An Ordinance to Provide Purther Licensing for purpose of Revenue and Regulation of Pursuits, Tradec, Occupations, Avocations, ~mplo~ents, 0alling and Busi- ness carried on in the City of Santa Aha, fixing the rate therefor, providinS for the collection thereof, and pro- viding penalties for the violation thereof, and repealing Ordinance No. Z55 and all Ordinances in conflict therewith. The Board of Tructees of tho City of Santa Aha, do ordain as follows: Section 1. It shall be unlawful for any person, per- cons, firm, co-partnership or corporation or for any person as agent, clerk or employee, either for himself or for any other person, firm, co-partnership or corporation within th~ corporate limi~c of the City of Santa Aha, to transact, engage in, or calTy on any pursuit, trade, occupation, avocation, employment, business or calling, hereinafter specifisd until he, she, they or it shall first obtain a license therefor ac in this Ordinance rs.Auired. Each and every day or fractional part of a day that said pursuit, trade, occupation, avocation, employment, business or calling in this Ordinance specified is conducted or carried on without such license, shall constitute a violation of this Ordinance and any person, who, for himself or for any other person, shall violate any of the provisions of this Ordinance, shall for eadh violation thereof be deemed guilty of a misdemeanor and upon conviction by any Court having jurisdic- tion thereof, shall be fined therefor in a sum of not more than SZ00.0C or by ~prisonment in the City Jail not exceeding twenty- five days or both such fine and imprisonment; provided however that if any person shall furnish such evidence as shall satisfy the President of the Board of Trustees and the Oity Marshal that he or she, by reason of misfortune or physical infirmity, merits exemption from any section or clause of this Ordinance or that he was formerly a soldier in the United States Army or a sailor in the United States Navy, from either of which he was honorably discharged, a free license may be issued to such party for a limited period to be specified in such license. All licenses provided for in this Ordinance shall be paid for in advance in lawful money of the United States and such licenses shall be taken out anually, semi-annually, Quarterly, weekly, or by the day as hsreinafter provided, co~m~encing January let and if for a part of a quarter when taken out, there shall be paid the balance of said Quarter, except where a different ter~ ic provided for by this Ordinance. 10( form with bl~n~k ~dtuf°r one Y?r in book which stateme~r~l°n or said license, not be assignable ~e said license Shall bowlfng ~ley g~k, ~erry_go.ro~nd All licenses issued under the provisions of this Ordinance shall be posted in the place of business of tho licensee named in such license and the said license shall be produced by the licensee same shall be required by the Marshal or any officer whenever the of the City. It is hereby made a duty of the City Marshall to enforce all the provisions of this 0rdiuance. No personal demand or notice by the Marshal to such persons owing such license tax shal~ be necessary to incur the penalties of this Ordinance. Section ~. All licenses lsmued under and by virtue of this Ordinance shall be printed in blank form signed by the Presi- dent of the Board of Trustees and countersigned by the City Clerk, who shall set forth the name of the party to whom the license is issued, the nature of the trade or business, he, she, they or it are license~ to pursue, the time for which the same is granted, the date thereof, and the amount p~id therefor. ~ The City Clerk shall cause to be printed a sufficient number of such licenses as may be required for one year, in book form, with blank stub to each; and shall deliver the same to the Marshal from time to time as may be required and charge the Marshal therewith, who shall appear at the office of the City Clerk on the first Monday in each month and settle for the licenses sold. Pro- vided however, that all licenses now issued shall be good for the time for which such licenses were issued. The City Clerk shall, on application of the Marshal,issue to him such blank licenses as may be required, receiving ~ the t~:s of issuing the san~, from the Marshal, a statement of the person to who$ issued and the time o£ commencement and expiration of said license, which statement ~st be inserted by the City Clerk on the stub of said license so issued and which stub must be kept in the office of the City Clerk. Section 5. Each license granted or issued under any other provisions of this Ordinance shall authorize the licensee to transact or carry on the business or calling therein named at the place therein designated and no other and the said license shall not be assignable or transferable. Section 4. No license s!all be issued for any livery, or feed stable, public laundry where washing is done for hire, hotel, lodging hou~e, chop house, coffee house, bakery, restaurant, lunch counter, shooting gallery, billiard room, pool room, pocket billiard room, skating rink, merry-go-round, bowling alley, garage, creamery, auctioneer, auction house, junk dealers, wrecking house, or automo- biles for hire at stations, stands or places on the public streets, or peanut vendors, tamale stands, or lunch wagons at stations, stands or places on the public streets, except on tlze order of the Board of