AND SULLIVAN STREET, RESERVING AN OVERHANG
EASEMENT THEREIN, AND GIVING NOTICE OF HEARING
THEREON
WHERF2%S, on recommendation of the Planning Department and
the Department of Public Works for vacation of street easement
dedicated by the property owner and now declared to be surplus, it
has been determined that said street easement should be returned
to the property owner.
NOW, THEREFORE, B~ IT RESOLVED: That the City Council hereby
approves the map attached hereto and orders the same filed with the
original of this Resolution in the office of the Clerk of the Council,
declares its intention to proceed with this vacation under the
provisions of the Street Vacation Act of 1941 (§8300 through §8374 of
the California Streets and Highways Code) to vacate a portion of
street right of way on the south side of McFadden Avenue, east of
Sullivan Street, and reserving therein an overhang easement for
transmission of electrical energy and electrical ccaumunication for
the Southern California Edison Company. Said easement lies in the
City of Santa Aha, County of Orange, State of California, and is
described as:
Those portions of lots 1 and "X" in Block "A" of Tract No. 604,
in the City of Santa Aha, County of Orange, State of California,
as per map recorded in Book 24, Page 19 of Miscellaneous Maps,
in the office of the County Recorder of said County, lying
northerly of the following described line:
Beginning at the intersection of the East line of said Lot 1
with the South line of the North 10.00 feet of said lots; thence
West along said South line to a point East 15.00 feet from the
West line of said lot "X"; thence southwesterly on a direct line
to a point on the West line of said lot "X" southerly 15.00 feet
from the northwest corner thereof.
EXCEPT that portion thereof lying northwesterly of a curve
concave southeasterly having a radius of 25.00 feet which is
tangent to the West and North lines of said land.
BE IT FURTHER RESOLVED: That June 21, 1965, at the hour of
7:30 P.M. in the Council Chambers, City Hall, Third and Main Streets,
Santa Aha, California, is hereby fixed as the time and place for
hearing all persons interested in or objecting to said proposed
street vacation.
The Clerk of the Council is hereby ordered to publish this
Resolution once in The Register and the Director of Public Works is
ordered to post notices of street vacation conspicuously along the
line of said streets stating the passage of this Resolution of
Intention to vacate and the time and place of hearing thereon. Said
notices shall be posted not more than 300 feet apart and at least
three such notices shall be posted. Both publication and posting
shall be completed at least ten days before the date of said hearing.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 17th day of May, 1965.
