HomeMy WebLinkAbout64-153RESOLUTION 64-153 AUTHORIZING CONDEMNATION OF REAL PROPERTY NECESSARY FOR PUBLIC STREET PURPOSES FOR THE APPROACH TO THE SANTA ANA RIVER BRIDGE AT MCFADDEN AVENUE WHEREAS, the Master Plan for Streets and Highways approved by the City Council on October 20, 1958, provides for the crossing of the Santa Aha River by McFadden Avenue, an arterial street; and WHEREAS, the County of Orange is presently constructing a bridge over said river to accomplish this crossing; and WHEREAS, it is necessary to acquire rights of way for public street purposes to connect McFadden Avenue with said bridge, thereby accomplishing the continuity of McFadden Avenue. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Aha hereby finds and determines that public interest and necessity require the continuation of McFadden Avenue across the Santa Aha River and further require that said City do have and acquire as right of way for public street purposes, in fee simple, that certain real property in the City of Santa Aha, County of Orange, State of California, described as: That portion of the West half of the East half of the Northeast quarter of the Southwest quarter of Section 15, in Township 5 South, Range 10 West, in the Rancho Las Bolsas, in the City of Santa Aha, as shown on a map thereof, recorded in Book 51, page 7, et seq., Miscellaneous Maps, records of Orange County,bounded Easterly ilby the Channel of the Santa Ana River as conveyed to the Newbert Protection District, by deeds recorded November 18, 1910, in Book 194, page 168, and in Book 194, page 169, of Deeds. BE IT FURTHER RESOLVED: 1. That the City Attorney is hereby ordered to bring an action in the name of the City to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination; 2. That public interest, necessity and convenience require and it is hereby ordered that said City take immediate possession and use of the property herein ordered to be acquired upon compliance with the requirements of law applicable thereto as a right of way for public use; 3. That said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury; 4. That the City of Santa Aha, a municipal corporation, is authorized and empowered to provide for the opening, extension, widening, construction and maintenance of public streets and highways within the City; 5. That said action in condemnation shall be taken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain. -1- PASSED AND ADOPTED by the City Council of the City of Santa Aha at its regular meeting held on the 19th day of October, 1964.