Trustees of the City of Santa Ana, and whenever any person, persons, firm, co-partnership or corporation, desires to open or ke~p any business specified in this section, he, she, they or it shall 101 be the duty of the licensee of each auto- mobile for hire to attach and display said (d) ~]very person, firm, co-partnership or corporation h~ving no fixed place of or automobiles within ~he corporate lira- petition the Board of Trustees to order a license therefor which petition shall set forth the name of the applicant, the character of the business and the location of the premises where the business is to be conducted and on the hearing of said petition the said Board may grant the same in whole or in part or may reject the same and no license shall be issued thereon except as ordered by said Board. Where any business in this Section specified may become dangerous to or affect the public health, peace or safety or become dangerous to surrounding property, the Board of Trustees shall refuse to grant the license. Should the Board of Trustees of said City at any time determine that the premises wherein any business described in this Section is conducted, are not in good and sanitary condition or not properly drained and have become dangerous and affect the public peace and Quiet it may revoke its ordor requiring tho license for such business to issue and no further license shall be issued there- on and it may also revoke any license theretofore issued by written notice to such licenses person. Section D. The rat~s of license for carrying on the pumsuit, trade, occupation, avocations, emplo~,~ents, business or calling in this Ordinance provided, shall be as follows,to-wit: Subdivision One. (a) For keepin~ or maintaining an automobile or automobiles for hire at stations, stands or places in the City of Santa Ana, or on the public streets of said City, other than a licensed garage for each automobile $B8.00 per year~ and ~B.50 per day payable in advance, for any person, firm, co-partnership or corporation who keeps for hire an automobile to carry passengers for a single day. (b) For each garage which is kept to sell, lease or repair automobiles including keeping one automobile for hire, $1S.O0 and for each "for hire" autmobile in addition to the first ~lO.O0, but none of the auto mobiles so kept shall stand for hire on the public streets for the purpose of soliciting trade. (c) To evory person, firm, co-partnership or corporation keep- ing or maintaining an automobile or automobiles for hire to carry 'passengers in said city, the marshal shall furnish with each licen~ issued for each auton~obile specifisd in the above classes of this Ordinance, a metal tag, not less than two (S) inches each way, whidu said tag shall be numbered and the said tag shall be of a different design and shape in each succeeding year and each of said metal tags shall contain the words "For Hire" in letters not less than one inch in length. Itshall be the duty of the licensee of each auto- mobile for hire to attach and display said metal tag conspicuously on each automobile so licensed by him. (d) Every person, firm, co-partnership or corporation, having no fixed place of business in the City of Santa Ana, who exhibits or demonstrates an automobile or automobiles within the corporate l im~its 102 $2.50. of said city for the purpose of thereof, shall pay a license of SS.O0 Der all payable in advance. inducing trade from the citizens day or $80.00 per (e) ~or every skating rink $15.00 per quarter, provided that same shall not be operated on the day commonly called Sunda~ nor between the hours of 10:50 o'clock P.M. of any day and 6:00 o'clock A.N. of the day following. (g) For carrying on an auction store or establishment where goods, wares or merchandise are sold at public auction, where zuch goods, wares or merchandise are sold as new ~oods, wares or mer- chandise, the license shall be $15.00 per day and no license shall be issued to any person under the provisions of this subdivision for less than thirty days at said sum of $15.00 per day. (h) For selling at public auction live stock, second- hand goods, wares or merchandise, the license shall be per year. (i) For every laundry where four or more male persons are emp2oyed $1B.O0 per year. (j) ~or every dry cleaning establishment for cleaning clothing or household furnishings $1~.00 per year. (k) ~or every hotel or rooming house, with or without dining room, with ten or more rooms, the license shall be ~6.00 per year; for less than ten rooms, taking transient roomers by the day the license shall be $~.00 per year. (1) For house moving upon Zhe streets of said City or on private or puolic property within said city, the license shall be $10.C0 per year and may be paid in semi-annual installments. ~othing in this subdivision shall be deemed to conflict with or affect the provisions of Ordinance $~4Z of the City of Santa Ana, in relation to the construction and moving of buildings and before a house is moved, the owner of the property or house to be moved or the holder of the housen~oving license shall first procure the permit s~cured by Section ~ of Ordinance No.299 of the City of Santa Aha, Subdivision Two. (a) ~or a theater or public hall to which an admission fee is ol~rged for meetings, plays, lectures or other assembla~ges, having or containing more than 700 seats for its patrons,including thSse carrying on both vaudeville entertain~ents