OF REAL PROPERTY NECESSARY FOR THE LOCATION
OF A PUBLIC STREET NORTH OF SEVENTEENTH STREET,
EAST OF VALENCIA STREET
WHEREAS, it has been determined that the present on-ramp
to the Santa Ana Freeway creates traffic backup and continuing
traffic hazard and that the same should be relocated to provide
connection with Poinsettia Street, and that the City must acquire
one triangular piece of property to provide for the realignment
of this on-ramp.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of
the City of Santa Ana hereby finds and determines that public
interest and necessity require that the Freeway on-ramp at
Seventeenth Street be realigned to connect with Poinsettia Street
and further require that said City do have and acquire for street
purposes, in fee simple, that certain land in the City of Santa
Ana, County of Orange, State of California, described as:
Beginning at a point in the Easterly line of Lot 28,
Block "G", resubdivision of the Nob Hill Tract, as per
map recorded in Book 6, page 3, Miscellaneous Maps in the
office of the County Recorder of Orange County, California,
distant Northerly thereon 11.01 feet from the Southeasterly
corner thereof; thence following that certain property line
described in a deed executed by the State of California and
recorded March 7, 1957 in Book 3830, pate 274, Official
Records of said Orange County, North 81v 22'03" West 4.45
feet; thence North 42° 33' 00" West 136.93 feet to a point
of cusp with a curve that is concave Northeasterly, having
a radius of 178.00 feet, a radial to said curve at said
point bears North 47° 27' 00" East; thence departing from
said certain property line and running Southeasterly along
said curve through a central angle of 36° 21' 57", an arc
distance of 112.98 feet to a point in said Easterly line of
Lot 28; thence along said East line South 0° 06' 14" East,
47.24 feet to the point of beginning.
BE IT FURTHER RESOLVED:
1. That the City Attorney is hereby ordered to bring an
action in the name of the City to condemn said property necessary to
be taken and to do all things necessary to prosecute said action to
final determination;
2. That public interest, necessity and convenience require
and it is hereby ordered that said City take immediate possession
and use of the property herein ordered to be acquired upon compliance
with the requiraments of law applicable thereto as a right of way
for public use;
3. That said public improvement is planned and located in
a manner which will be most compatible with the greatest public good
and the least private injury;
4. That the City ~ Santa Ana, a municipal corporation, is
authorized and empowered to provide for the opening, extension,
widening, construction and maintenance of public streets and highways
within the City;
5. That said action in condemnation shall be taken in
accordance with the provisions of the Code of Civil Procedure and
the Constitution of the State of California relating to eminent
domain.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 6th day of July, 1964.
