DEDICATION, AND AN INDENTURE, ALL WITH NO CASH
CONSIDERATION, AND AUTHORIZING EXECUTION OF
AMENDMENT TO ESCROW INSTRUCTIONS
WHEREAS, BANK OF AMERICA NATIONAL TRUST AND SAVINGS ASSOCIATION,
a national banking association, has delivered to the City a deed dated
June 25, 1965, conveying an easement for street purposes at the
southwest corner of Ninth and Bush Streets and an easement for street
purposes at the northwest corner of Eighth and Bush Streets; and
WHEREAS, KENNETH C. TUCKER and LOIS R. TUCKER have delivered
to the City a deed dated August 3, 1965, conveying vehicular access
rights to Fifth Street, west of the Santa Aha River; and
WHEREAS, FREDERICK R. SACHER and RUTH F. SACHER have delivered
to the City a deed dated July 28, 1965, conveying an easement for
water main purposes for Stevens Avenue, 372 feet east of Main Street;
and
WHEREAS, FRED R. CERMAK and FLORENCE S. CERMAK have delivered
to the City two (2) deeds dated August 5, 1965, conveying easements
for street purposes at the southwest corner of Bristol and Walnut
Streets, and an Offer of Dedication dated August 5, 1965, for alley
purposes at the southwest corner of Bristol and Walnut Streets, said
Offer of Dedication to expire on May 19, 1975, unless previously
accepted by the City; and
WHEREAS, SOUTHERN PACIFIC COMPANY, a corporation of the State
of Delaware, has delivered to the City an Indenture dated July 13,
1965, granting an easement for Edinger Avenue across the Southern
Pacific Company's Santa Aha-Dyer line; and
WHEREAS, all of said instruments are without cash consideration
being paid to said grantors by the City;
NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Ana
accepts said instruments and Carl J. Thornton, the City's designated
agent, is directed to place his Certificate. of Acceptance on said
instruments.
BE IT FURTHER RESOLVED: That the Mayor is hereby authorized
to sign the Amendment to Instructions to Escrow No. 52781-C in
connection with an exchange of properties between JULIA M. STILLINGS
and the City of Santa Ana.