and motion pictures, $50.00 per year, payable Quarterly, and for those con--~ raining less than 700 seats for its patrons $S5.00 per year, payable quarterly. (d) For every lumber yard, including planing and molding mill, for the deposit and sale of lumber the license shall be the sum. of $S0.00 per year, payable quarterly. (e) For every place of business for the sale of gasoline, potroloum,naptha, kerosene, or other illuminating oil, exclusively by wholesale, the license shall be $60.00 per year. (f) For the business of conducting or carrying on a public bath house, including plunge, the annual rate of license shall and the same is hereby fixed as follows: For every open plunge $1B.O0 per annum. Subdivision Three. (a) For either a lunch wagon, tanmle stand, portable lunch counter, chop house or restaurant on a public street,$1B.O0 per annmn, provided that no business shall be conducted therein between 6 o'clock a.m. and 8 p.m. of any day. (b} For each Stand on a public street for the sale of peanuts or popcorn or bo~h $1~.00 per annum~. (c) For a restaurant, bakery, chop house, coffee house or lunch counter $8.00 per annum. (d) For a pool, billiard~ or pocket billiard room $1B.O0 for each table; for each bowling alley $~8.00 per quarter; provided that it shall be unlawful to conduct a bowling alley on the day commonly called Sunday or between the hours of lB O'clock midnight and 6 o'clock a.m. of any day. (e) For a creamery $1B.O0 per annum. (f) For a junk or wrecking store or place of business $1B.O0 per annum. For every junk dealer having no fixed place of business within the City, $50.00 per annum. For every pawn shop ~0.00 per annu~:. (g) Every proprietor or manager of any circus or menagerie shall be charged as follows:- For first oar used or containing persons and property he shall pay by the day and night or either $10.00; for each add- itional car, to and including the tenth,S6.00; for each additional car after the tenth ~S.60. (h) For every procession on the streets of said City of any circus or menagerie not exhibiting within the Oity limits for each day or part thereof ~0.00. (i) For every exhibition other than those named in the foregoing subdivision, charging a fee, such as microscopes,lung testers,muscle testers, ball, knife or ring throwing, galvanic batteriss,telescope~ li£ting, striking or oth~r device for testing physical strength and all s~ilar ~n character no$ otherwise named, the license shall be $2.60 per day. 104 by said license; provided however that no license shall he revoked without giv- lng the holder thereof ar~ opportunity to adopted this 4th day of January, 1915, by the following vote to-wit: · FRANK EY, City of Santa Aha, California. (k) For every "flying-horse" or so called me~ry-g®-round $10.00 per w~ok, provided that any such"flying-horse "or merry-go- round shall not be permitted to run under a license under this Ordinance on any part of the day comn~only called Sunday. (1) For every stable kept for the sale of horses or mules $1E.O0 per annum. (m) For a store for male of oils, fuel, hay, grain flour or poultry, or all combined ~'8.00 per annu~l. (n) For carrying for hire goods, freight, merchandise or other property with a one horse dray or wagon, $4.00 per annum and with a two horse dray or wagon $8.00 per annum, and each shall have a legible num. ber as designated by the City Narshal, posted conspic- uously thereon and a record ~hall be kept t'hsreof by the City Marshal in his office. (o) For a motor truck used for transporting, transferring or carrying goods, wares, merchandise, or other property from one part of the city to another, the license shall be as follows: For one ton truck or less $4.00 per annu~,. For over one ton truck and not over two ton truck For over two ton truck and not over three ton truc~k For over three ton truck and not over four ton tru~k~10.0 For over four ton truck Subdivision Four. (a) Every solicitor or order agent soliciting or taking orders from house to house for the sale or purchase of goods, wares or merchandise, with or without samples, either for present or future delivery, and hawking, peddling or itinerant vending of goods,wares or merchandise except vegetables other than bananas or apples when not in conjunction with any store or ether fixed place of busi- ness, paying a license fee to the City of Santa Ana, except as herein otherwise provided,S5.00 per day. )b) For every person who shall own, open, establish, manage or have charge of a temporary location or place of business of any kind for the sale of any goods, wares or merchandise, or live stock_k~ to persons not regularly engaged in or carrying on such lines of business, the license shall be $15.00 per day, provided however that any person or persons who may own, open, establish, manage or have charge cf any temporary place of business for the sale of any goods, waC:es or merchandise or live stock in lieu of such payment may file with the city marshal as evidence of good faith in lieu 105 of the payments of said license in advance, a good and sufficient bond with two sureties or surety bond in the penal sum of $500.00 in favor of the City of Santa Ana, conditioned to guarantee the payment of the license herein called for if such temporary location or place of business should not be occupied for a continuous period of six months. Any place of business for the transaction of any of the kinds of business in this