HomeMy WebLinkAbout64-107RESOLUTION 64-107 OVERRULING THE DECISION OF THE PLANNING COMMISSION AND GRANTING A VARIANCE ON APPLICATION NO. 1954 FILED BY KEYSTONE INVESTMENT CO. AND THEODORE H. VANDLING, SUBJECT TO CONDITIONS WHEREAS, after hearing on notice, the Planning Commission DENIED a variance on Application NO. 1954, filed by KEYSTONE INVESTMENT CO. and THEODORE H. VANDLING, and Appeal Application No. 132 was duly filed by the applicants presenting the matter to the City Council; and WHEREAS, the City Council, after public hearing on notice, has detezmined that said Variance meets the requirements of Section 9250.8 of the Santa Ana Municipal Code, that the decision of the Planning Commission should be overruled, and that said Variance should be granted subject to certain conditions. NOW, THEREFORE, BE IT HESOLVED: That the City Council of the City of Santa Ana does hereby overrule the decision of the Planning Commission and does hereby grant a Variance on Variance Application NO. 1954 to allow the construction of an office building waiving front, rear and side yard set backs at 1210 to 1218 North Broadway, Santa Ana, California. Said Variance is granted subject to the following conditions: That applicant submit a revised parking plan; said plan to be approved by the Planning Department and development to be according to the approved plan. That a landscaping plan be submitted to and approved by the Planning Department; said landscaping to be implemented and maintained. 3. That this variance permits the deletion of the three (3) foot side yard and the ten (10) foot rear yard. 4. That this plan shall comply with the front yard setbacks as required in the P zone. 5. That Section 9247. of the Santa Aha Municipal Code relating to off-street parking requirements be cemplied with. 6. That Section 9245. B (Parking Modifications) of the Santa Ana Municipal Code be complied with. That the subdivider's engineer furnish the Department of Public Works a final grading plan including existing elevations along the property lines. 8. That an easement be provided for a 10-foot alley corner cutoff at Broadway. 9. That a 40-foot easement be provided for Washington Avenue from center line to property line for street purposes. NOTE: Dedication shall be initiated by owner, through the Department of Public Works, at least two weeks prior to application for a building permit to avoid delay. 10. That all elevations be on 1958 Orange County Survey Datum. 11. That all plans and surveys for the required improvements be completed by the owner's engineer and submitted to the Department of Public Works for approval. 12. That the owner replace sidewalk on Broadway and repair broken lip at alley approach prior to issuance of utilities release by the Building Department.
