HomeMy WebLinkAbout65-179RESOLUTION 65-179 A~£HORIZING CONDemNATION OF AN EASemENT FOR STP~EET PURPOSES ON THE NORTH SIDE OF EIGHTH STREET, WEST OF BRISTOL STREET WHEREAS, the rapid expansion of the Civic Center area of the City and the continuing increase in traffic volume has made it necessary to widen Eighth Street to provide for the present and prospective traffic demands; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby find and determine that the public interest and necessity require that Eighth Street be widened on the north side, west of Bristol Street,and does require that said City do have and acquire an easement for street purposes in, over, through and across that certain real property in the City of Santa Ana, County of Orange, State of California, described as: That portion of the Northeast quarter of the Southeast quarter of Section 11, Township 5 South, Range 10 West, San Bernardino Base and Meridian, in the City of Santa Ana, described as follows: Commencing at a point 40.60 chains South of the common corner of Sections 1, 2, 11, and 12, Township 5 South, Range 10 West, San Bernardino Base and Meridian, thence West 263.45 feet; thence South 363.92 feet to the true point of beginning; thence East 46.24 feet to the beginning of a tangent curve concave South- westerly, having a radius of 1,040.00 feet; thence Southeasterly along the arc of said curve through a central angle of 0° 28' 57" an arc distance of 8.76 feet to a point on a non-tangent line; thence South 39.63 feet to the center line of Eighth Street as shown on Tract 662, recorded in Book 24, Page 17, Miscellaneous Maps, records of Orange County, California; thence Westerly 55 feet along said center line of Eighth Street; thence North 40 feet to the true point of beginning. EXCEPTING '~HE~EFROi~ that portion previously dedicated for street purposes. BE IT FURTHER RESOLVED: 1. That the City Attorney is hereby ordered to bring an action in the name of the City of Santa Ana to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination; 2. That the City of Santa Ana is authorized and empowered to acquire, develop, maintain, improve, and repair streets within the City; 3. That said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury; 4. That said action in condemnation shall be taken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain; 5. That the public interest, necessity, and convenience require, and it is hereby ordered, that said City take immediate POSSeSsion and use of the property herein ordered to be acquired upon compliance with the requirements of law applicable thereto as right of way for public street.