paragraph specified which has been occupued for a period of six n~onths, shall thereafter be deen~ed a permanent location or place of business. Any amount paid to the City marshal as a license for a temporary place of business over ~nd above or in excess of the license provided for by this Ordinance for a permanent place of business for the sale of the foregoing articles shall, at the expiration of said six months, be refunded by order of the Board of Trustees to the person or persons paying said license and said bond shall be cancelled and redelivered to the person giving the same. Provided that any place of business for the transaction of any of the kinds of business in the paragraph specified which is being occupied before the passage of this Ordinance shall be deemed a permanent place of business. (c) For hawking, peddling or itinerant vending of fruits or vegetables except bananas or apples £rom wagons on the streets, or canvassing or soliciting the sale of the same, or in soliciting ord~s for any future delivery of any such articles or in delivering any such articles previously contracted to be delivered and not mentioned in this section, the license shall be $20.00 per year by the year or Quarterly in advance; provided however that nothing herein contained in this section or in this Ordinance shall apply to canvassers or solicitors of any established business house in this City or to any person or solicitor of established wholesale dealers who shall canvass or solicit orders from estsblished de~lers only, nor shall this sec- tion nor this Ordinance apply to farn~rs who occasionally sell their own products raised on their fa~s and who are no~ thus engaged in such peddling, hawking or itinerant vending as a business independent of selling the products raised on their own farms. (d) ~or keeping City the person keeping each of said dogs a tag any dog or dogs within the limits of said the same shall procure from the marshal for for which he shall pay a yearly license of $~.00. Nothing in this section shall be construed to affect or modify any of the provisions of Ordinance No.18, of the said City except as herein provided. (e) For the business of an undertaker, enlbaln~er or funeral director $1~.00 per annum. Section V~. · or any one line business not herein otherwise specifically provided for, ~.00 per annum; and when more than one line of busi- ness is carried on in one store or place of business, the license shall be as follows: For any two lines $8.00 per annum; for three 106 lines $10.00 per annum, and $t~°.00 per annum for four lines or more. Section VII. All licenses granted under this Ordinance or any section thereof are granted and accepted by all parties receiving licenses with the express understanding that the Board of Trustees may revoke the same at any time if satisfied that any of the conditions of the license or terms of this Ordinance have been violated, or thais the license was obtained by fraudulent representations, or that the holder of the license is an unfit person to be trusted with the privilege s granted by said license; provided however that no license shall be revoked without giving the holder thereof an opportunity to appear before the Board in his own behalf. On revocation of the license, no part of the money in hands of the city treasurer shall be returned, but such license fee shall be forfeited to the City of Santa Aha. Section VIII· Every person, firm or corporation who may become delin- quent in the license fees for any license issued to him or her un~ the provisions of this Ordinance, may be sued for the same by said city, in the proper court, having jurisdiction thereof. Section IX. Where the word "person" is used in this Ordinance, referring to those liable to pay license tax, the same is intended and shall be construed to mean and include male and female person, fire, &sooc~t~ons or corporations carrying on the business for which the license must first be procured, and when the term used , in this Ordinance designated the principal, the sam, e shall be construed to mean and include the clerks, agents, servants, repre- sentatives and employees of such principals. It being the intenthn hereby to license the "business" and not separate or individual acts. Section X. Ordinance No.B~ of the O~tty of Santa Aha and all amendments thereto in relation to licenses and all other ordinances of said city in conflict with the provisions of this Ordinance, except ordinances provmdmn, for licenses for busLuess other than is provided for in this Ordinance are hereby repealed. Sect ion XI. The City Olerk shall cause this Ordinance to be published once in the "Evening Blade" a daily newspaper printed, published -~ and circulated in the city of Santa Ana, and ~0 days thereafter it ~hall take effec~ and be enforced. All fire trucks or apparatus of the fire department or conveyance or conveyances conveying any member of the fire department when going to a fire in the City of Santa Aha, shall have the paramount right of way over the streets, avenues, lanes, alleys and highways of said City and all other vehicles or conveyances of each and every nature and kind whatso- ever,(excepting street cars), upon the sounding of a gong or other signal that may be used by the fire company upon the approach of any such fire truck or fire apparatus or any convey- ance carrying any fireman, shall at once come to a stand or park adjacent to ~he curb