249 ORDINANCE NO. 6~6. AN ORDINANCE DIVIDING THE CITY OF SANTA ANA INTO TWFLVE MUNICIPAL ELECTION PRFCINCTS AND FIXING THE BOUNDARIES THEREOF. The Board ~f Trustees cf the City of Santa Aha do ordain as follows:- Section 1. The City of Santa An& is hereby divided into twelve Municipal Election Precincts and their boundaries axe hereinafter fixed as follows:- Section Z. Precinct No.1 shall include and embrace all of that portion of the City of Santa Aha located within the following described boundaries:- Beginning at the center line of North Main and l?th Streets, thence West on the center line of West l?th street to the center line of North Broadway; thence south on the center line ~f North Broadway~ to its intersection with west 5th Street; thence east on center line of West 5th Street to its intersection with North Main street; thence south on center line of North Main street to its intersection with ~rd street; thence east on center line of 3rd street to its intersection with French street; thence North on the center line of French street to its inter- sectioh with East Washington Ave. thence west on center line of East Washington Ave. to its intersection with Bush street; thence North on the center line cf Bush street to its intersection with East 17th street; thence west on center line of East l?th street to its intersection with North Main street, the point of beginning. Section 3. Precinct No.2 shall include and embrace all of that portion of the city of Santa Aha located within the following described boundaries: Beginning at the intersection of 10th street and Broadway; thence West on center line of West 10th street to the center line of North Ross Street; thence north on center line of North Ross street to a point opposite the center line of that portion of West 10th street which extends westerly from Ross street; thence west along the center line of West 10th street to Garnsey street; thence south on center line of North Garnsey street to its intersection with West 5th street; thence east along the center line of West 5th street to its intersection with North Broadway thence along the center line of North Broadway to its inter- section with West 10th street, the point of beginning. Section 4. Precinct No.3 shall include and embrace all of that portion of the city of Santa Aha located within the following described boundaxies: Beginning at the intersection of West 5th Street and North Broadway; thence West along the center line of West 5th Street to its intersection with North Parton Street; thence south along the center line of North Paxton street to its intersection with West First Street; thence west along the center line of West First street to its inter- section with South Flower Street; thence south along the center line of South Flower Street to its intersection with West Camile Street; thence East along the center line of West Camile Street to its intersection with South Broadway; thence North along the center line of South Broadway to its intersection with the center line of West First Street; thence North along the center line of North Broadway to its intersection with the center line of West 5th Street, the point of beginning. Precinct No. 12 shall include and embrace all of that portion of the city of Santa Ana located within the following described bottudarlee: Beginning at the intersection of First Street and Main street; thence along the center line of East let street to its intersection with Lyon street; thence south along the center line of Lyon street to its intersection with McFadden street; thence south along the city limits; thence west along the City limits to South Main street; thence north along the center line of South Main street to its intersection with let street the place of beginning. Section 14. Ali Ordinances or parts of Ordinsmces in con- flict with this Ordinance are hereby repealed. Section 15. The City Clerk shall cause this Ordinance to be published three times in the "Santa Aha Daily Evening Register" and thereupon and thereafter it shall take effect and be in force. This Ordinance being one that is urgent and otherwise expressly required by the laws of the State of California. Said City Clerk shall cause to be made not less than two (2) publications of said list in each of said newspapers before Election Day, one of which publications must be made upon the last day upon which said newspaper is issued before the day of election. The list of nominations published by him as aforesaid shall be arrsmged in the order and form in which they will be printed upon the ballot. The City Clerk shall also procure and cause to be printed sample ballots setting forth the list of nominations for office filed with him, arranged as they will be arranged on. the regular election ballot, and he shall within the time and in the manner provided for by law send one of such sample ballots to each qualified elector of said city. The City Clerk shall furnish twelve cards .of instruction to the Boards of Election in each precinct of said City at the se.me time and in the same manner as the printed ballots. The Boards of Election shall post at least one of such cards in each such booth or compartment provided for