HomeMy WebLinkAbout62-001 1 4 6 10 11 14 15 17 19 2O 21 22 24 25 26 27 28 30 31 ~2 RESOLUTION NO. 62-1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANAt CALIFORNIA, GRANTING CONSENT TO THE CITY OF FOUNTAIN VALLEY FOR THE EXTENSION OF THE WORK OUTSIDE THE BOUNDARIES OF THE CITY OF FOUNTAIN VALLEY AND INTO THE TERRITORY OF THE CITY OF SANTA ANA FOR THE CONSTRUCTION OF DOMESTIC WATER FACILITIES IN "CITY OF FOUNTAIN VALLEY-WATER ASSESSMENT DISTRICT NO. 1," AND APPROVING PROPOSED RESOLUTION OF INTENTION OF THE CITY OF FOUNTAIN VALLEY FOR S~T~ ,~ORK. WHEREAS, the City Council of the City of Fountain Valley has by its Resolution No./O gq , adopted on January 2, 1962, requested consent for the extension of the work outside the boun- dary limits of the City of Fountain Valley and into territory with- in the boundary limits of the County of Orange, the City of Huntington Beach, the City of Westminster, the City of Garden Grove and the City of Santa Ana, for the construction of domestic water facilities and all appurtenances and appurtenant work, in "City of Fountain Valley-Water Assessment District No. 1," and has further requested consent and approval to proceedings for the said proposed construction and to the exercise of jurisdiction by the said City Council of the City of Fountain Valley to all the proceedings necessary or proper for the purpose of consummating the same, all in accordance with the provisions of the "Improvement Act of 1911," being Division 7 of the Streets and Highways Code of the State of California; and WHEREAS, the City of Fountain Valley has submitted to this City Council a certified copy of its said Resolution No. and a copy of its proposed Resolution of Intention for said work, and a copy of the plans and of the plat of the assessment district, and has requested approval thereof, and it appears from an examina- tion of the proposed Resolution of Intention, the plans and the plat,, that although the work and improvements proposed to be con- structed will extend outside the boundaries of the City of Fountain -1- 1 £ $ 4 5 6 8 9 10 ].4 15 3.6 20 22 24 25 26 27 28 29 30 Valley, the proposed assessment district will not extend outside the boundaries of the said City of Fountain Valley; NOW, THEREFORE, pursuant to the provisions of Sections 5115 to 5118, inclusive, of said "Improvement Act of 1911," the City Council of the City of Santa Ana does hereby RESOLV~ and ORDER as follows: Section 1: That the consent of the City Council of the City of Santa Ana is hereby granted to the City of Fountain Valley for the extension of the work and improvements in the proposed "City of Fountain Valley-Water Assessment District No. 1" outside the boundaries of the City of Fountain Valley and into the terri- tory within the boundaries of the City of Santa Ana, as shown in the aforementioned plans and the proposed Resolution of Intention. Section 2: That consent is further hereby given to the assumption by the City of Fountain Valley and its City Council of jurisdiction for all purposes of the proceedings under the said "Improvement Act of 1911,# and consent, approval and authority is hereby given and granted to the City Council of the City of Fountain Valley to take each and every step required for and/or suitable for the extension of the work outside the boundary limits of the City of Fountain Valley and within the boundary limits of the City of Santa Ana, and for the levying, collecting and enforce- ment of the assessments to cover the expenses thereof, and the issuance and enforcement of bonds, if any, to represent unpaid assessments. ~ection 3: That the City Clerk of this City shall certify and deliver a copy of this resolution to the City Clerk of the City of Fountain Valley.
