore allocated to Project ~25, to resurface that ~e~$iee~ of Fairhaven Avsnue, State Highway ROute 179, lying within the City of Santa Ana, and that the amount Of $961.71 there- fore be approved for expenditure by the said Department of Public Works for such resurfacing. of $2,sy5. RESOLUTION CONCERNING PARKING LIMITATIONS UNDER ORDINANCE NO. 1030 BE IT RESOLVED BY THE CITY COUNCIL OF T~ CITY OF SANTA ANA, as follows: WHEREAS, by previous Resolution of the City Council of the City of Santa Ana, pursuant to the provisions of the Vehicle Code of the State of California, and pursuant to the provisions of Ordinance No. 1030 of the City of Santa Ana, entitled Ordinance Regulating the Use of Public Highways within said City~l, adopted Aprll 6, 1936, the City Council did declare that the fol- lowing curb along the public highway in the City of Santa Ana shall be painted Yellow as provided in Subdivision "h" of Section 9 of said Ordinance No. 1030, and the City Engineer was thereby directed to cause the curb to be painted as above described on the following curb, to-wit: On the West located as follows: and eliminate NORTH BROADWAY side between Fifth and Sixth Streets, The North 14.6 feet of the South 88 feet. AND, it is the desire of the City Council to abandon that certain loading zone as above described. NOW TH~HEFORE, be it resolved that the foregoing loading zone is hereby eliminated, and the City Engineer is hereby directed to cause the paint on said curb to be removed or covered. At the time fixed for receiving and considering said report, the City Council shall hear the same, together with any objections which may be raised by any of the property owners liable to be assessed for the work of abating said nuisance and thereupon make such modifications in the report as they deem necessary, after which said report shall be confirmed. The amounts of the cost for abating such nuisance in front of or upon the various parcels of land mentioned in said report shall constitute special assessments against the respective parcels of land, and, as is made and confirmed, shall Constitute a lien on said property for the amount of such assessments, respec- tively, and thereafter said amounts shall be collected at the same time and in ths same manner as ordinary municipal taxes are collected and shall be subject to the same penalties and the same procedure under foreclosure and sale in case of delinquency as provided for ordinary municipal taxes. M. (b) Resolution adopted July 7, 19~3, declaring as a freeway, that portion of State Highway Route 2, in the City of Santa Ana and County of Orange between the point of intersection of said above-mentioned Route 17~ with Main Street, and the point of intersection of said Route 2 with First Street, as said por- tion of Route 2 is shown on the general route map adopted by this Commission on July 7, 1943, and filed in the office of the Department of Public Works at Sacramento, California, and, V~REAS, a plan map for such freeway in the City of Santa Ana for Routes 2 and 174 lying between Roe Drive and the east city boundary of City of Santa Ana at Mabury Street has heretofore been prepared showing the proposed plan of the State as it affects city streets, including the provisions for closing of City Streets, for carrying City Streets over or under or to a connection with such freeway, and for relocations of City Streets; NOW, THEREFORE, IT IS AGREED 1. The City agrees and consents to the closing of city streets, relocation of city streets and other construction affecting city streets, all as shown on the said plan map attached hereto, marked E~hibit i and by this reference made a part hereof; and further, the City agrees and consents to the acquisition by the State by negotiation with property owners or by condemnation of all necessary lands required for the construction, reconstruc- tion, altering, relocating, or otherwise changing such existing city streets end all lands necessary for the construction of new streets, outer highways, ramps and connections appurtenant to said freeway and as shown on attached plan map, Exhibit 1. 2. The State in the construction of said freeway will, out of the funds available for expenditure on state highway routes, make such changes affecting city streets, in accordance with the said plan map Exhibit l, or as the same may hereafter be modified by subsequent agreement between the parties hereto. The grade separations indicated on attached plan map Exhibit i will be financed from said state highway funds, and may be either underpasses or overpasses, as the State determines by reason of the engineering conditions involved. 3. The City will resume control and maintenance over each of the relocated or reconstructed city streets on written notice to the City Engineer from ~he State that the work herein provided for on such city street has been completed, except as to -2- any portion thereof which is adopted by the State as a part of the freeway proper. ~. It is mutually agreed and understood that this agreement shall supersede and cancel that certain freeway agree- ment between the State and City dated July 19th, 19~3. 5. It is also mutually agreed herein between the parties hereto that the freeway improvement as herein contemplated and as shown on attached plan map Exhibit i for the portion thereof lying between Roe Drive and Main Street shall modify, supersede and cancel the proposed plan of the freeway improvement between Roe Drive and Main Street, as shown on Exhibit "B" attached to that certain freeway agreement dated June 9, 194l between the parties hereto. 6. This agreement may be modified at any time by the mutual consent of the parties hereto as may become necessary for the best accomplishment through State and City cooperation of the whole freeway project for the benefit of the people of the State and of the City.