the preparation of abllots and not less than three of such at other places in and about the polling places on the day of election. It shall be unlawful for shy person, firm or corporation to keep, deposit, store or stand any vehicle upon that portion of North Main Street on the West half thereof and within that certain space from the North curb line of Fourth Street produced to a line p~rallel therewith and 112 feet North thereof. That for the purpose of putting this Ordi- nance in force and effect the West district is hereby restricted from the uae of water for sprinkling or spraying or irrigation of lawns, streets, walks and gardens during the months of June, July and August of each year, to Mondays, Wednesdays and Fridays, and the East dis- trict is restricted from the use of water for said purposes on Tuesdays, Thursdays and Saturdays of each week, except all public grounds and public improvements. Section 3. Any person, firm or corporation either by themselves or agent, who shall fail to comply with the provisions of this Ordinance shall be guilty of a misdemeanor and fined in a sum not to exceed $30.00, or imprisoned in the County Jail for ten days or both in the discretxon of the Court. Section 4. All Ordinances or parts of Ordinances or rules or regulations as the same may conflict with this Ordinance are to that extent hereby repealed. Section 5. This Ordinance being of imperative and pressing need, in order to protect the welfar~e and interests and health and safety of the citizens of Santa Aha, and of special im- portance shall be in full force and effect after its publication as provided by law. AN~ PARTS OM ORDINANCES IN CONFLICT THFRMWITH. The Board of Trustees of the City of Santa And do ordain as follows to-wit: Section 1. It shall be unlawful for any person, firm, corporation, owner, lessee, or occupant to burn rubbish, waste- paper, rags, excelsior, straw, grass, weeds, or any other inflammable or combustible material within Fire District No.1. Section 2. It shall be unlawful for any person, firm, corp~ation, owner, lessee or occupant to burn rubbish, waste paper, raga, excelsior, straw, grass, weeds or any other inflammable or combustible material within the corporate limits of the City of Santa And, California, at any other time than between the hours of six o'clock a.m. and ten o'clock a.m. and then only at a distance of 15 feet from any building or other combustible structures. Section 3. It shall be unlawful for any person, firm or corporation as owner, agent, tenant, lessee building or any lot, within the fire limits of Ana, California, to permit rubbish, waste paper, or occupant of any the City of Santa straw, ags, excelsior, or junk or any other waste or inflammable or combustible materials to accummulate upon any roof, or in any room, basement, hall, closets or light wells of any buil~inE, or to p~rmit dry weeds or grass or other rubbish to accummulate on any lot or premises nearer than l0 fe~t of any buildin8 or other structure within the fire district. Section 4. It shall be unlsw£ul for any person, firm or corporation to maintain or conduct any store, wherein any goods, wares or merchancise composed of combustible materials are kept or offered for sale unless there is maintained unobstructed aisles not less than fcur (~) feet wi~e from the front entrance to rear exit, together with sufficient cross aisles not less than three (3) feet wide each, so as to provide ample passageways therein, provided further that said goods, wa~es and merchandise shall not be piled up nearer the ceiling of said store room than three (3) feet. It shall be thc duty of the chief of the fire department or his assistants to notify in writing the ~wner, agent, tenant, lessee or occupant of such building, lot or premises in or upon which such acoum~lstions are found to remove s~ne forthwith and the persons receiving such notice shall w~thin 12 hours after receiving the same, comply with the requirements thereof. Section 5~ Provided further, that no person or persons shall make or cause to be made any open Elre for burning rubbish or weeds or combustible m~ter~al on any streets, alleys or sidewalks within the City of Santa And, California. P~ovlded further, that no pumps or other devices for hsndling gasoline, petroleum, crude oils or other oils shall be installed or used on any street or sidewalks within the City of Santa And, California, unless specific permission shsl~ have first been obtained from the Board of Trustees of the City of Santa Aha, California. Section 6. Regulating the construction ani use of buildings occupied as garages, clothes cleaning establishments ~nd the storsge and use of g~oline in connection therewith. Definitions and miscellaneous provisions: The following terms shall have the following meaning in this Ordinance to-wit: (~)"Chief of fire department" means chief of the fi~e department of the City of Santa Rna, California, or any one of his assistants. (b) "Approved" means approved by the chief of the fire department. (c) "Gasoline" means any product or any hydro-carbon liquid that will flash or emit an inflammable vapor below the temperature of one hundred and ten (110) degrees Fahrenheit. (d) An "automobile" is