iu such a position or place so as to in no manner obstruct or endanger the free passage of such fire truck or t~acks or apparatus or conveyances of firemen and so to remain until the same shall have fully passed. For the purpose of this Ordinance "Range Cattle are herein defined as those cattle reared or kept upon the great plains or mountains or other general unsettled country and undomesticated and not familiar with the oondixtions pertain- ing to industrial pursuits and the noises and confusion incident to thickly settled communities. Section 2. It shall be unlawful for any person,firra or corporation to undertake to drive or conduct any range cattle over or through or along the streets or highways of the City of Santa Ann with insufficient assistance, help or management so that said cattle shall become unmanageable or disorderly or shall in any manner go estray so as to endanger the public safety or damage to the property of any person or persons whomsoever. Section 3. It shall be unlawful for any person, firm or corporation shipping range cattle into or out of the City of Santa Ann to undertake to conduct or drive the same through or over or along the streets or avenues or alleys of said City without first having obtained a permit from the police department granting them ths right-of-way over certain streets and alleys of said City for the conduct of the same. Sectiond. When application shall have been made to the police department of the City of Santa Ana for permit to conduct "range cattle "over or through the streets of said City it shall be the duty of the police department to grant said per- mit and to deeiguate the street or streets or alleys or highways over which said cattle shall be driven and an officer of said department or the pound master or assistant pound master at the discr~ ion of the police department shall be present when said "range cattle" are being conducted and shall require that said cattle are conducted in accordance with the provisions and re- Quirements of said police department. Section §. That said person, firm or corporation having in charge or owning said "range cattle" before they shall receive the permit provided for in the precedinf section, shall pay into the police department of the City of Santa Aha the sum of $2.00, which shall be the compensation for the officer, pound master or assistant pound master who shall act in the sup~ - vision of the conduct of said cattle as provided in the preced- ing section. Section 6. It is hereby provided that in case of a failure of any firm or corporation in conducting "range cattle" any where within the limits of the City of Santa Aha, that should the same or any part of them escape from the custody or control of the person, firm or corporation owning the same ~r having the same in charge, that it shall be the duty of the pound master of the City of Santa Ana, or his assistant or assistants, as the case may be, to capture or restrain the said range cattle and the same will be at the expense of the person, firm or corporation own- ing said range cattle to the amount not to exceed $25.00 per head for each head of range cattle so restrained or captured. Section 7. Any person, firm or corporation ~ndertaking the conduct of said range cattle without the requirements as above provided or who shall in any manner fail or refuse or neg- lect to comply with any of the provisions of this Ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed $100.00 or be imprisoned in the City Jail f~ a period of 80 days or both in the discretion of the Court. Section 8. The City Clerk shall certify to the adoption Of the within Ordinance and shall cause the same to be published once in the "~vening Blade" a newspaper of general circulation in the City of Santa Ana, and thereupon and thereafter it shall take effect and be in force. Section 2. Whenever the words #Auto car" is used in this Ordinance it shall be considered as meaning any automobile, auto bus or motor bus for hire as the case may be, such as are in this 0rdi- nance sought to be regulated. Section 3. It is hereby declared to be unlawful for any per- son, firm or corporation to carry on the business of operating an auto car in the City of Santa Ana, without first having procured liability insurance in a reliable insurance company., the same to be approved by the Board of Trustees of the City of Santa Ana. Section 4. The liability insurance for each auto car carrying passengers as in this Ordinance specified shall be for standard limits of $§000.00 and $10,000, the policy designated shall be declared to be a standard limit of $5000.00 for any per- son injured and the total limit of $10,000 for any number of per- sons injured in any one accident. The policy shall provide for 13! and be made to cover all injuries to any person or persons that may be caused by such auto car. Section §. Any person, firm or corporation desiring to run or operate any auto car for the purpose of carrying passengers throujh oF over the streets of the City of Santa Ana shall first procure a permit from the Board of Trustees of said City for the said purpose; said permit to be procured in the following n~nner: The applicant for such permit shall file with the City Clerk an application in writint therefor stating: (A) The type of auto car intended to be used. (b) The horse power thereof. (c) The factory number thereof. (d) The State license number thereof. (e) The