RIGHT OF ~AY FOR THE C-5-F DRAINAGE CHANNEL
WITHIN THE CITY OF SANTA ANA
WHEREAS, in order to continue the construction of a portion
of the storm drains of the City, to wit: the C-5-F Drainage Channel,
it is necessary to acquire one parcel of real property in fee title.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana hereby finds and determines that the public
interest and necessity require the construction of certain drainage
facilities, require the acquisition of a right of way for the
location of a storm drain and storm water structures in fee simple,
and said City Council hereby orders that the City do have, take and
acquire, in fee simple, the real property in the City of Santa Ana,
County of Orange, State of California, described as:
The southerly 35.00 feet of the east half of the northeast
quarter of the northeast quarter of Section 16, Township 5 South,
Range 10 West, in the Rancho Las Bolsas, as shown on a map
recorded in Book 51, Page 12, of Miscellaneous Maps, Records of
Orange County, California.
EXCEPTING THEREFROM the easterly 50.00 feet.
BE IT FURTHER RESOLVED:
1. That the City Attorney is hereby ordered to bring an
action in the name of the City to condemn said property necessary to
be taken and to do all things necessary to prosecute said action to
final determination;
2. That public interest, necessity and convenience require
and it is hereby ordered that said City take immediate possession
and use of the property herein ordered to be acquired upon compliance
with the requirements of law applicable thereto as a right of way
for public use;
3. That said public improvement is planned and located in a
manner which will be most cempatible with the greatest public good
and the least private injury;
4. That the City of Santa Ana is authorized and empowered
to provide for drainage structures and rights of way for the
removal of storm waters from the City;
5. That said action in condemnation shall be taken in ac-
cordance with the provisions of the Code of Civil Procedure and the
Constitution of the State of California relating to eminent domain.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 17~th day of May, 1965.