any motor vehicle using gasoline or distillate for generating motive power. (e) A "public garage" is a building where motor vehicles are kept or stored or where a cherge is made for use or storage of automobiles. (f) A "private garage, is a building where an automobile or automobiles ~re kept for private use only and not rented nor hired out to the public nor any charge made for keeping the s~ne. (g) "Private Gareges" where more than two automobiles are kept or stored shall be subject to the same requirements as specified for public garages. (h) A "Gara~e" shall include both a public ~nd private garage. (i) "Clothes cleaning establishment~" shall mean any building or premises where more than one (1) quart of gasoline is kept to be used for cleaning or renovating any clothing or articles of wearing apparal or fabric of any kind including dye works and tailor shops. (k) "Standard test" means will not flash or emit an inflammable vapor below one hundred ~nd ten (llO) degrees Fahrenheit, the fire chief shall determine the flashing point. - (i) The provisions of this Ordinance shall ap~ly to buildings now existing as well as any hereafter constructed. Section ~. Garages, filling stations, clothes cleaning establish- merits. (a) Permits. It shall be unlawful for any person, firm or corpo- ration hereafter to conduct or maintain any garage, filling station, or clothes cleaning establishment w~thout first obtaining a permit therefor from the Board of Trustees of the application for a permit shall be of the permittee and the loc~tion City of Santa Aha, California. The in writing and shall specify the name of the premises to be u~ed a~ an automobile garage, filling station, or clothes cleaning establishment, ~:d the amount of gasoline that may be stored in said premises. No gasoline shall be kept or stored in or about any garage, filling station or clothes cleaning establishment, except as authorized ~ such permit and provided for in this Ordinance. (b) Protection. 1. There shall be in every public garage and clothes cleaning establishment one chemical fire extiinguisherm of not less than three gallons each where the floo~ space is less than One thouse, nd square feet, and one additional chemical flre extinguisher for each additlonal 1000 square $. Every public at least two hundred pounds feet of floor space or fraction thereof. garage shall also have on hand at all times of clean sand w~th one hand scoop ~n each barrel or box of sand to be pla~ed in different parts of main floor and repair shop, if any, such sand when saturated with ell or gasoline shall be removed from the building. The use of sawdust for absorbing oils in any garage shall be prohibited,~except for sweeping only). Every garage and clothes cleaning establishment must at con~'orm to the fo]%owiug regulations: 1. No gasoline shall be allowed tc remain in mny open receptacle of any kind in or about the garage or establishment. 2. No gasoline shall be put into cr where there is mn open light or when the engine is in momentum. Regulations for automobile garage and clothes cleaning eetabllsh- taken out of any automobile establishment. A notice in large letters "No Smoking" shall be dis- played in a conspicuous place and m~nner on the floors and at all entrances to any clothes cleaning establishments. 6. Handling Gasoline. Gasoline up to twenty-five gallons in amount may be kept inside of a garage and one gallon in any clothes cleaning establishment; provided thmt they are kept in safety metal containers, 7. Gasoline may be kept in approved portable filling tanks inside of a garage. No such filling tank shall have a capacity to exceed fifty (50) gallons. Every approved portable filling tank be amounted on all metal wheels with rubberJtires and shall be shall equipped with an approved pump fitted with hose attachment not to exceed eight ($) fc~t in length with shut off nozzle. The gasoline shall be pumped into the reservoirs of the ~utomobile from such approved wheel tanks. Such portable wheel tanks when not in use must be kept near the entrance of the building. 8. Storage of gasoline. Except as hereinafter provided, all gasoline other than that contained in the tanks of automobiles shall be kept in underground tanks in accordance with the fo]lowing speci- fications: (1) No single tank shall have a capacity of more than three hundred (300) gallons of gasoline. (2) All gasoline storage tanks shall be constructed of at least 12 guage galvanized steel or one quarter (4) inch black open hearth stock. Provided tanks lees than 300 gallons may be constructed of less th~n 1/4" steel. (3) All tanks made of galvanized steel shall be carefully riveted and soldered. All tanks made of black steel shall be carefully riveted and calked. (4) All tanks shall Ce coated on the outside with asvhaltum or oti.er rust-resisting material. (~) There shall be no openings or connections of any tank except on the top thereof, smd no tank shall be connected either directly or indirectly with any drain, catch basin, public or private sewer. (7) Where the space under the sidewalk is excavated for use as part of a basement, tanks shall rest on earth, with no floor underneath, and shall be surrounded on the