seating capacity thereof, according to its trade or factory rating. (f) The name of the person to be in immediate charge thereof as driver. (g) The age, residence and nationality of the driver. (h) The number of the chauffeur's license. (i) The streets or route over which said auto car is to be routed. Section 6. Upon receiving such application the clerk shall refer f~he same to the Board of Trustees who may in their discretion issue or refu~e to issue a permit thereon and whose decision thereon shall be final. ion before a permit will be issued the State license number plate muat the car is put in commission. Section 7. Upon the permit being granted by the Board of Trustses the applicant shall preseut the same to the City Clerk, who shall receive and file the same in his office, and the applicant x~xx thereafter before a license is issued to him shall present his policy of liability insurance to the Board of Trustees for its approval or disapproval and if the same shall have been approved by said Board of Trustees the same shall be presented to the City Clerk who shall endorse the number of each policy, the name of the Company and the agent's address and date of policy upon each respective per- mit and the City Clerk shall then and not till then issue a license to the applicant in conformity to and with the terms of the permit provided the license shall contain the same n~ber as the corres- ponding permit and the word "revocable" shall be plainly written or printed upon its face. Ail licenses now in force in the Oity of Santa Ana in favor of any person, firm or corporation for such business as is herein sought to be regulated shall cease to be in force from and after ~0 days from the date of the final pass- age of this Ordinance and provided at said time a license holder may have the unearned part of his license fee of tho license then in force refunded or may have the same applied upon the fee in the now license under this Ordinance. Section 11. If at any time during the life of any such license herein provided for, the holder thereof allows his lia- bility insurance to lapse or become inaffective or to terminate in whole or in part, then at the same time the license of such holder shall ipso facto become null and void. Section IS. Every person, firn~ or corPoration operating any such auto oar shall abide by each and all of the Ordinances, rules and regulations of the City of Santa Aha, and the laws of the State of Oaliforn~& now in force or that hereinafter may be ~ut in force calculated to regulate auto oars, as defined herein or motor vehicles used to convey passengers for hire. Ssction 1~. It shall be unlawful for any one by himself, agent or employee, to drive or operate, or to cause to be driven or operated any auto car if the driver or operator is less than 16 years of age. Section 14. It shall be unlawful for the driver of any auto car to run by any ether auto car for the purpose of beating the driver of another auto car to a prospective passenger or passengers. Section 1~. ~ach person, firm or corporation maintain- ing or operating an sure car must tag or label such auto car in- dicating the trip or route of the vehicle so labeled. Section 16. It shall be unlawful for any person,firm or corporation maintaining or operating an auto car to solicit patronage or publicly announce his trip or trips upon the street or streets of the Oity of Santa Aha in a loud or boisterous manner 133 or in any manner to disturb the quiet or peace of the people upon said street or to in any manner provoke or annoy any person or persons upon the streets of said City. Section 17. It shall be unlawful for any person, firn~ or corporation to deposit, store or stand any autp car as defined in this Ordinance upon the streets, alleys or avenues of the City of Santa Aha for any period of time longer than actually necessary to discharge a passenger or passengers at such a point as said passenger or passengers shall have indicated or to take on a passen- ger or passengers, which said passenger or passengers shall at such time be in waiting and then only to stop at a traffic corner. Section 18. If any section, sub-section, sentence,clause or phrase of this act is for any reason held to be unconstitutional such decision shall not affect the validity of the ren~ining por- tions of th~s Ordinance in that the Board of Trustees of the City of Santa Ana declares that it would have passed this Ordinance and each section, sentence, clause and phrase thereof irrespective of th~ fact that any one or more other sections, sentences, clauses or phrases be declared unconstitutional. Section 19. Any person, firm or corporation who shall violate any of the provisions of this Ordinance or who shall fail to conform to any of ttle provisions herein contained shall be deemed ~uilty of a misdemeanor and upon conv~ction thereof shall be fined not tc excsed $10C.00 or shall be liable to i~risonment in th~ Ci~y Jail not to exceed 50 days or shall suffer both said fine and in~risonment at the discretion of the Court. The City Marshal of said City of Santa Ana shall deliver said blank to the person from whom said reports are required from time to time, free of charge and shall upon receipt of said report file the same in some secure place in his office and the same shall be open to inspection only to the police department of said City, or upon order of some court duly made for that purpose.
