WAIVING NOTICE OF AND CONSENTING TO TEE PROPOSED
RELINQUIS~94]~T OF A PORTION OF EIGHWAY RIGRT OF
WAY IN TEE CITY OF SANTA ANA, AND EXPRESSING
ITS WIT.T.TNGNESS TO ACCEPT SUCH RELINQUISH}~IT.
Wn~, the California Highway C~ission on July 7, 1943 adopted
a resolution declaring that certain section of Route 5, (formerly Route 2),
in the City of Santa Aha, to be a freeway; and
W/t~, the State of California has acquired rights of way for
and has constructed a frontage road and has altered certain city streets
in the City of Santa Ana between Valencia and Seventeenth Streets, road
V~I-Ora~5, in eonnection with the Santa Aha Freeway; and
Wa~, by freeway agreement dated February 15, 1954, between
the City of Santa Aha and the State of California, the City agreed to accept
for inclusion in the City Street System said frontage road and altered city
streets upon relinquishment thereof to said city by the State of California;
and
W~S, the California Highway Commission has found and determined
that it is desirable and in the public interest that said frontage road and
altered city streets be relinquished to the City of Santa Ana for use as
city streets;
NOW, 'I'~EFORE, BE IT RESOLVED that the City hereby waives the
requirement that ~0 days' notice be given prior to relinquishment and requests
the California Highway Commission at its May 1964, meeting to relinquish to
the City of Santa Ana all of the State of California's right, title and interest
in and to that certain frontage road and those altered city streets in the
City of Santa Aha, together with the rights of way and appurtenances thereof,
described as Relinquishment No. 293 and described in attachment to letter dated
April 6, 1964, from State Highway Engineer to City Council) and
The City of Santa Aha hereby consents to said proposed relinquishment
and to the acceptance thereof notwithstanding the fact that the same be
substandard by reason of size, shape or condition; and
The Clerk of the Council shall certify to the adgption of this
Resolution and shall cause a certified copy hereof to be forwarded to
Mr. J. C. Womack, State Highway Engineer, State of California, Department of
Public Works, Highway Transportation Agency, Post Office Box 1079, Sacramento,
California, Attention: Mr. E. J. McKenney; and Mr. E. P. Jones, Supervising
Right of Way Agent, Division of Nighways, 120 South Spring Street, Los Angeles,
California 90012.

California, at its regular meeting held on the 20th day of April, 1~64.
