HomeMy WebLinkAbout64-194RESOLUTION 64-194 ACCEPTING INDENTURE WHEREIN PACIFIC ELECTRIC RAILWAY COMPANY GRANTS A DRAINAGE DITCH EASEMENT ALONG THE NORTH SIDE OF ITS RIGHT OF WAY BETWEEN MAIN STREET AND CYPRESS AVENUE TO THE CITY OF SANTA ANA IN CONSIDERATION OF $2,280.00 WHEREAS, after negotiation, agreement has been reached between the parties hereto for the conveyance of a drainage easement in consideration of cash payment by the City of Santa Ana. NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Ana hereby accepts the grant of easement contained in that certain Indenture dated March 26, 1964, between the PACIFIC ELECTRIC RAILWAY COMPANY and the CITY OF SANTA ANA granting to the City a drainage ditch easement along the northerly side of the Railway Company's property running northeasterly from Main Street to a point which would lie at the southerly extension of the easterly right of way line of Cypress Avenue, said easement being 10 feet wide, in consideration of $2,280.00, and Carl J. Thornton, the City's designated agent, is directed to place his Certificate of Acceptance on said instrument. BE IT FURTHER RESOLVED: That the Mayor and the Clerk of the Council are hereby autherized to execute said Indenture for and on behalf of the City of Santa Ana and to record the same after the consideration herein provided for has been paid to the PACIFIC ELECTRIC RAILWAY COMPANY and a fully executed counterpart of said Indenture has been delivered to said RAILWAY COMPANY. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 7th day of December, 1964.