sides with a concrete wall not less th~u twelve (l~) inches thick, extending from the base o£ the excavation to four (4) feet above the top of the tank. The space between the~ top o[ the tank and the top o£ the wall shall be filled with earth, and the earth covered with at least three (3) inches of concrete. (g) ,~ere more th~u one tank is installed, the tanks shall be separated by at least twelve (12) inches of earth, all well tamped in place. The tor~ of every t~nk shall be below the level oF the lowest pipe line in the building used in connection with the equi,~ment, not to have connection with each other. (9) No ~torage tank shall be covered with earth until an inspection has been made and approval in writing signed by the chief o£ the fire department. (10) Any storage tanks sh~l~ be provided with one (1) inch diameter galvanized iron vent pipe, same to be connected to top of the tank. (12) Filler pipes shall be made of galvanized iron piping, which pipes shall enter at the top and extend to the bottom of the tank. The upper end o~' such filler pipe must terminate in a screw cap securely locked. (13) When filler pipe runs to Bi~ewalk or to alle~or to other public highway, it shall terminate in a screw cap securely locked, and be pro- tected by a cast iron filler box, which shall be flush with the sidewalk or alley of the highway. (14) All pipes shell be galvanized and put together with litharge ~,d glycerine. (g) Pumps- Gasoline shall be drawn from storage tanks only by automatic closing valve pumps. Such pumps must be located above the top of the tanks. Section g. AN ORDINANCE OF TH~ CITY OF SANTA ANA, CALI¢ORN!A, AMENDING SECTION 9 and PARAGRAPH 4 of SECTION 6 of ORDI}YANCE No.626, PERT~.INING TO SERVICE WIRES AND CABINET~. The Board of Trustees of the City of Santa Ana, California, do ordain as follows:- Sec.1. That paragraph 5 of Section 6, of Ordinance No.626, adopted and approved by the Board of Trustees of the City of Santa Aha, California, on the 21st day of May,1917, be amended to read as follows: All service wires in buildings not in Fire District No.1, shall be brought in in rigid conduit to the main service switch. All service switches both light and power must be externally operated and to be located in a ready, safe and accessible place. All cut out and branch blocks must be inclosed in metal cases or cabinets where there is but one circuit a branch block in addition to the main line will not be required. Doors of all switch and cut out cabinets must be hinged at the sides and so located that the highest part of any service switch or cut out will not be more than 6 feet above the floor. All switches must be so connected that when switch is open blades and fuses will be dead and so arranged that gravity will not tend to close them. Section 2. Section 9 of the same Ordinance shall be amended as follows: It shall be unlawful for any person, firm or corpora- tion as principal, agent, officer, servant or employee, for him- self or itself, or for another person, firm or corporation to install, alter, repair, add to, connect with or chan~e, energize or utilize any inside electrical wiring, connections, fixtures, appliances, apparatus, mschinery, equipment, or work, or to in- stall any electrical meter or service wires without first securing a certificate therefor, as in this ordinance provided. It shall be unlawful for any person, firm or corpo- ration engaged in the business of selling second-hand goods to sell or offer or expose for sale or cause or permit to be sold, offered or exposed for sale any used or second-hand mattress unless said mattress has been thoroughly sterilized and disinfected by a reasonable process approved by the Health Officer of the City of Santa Aha, California. Section 2. It shall be unlawful for any person, firm or corpo- ration .engaged in the business of the sale of second-hand furniture or furnishings to sell, offer or expose for sale or to cause or permit to be sold, offered or exposed for sale any used or second hand mattre~ unless same has plainly and indelibly stamped or printed thereon or upon a muslin or linen tag not smaller than 2X3 inches in dimensions and securely sewed to the covering of such mattress ~ statement in the Engl~h language setting forth the time, place aud process of sterilizing said mattress and the name of ~he person, firm or corporation sterilizing mattress and that the same has been approved by the Health Officer of the City cf Santa Ans. The statement required under the provisions of this Section shall be in the following form: "This used or second-hand mattress has been sterilized with on the __ day of __ 19 Approved by Health Officer of the City of Santa Ana,California, in compliance with Ordinance No.__ of the City of Santa An~,California." Section ~. It shall be unlawful for any person, firm or corpo- ration to refuse to allow the Health Officer or his deputies to enter any premises or place where used or second-hand mattresses are sold, offered or exposed for sale for the purpose of examining and inspecting any sud~ mattresses. 