HomeMy WebLinkAbout65-133RESOLUTION 65-133 ORDERING VACATION OF A PORTION OF STREET RIGHT OF WAY ON THE SOUTH SIDE OF EDINGER AVENUE, 185 FEET WEST OF FLOWER STREET, AND RESERVING THEREIN A PUBLIC UTILITIES EASEMENT WHEREAS, on recommendation of the Planning Department and the Department of Public Works, Resolution 65-114 was adopted giving notice of intention to vacate certain street right of way and giving notice of a public hearing thereon; and WHEREAS, said public hearing was duly held on the question of said street vacation on both published and posted notices as required by law and, after hearing, the City Council determined that said right of way should be vacated. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Aha does hereby find that that portion of street right of way on the south side of Edinger Avenue, 185 feet west of Flower Street, hereinbelow described, is unnecessary for present or prospec- tive street purposes and does hereby make its order abandoning and vacating the same reserving therein an easement for the utility structures of the Pacific Telephone Company and the Southern California Edison Company; that that certain property in the City of Santa Ana, County of Orange, State of California, described as: The Southerly 27.00 feet of the following described property: Beginning at a point on the mon~mented center line of Edinger Avenue, South 89° 28' 50" West 185.00 feet from the intersection of said center line of Edinger Avenue with the center line of Flower Street, and running thence South 89° 28' 50" West 55.86' feet; thence South 0° 11' 30" East 40.00 feet; thence North 89° 28' 50" East 55.94 feet;.thence North 0° 18' 20" West 40.00 feet to the point of beginning. RESERVING all vehicular access rights to Edinger Avenue from the lands lying South of the North line of the above described property, EXCEPTING the West 28.00 feet. ALSO RESERVING AND EXCEPTING an easement and right of way to construct, lay, install, use, maintain, alter, add to, repair, replace, inspect, and/or remove, at any time and from time to time, aerial and underground electric lines and communication lines, consisting of poles, guys and markers and other fixtures and appliances, for conveying electric energy to be used for light, heat, power, telephone, and/or other related uses, in, on, over, under, and through that certain real property in the City of Santa Ana, County of Orange, State of California, de- scribed as follows; A strip of land, 10 feet in width, lying within the southeast quarter of the northwest quarter of Section 24, Township 5 South, Range 10 West, S.B.B.&M., the center line of said strip being described as follows: Commencing at the northeast corner of said southeast quarter of the northwest quarter of Section 24; thence along the easterly line of said southeast quarter of the northwest quarter of Section 24, southerly 42 feet; thence westerly parallel with the northerly line of said southeast quarter of the northwest quarter of Section 24, a distance of 40 feet, to the TRUE POINT OF BEGIN- NING of this description; thence northwesterly to a point located 185 feet westerly and 27 feet southerly, measured at right angles respectively from said easterly and northerly lines; thence westerly parallel with said northerly line a distance of 55.94 feet, be and the same is hereby vacated for street purposes.
