REAL PROPERTY NECESSARY FOR A RESERVOIR SITE
TO SUPPLY POTABLE WATER WITHIN THE CITY, A
RIGHT OF WAY TO AFFORD ACCESS TO SAID SITE,
AND A TEMPORARY CONSTRUCTION EASEMENT
WHEREAS, because of the record population growth within
the area and the increasing demands for potable water within the
City it is necessary that a new reservoir be constructed in the
southerly part of Santa Ana on the land hereinbelow described,
and because of the location of said land that a right of way to
afford ingress and egress to and from said parcel be acquired.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of
the City of Santa Aha hereby finds and determines that public
interest and necessity require the construction of a water reservoir
and require the acquisition of a right of way to afford access to
and fr~ said reservoir site; that fee title be acquired for said
reservoir site and said right of way, and that said public interest
and necessity require the acquisition of a temporary easement for
construction purposes over the land hereinbelow described in
Parcel 3 for the purpose of constructing said reservoir, and
further require that said City do have and acquire Parcels 1 and 2
in fee simple and a temporary easement in Parcel 3 of that certain
land in the City of Santa Aha, County of Orange, State of California,
described as:
PARCEL 1:
That portion of Lot 6 of the Williams Tract, as shown
on a map recorded in Book 30, page 14 of Deeds, Records
of Los Angeles County, California, described as follows:
Beginning at the intersection of the Easterly line of
said Lot 6 with the Northerly line of that certain strip
of land 80.00 feet in width described in a Deed to the
Southern California Sugar Company, recorded June 7, 1909
in Book 174, page 248 of Deeds; thence North 0° 17' 52"
West along said Easterly line a distance of 590.00 feet;
thence South 89° 30' 17" West parallel with the Southerly
line of said Lot 6 a distance of 340.00 feet; thence
South 0° 17' 52" East 590.00 feet to the Northerly line
of said land of Southern California Sugar Company; thence
North 89° 30' 17" East 340.00 feet to the point of
beginning.
PARCEL 2:
That portion of Lots 6 and 7 of the Williams Tract, as
shown on a Map recorded in Book 30, page 14 of Deeds,
records of Los Angeles County, California, described as
follows:
Beginning at a ~int on the Easterly line of said Lot 6
distant North 0 17' 52" West 590.00 feet from the inter-
section of said Easterly line with the Northerly line
Of that certain strip of land 80.00 feet in width
described in a Deed to the Southern California Sugar
Company, recorded June 7, 1909 in Book 174, page 248 of
Deeds; thence North 0° 17' 52" West 261.61 feet along
said Easterly line of a point on a curve in the Westerly
line of land described in a Deed to the Orange County
Flood Control District, recorded April 10, 1961, in
Book 5682, page 842 of Official Records, concave North-
easterly having a radius of 790.00 feet, a radial line
through said point bears South 71~ 23' 30" West; thence
Northerly along said curve through a central angle of
18~ 18' 38" a distance of 252.47 feet to the end of said
curve; thence tangent to said curve North 0° 17' 52"
West 112.21 feet to the Southerly line of land described
PARCEL 3:
in a Deed to the City of Santa Ana, recorded December 14,
1959 in Book 5014, page 317 Of official Records; thence
South 89° 39' 08" West 20.00 feet; along said Southerly
line to a line that is parallel with and distant
Westerly 20.00 feet measured at right angles from the
Westerly. line of said land of the Orange County Flood
Control District; thence South 0° 17' 52" East 112.19
feet along said parallel line to the beginning of a
tangent curve concave Northeasterly having a radius of
810.00 feet; thence Southeasterly along said curve through
a central angle of 18° 04' 53" a distance of 255.62 feet
to a line that is parallel with and distant Westerly
20.00 feet measured at right angles from the Easterly
line of said Lot 7; thence South 0° 17' 52" East 258.47
feet to a line that bears South 89° 30' 17" West from
the point of beginning; thence North 89° 30' 17" East
20.00 feet to the point of beginning.
An easement for temporary construction purposes over that
portion of Lot 6 of the Williams Tract, as shown on a
Map recorded in Book 30, page 14 of Deeds, Records of
Los Angeles County, California, described as follows:
Commencing at a point on the Easterly line of said Lot 6,
distant North 0° 17' 52" West 590.00 feet from the inter-
section of said Easterly line with the Northerly line of
that certain strip of land 80.00 feet in width described
in a Deed to the Southern California Sugar Company,
recorded June 7, 1909 in Book 174, page 248 of Deeds;
thence South 89~ 30' 17" West parallel with the Southerly
line of said Lot 6 a distance of 20.00 feet, said point
being the true point of beginning; thence continuing
South 89° 30' 17" West 320.00 feet; thence South 0~ 17'
52" East 590.00 feet to the Northerly line of said land
of Southern California Sugar Company; thence South 89~
30' 17" West along said Northerly line a distance of 100.00
feet; thence North 0~ 17' 52" West 690.00 feet; thence
North 89~ 30' 17" East 420.00 feet; thence South 0° 17'
52" East 100.00 feet to the true point of beginning.
Said easement to expire not later than April 2, 1966.
BE IT FURTHER RESOLVED:
1. That the City Attorney is hereby ordered to bring an
action in the name of the City to condemn said property necessary
to be taken and to do all things necessary to prosecute said action
to final determination;
2. That public interest, necessity and convenience require
and it is hereby ordered that said City take immediate possession
and use of the property herein ordered to be acquired upon
compliance with the requirements of law applicable thereto as a
right of way for public use;
3. That said public improvement is planned and located in
a manner which will be most compatible with the greatest public
good and the least private injury;
4. That the City of Santa Ana is authorized and empowered
to provide for the supplying of water to the citizens and businesses
within the City and all mains, lines, valves, vaults, reservoirs
and works appurtenant thereto to carry out said purpose and to
extend, improve, construct and maintain said water works syste~.
5. That said action in condemnation shall be taken in
accordance with the provisions of the Code of Civil Procedure and
the Constitution of the State of California relating to e~inent
domain.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 4th day of May, 1964.
