HomeMy WebLinkAbout65-150RESOLUTION 65-150 AUTHORIZING CONDEMNATION FOR STREET PURPOSES FOR THE WIDENING AND IMPROVING OF EIGHTH STREET AT BRISTOL STREET WHEREAS, the increasing volume of vehicular traffic in and around the Civic Center area requires that Eighth Street be widened and improved to afford ingress to and egress from said area on Eighth Street across Bristol Street. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Aha hereby finds and declares that the public interest and necessity require the acquisition of rights of way for all the purposes of a public street in,through, and over certain parcels of real property in the City of Santa Ana, County of Orange, State of California, described as: PARCEL 1: That portion of Lot 26, and the East 25.41 feet of Lot 27, of Tract No. 662, in the City of Santa Aha, as shown on a map thereof, recorded in Book 24, page 17, of Miscellaneous Maps, records of Orange County, California, lying northerly of a line which is parallel with and 40 feet southerly, measured at right angles, from the following described new center line of Eighth Street: Commencing at the intersection of the survey center lines of Eighth Street and Bristol Street, as shown on map of said Tract No. 662; thence westerly along the survey center line of Eighth Street a distance of 244.75 feet to the TRUE POINT OF BEGINNING, and to a point on a tangent curv~ concave southwesterly and having a radius of 1,000 feet; thence southeasterly along said curv~ through a central angle of 7° 01' 18" an arc distance of 122.55 feet to a point of reverse curvature with.a curv~ concave northeasterly, having a radius of 1,000 feet; thence southeasterly along said curve, through a central angle of 7° 01' 18" an arc distance of 122.55 feet to a point on the survey center line of Bristol Street which is 15 feet southerly measured at right angles from said survey center line of Eighth Street. PARCEL 2: A spandrel shaped parcel of land bounded on the North by the South line of Parcel 1, bounded on the East by a line parallel with and 50 feet Westerly, measured at right angles, from the survey center line of Bristol Street as shown on map of said Tract NO. 662, and bounded South- westerly by the arc of a curve concave Southwesterly, having a radius of 25 feet and tangent to said North and East boundaries. PARCEL 3: A strip of land 25 feet in length, more or less, bounded on the North by the South line of Parcel 1, bounded on the West by the East line of Parcel 2, bounded on the East by a line parallel with and 10 feet East, measured at right angles, from the East line of Parcel 2, bounded Southerly by the Easterly extension of the radial to the Southwesterly boundary of Parcel 2 at its most Southerly point. PARCEL 4: A temporary easement for the complete removal of improve- ments existing in whole or in part on Parcels 1, 2, and 3, next hereinabove described, including any part of any suc~ improvement existing on the real property retained by the owners of said real property; said temporary easement to allow said City of Santa Ana the right to enter in and upon all portions of that property retained by said owners lying southerly of said Parcels 1, 2, and 3, and said temporary easement to terminate not later than 60 days after the City of Santa Ana is granted possession of said Parcels 1, 2, and 3 and this temporary easement. BE IT FURTHER RESOLVED: 1. That the City Attorney is hereby ordered to bring an action in the name of the City of Santa Ana to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination; 2. That the City of Santa Ana is authorized and empowered to acquire, develop, maintain, improve, and repair streets within the City; 3. That said public improvements are planned and located in a manner which will be most compatible with the greatest public good and the least private injury; 4. That said action in condemnation shall be taken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain; 5. That public interest, necessity, and convenience require, and it is hereby ordered, that said City take immediate possession and use of the. property herein ordered to be acquired for street purposes upon compliance with the requirements of law applicable thereto as rights of way for public streets.