265 For the purposes of this Ordinance the term "mattress" ie hereby deemed to be and include any quilted pad, comforter, mattress pad, bunk quilt, pillow or cushion stuffed or filled with wool, hair, cotton or other soft materials to be used on or form part of a couch or other bed for sleeping or reclining purposes. Section 4. Under the provisions of this Ordinance when the Health Officer or his deputies shall be required or it shall become necessary for said officer to personally fumigate, sterilize or dieinfe~ any mattress or mattresses as defined herein, there shall be a minimum charge of 50 cts. and in addition thereto any expense for material, toc~ or appliances, sufficient for performing such sterilization made payable to the City of Bant~ Ans. Section 5. Any person, firm or corporation violating any of t~ provisions of this 0rdinanoe shall be guilty of m misdemeanor and fined in a sum not to exceed $50.00 or by imprisonment in the County Jail not exceeding 20 days. That a franchise Atchison, Topeka and Santa Fe Railroad, to construct, maintain and operate for is hereby granted to the its successors and assigns, a period of fifty (50) ye~s, a single railroad spur track over and across Brown Street in the City of Santa Ana, and described as follows: "Beginning at a point in the center line of the Main Track of the A.T. & S.F.Ry. Company's to San Diego,California, at Engineer's Station 259? plus 28.69, thence northerly on a Zangent curve concave to the east with a radius of ~42.291 feet, a distance of 63.9? feet to a point in the southerly line of Brown Street distant easterly y4.9y feet from the intersection of said southerly street line w~h the westerly line of said Railway Company's 100 foot right-of-way; thence continuing northerly across Brown Street on said curve a (Lis- tance of 53.57 feet; thence northerly tangent to said curve a distance of 6.? feet to a point in the northerly line of Brown Street dis- tan~ easterly 80.54 feet from the intersection of said northerly street line with the westerly line of said Railway Company's 100 foot right-of-way thence continuing northerly on said tangent a distance of 5?.39 feet; thence northerly on a curve concave to the west with a radius cf 603.805 feet a distance of ?5.26 feet; thence northerly tangent to said curve and parallel to the center line of the afore- said ~ain Track and distant 20 feet easterly therefrom a distance of 219.11 feet to the end of the track." Section 2. That no cars or locomotives shall be permitted at any time to remain upon the portion of track located in the public street except only during the time required for switching oars upon such spur trac~, and that the said spur track shal~, at all times, be so used as to obstruct the use of the said street by vehicles or pedestrians as little as possible. Section 3. That this franchise is granted the said Atchison. Topeka and Santa Fe Railroad with the understanding th~ the said spur be constructed under the supervision of the Street Superintendent and maintained in such a manner as to prevent the least obstruction or inconvenience to the traveling public, and at all times keep the crossing and approaches thereto in good and safe condition, and the said Railroad will at its own cost and expense improve said track between the rails and for two feet on each side thereof with the same materials used by the City, and under the ~me specifications as the rest of the street adjacent to said track may be improved. Section 4. And it will keep the said track in repair, and shall make the roadbed conform at all times to the establish~ grade of the said street, and shall construct all necessary flumes and culverts for the free passage of water under the tracks where the same naturally flows and that such flumes and culverts shall b s constructed in accordance with plans and specifications approved by said Board of Trustees. Section 5. The City Clerk shall certify to the passage of this Ordinance and cause the same to be published 3 times in the Santa Ana Daily Evening Register and thereupon and thereafter it shall be in full force and~efI'ect. It shall be unlawful for any person operating or in charge of any automobile, motor vehicle or other vehicle to suffer or permit any such vehicle to stand or remain standing upon any other portion of the public street in the City of ~anta Aha, California, within the district above ~efined and in the m~uner above indicated and ewpecially provided for, otherwise than parallel to the curb and with the center of the tread of the £ire farther than 1~ inches from the face of the curb. Section 2~. That a diagram indicating the provisions of this Ordinance as to the parking of said cars and the restrictions therein contained as to reserved sections of those certain portions of the streets of the City of Santa Aha, California, covered under the pro- visions of this Ordinance~ is attached hereunto and made a part hereof and a copy of the same sh~all be posted and filed in the office of the City Marshal of the City of Banta Aha, California. Section 3. Any person or persons, firm or corporation, either by themselves, ~gent or employee, violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and punished by a fine not exceeding,~.O0, or by imprisonment in the County J~l not exceeding 15 days ~i~-'~the discretion of the Court.
