BRO~qq TO PLACE ON THE CALL FOR THE SPECIAL
LEGISLATIVE SESSION THE QUESTION OF MAKING IT
A FELONY TO POSSESS, THROW, OR USE ANY FIRE
STARTING DEVICE OR "MOLOTOV COCKTAIL"
WHEREAS, Chapter 1916 of the Statutes of 1961 added to the
Penal Code Section 653 1 making it a misdemeanor to possess a fire
bomb; and
WHEREAS, the recent criminal activity involving extensive
use of fire bombs in the form known as "Molotov Cocktail" in
Los Angeles County has demonstrated the willingness of many persons,
a large percentage of them minors, to make and use this simple
incendiary device.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SANTA ANA:
That said City Council hereby requests and urges Governor
Edmund G. Brown to include in his call for the next special
legislative session consideration of an act to make it a felony to
possess, throw, or otherwise use, or attempt to use, any incendiary
device for a criminal purpose, and that the definition contained
in Penal Code Section 653 1 be included to expressly provide for
"Molotov Cocktails";
That the Legislature be requested to include the safeguards
contained in said Section 653 1.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 1st day of November, 1965.
